As the attached documents show, the complainant signed the membership registration agreement and paid a signup fee of $for the month of January On Febthe dues of $were collectedOn Feb the complainant requested cancellation according to the terms of the membership agreement Cancellation requires days notice and an additional full month of billing, therefor the March 1st billing for dues and Annual Rate Guarantee Fee on March 9th .Both the membership agreement and the cancellation request have the same email address as the complainant has used hereThese forms are automatically sent at the time of processing The balance remains and the member is responsible for all fees incurredWe have upheld our end of the agreement and cancelled future billing.The membership agreement and cancellation request have been resent to the email on file During the sign up process the prospective member is required to acknowledge that they have read and agree to the terms of the agreement before any money changes hands

Complaint: [redacted] I am rejecting this response because:We live two hours away from the Bellingham location We did not sifor or at the Bellingham Fitness Evolution, I do not even know the address or whereabouts of this business I signed up for my daughters membership through the North Seattle location online, which was somehow inadvertently linked to Everett, which I explained in detail in my original complaint We signed up for North Seattle as it is close to our home I have repeatedly attempted to cancel this membership and Fitness Evolution continues to automatically withdraw money out of my checking account I would like and need this withdrawal to cease and be refunded the amounts from the time I initially attempted to cancel the membership but was turned away or told to contact someone else.I should not have to contact Bellingham for any reason since I have never dealt with or visited that location, it is unreasonable for this gym to continue to charge me for a membership which we have no access to a location to use Sincerely, [redacted]

I am rejecting this response because: by December I was tired of paying for more training sessions than I had taken.I talked to the front desk and they informed me that my trainer ***, no longer worked there.I asked them how I could get the $charges to stop and get a refund for the sessions I had not takenI was told to come back and talk to the maanger [redacted] ***In January I talked to ***, I told him that I hadnt heard from my trainer in a couple months and that I was being charged $for training sessions I had not takenI told him that I wanted the charges to stop and that I wanted a refundHe told me that [redacted] should have called his clients, informed them that he was leaving and cancel the sessions [redacted] took my name and told me he would contact the corporate office to try to get my refundHe said that it could take from a week or so to a couple months to get it because they were very busy with new branches openingHe told me to to check back in a couple days an he would probably have information for me.I checked back two days later, he said hadn't heard anything an that it could take awhile longerI checked twice a week until February when I was charged $againIn February he told me to write a short description of what happened and sign itI wrote the letter and handed it to him on 2\27\I continued to check with him and tell him I was still being charged $100.by the end of March I started asking him if there was someone else I could talk toHe suggested I come back an he would call corporate with meNo Answer.We tried again the next week via conference call while I was at work...No answerI began to get frustrated an walked in again to talk to [redacted] He asked me again what was going on and who my trainer wasI told him, and told him that I was still getting charged 100$He then went into the computer looked it up and told me that I wouldn't get charged againHe said that he would continue to try corporate for my refundThe whole time I thought corporate would have to cancel the $charges and refund

When [redacted] joined the gym she was billed the enrollment fee of $and the prorated dues for August of $ On that day we received a payment for $leaving her with a balance of &which was included with her monthly dues on 9/1/and that charge was returned to us as "NFS While she was filling out her contract on an electronic tablet all the terms and conditions of the membership were explained to the member as well as the program will not let the member progress forward in the siprocess without acknowledging and accepting the terms of the contract Before giving payment information it is explained that a Credit Card payment has a surcharge and a Bank Account does not Additionally a completed contract is emailed to each member as soon as it is completed and according to the complaint [redacted] is receiving our emails.We do not charge any member for using the gym, we charge for a membership to the gym The cancellation form [redacted] signed states the need for days notice "which includes full month of billing This document was also emailed to the member after completion The original credit card given at siwas replaced on 9/but that credit card was also denied when we attempted its use for October dues.We stand by our contract which is regularly reviewed by the Attorney General of Maryland for accuracy and legality.Sheila K***Billing Manager

Better Business Bureau: I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me I would like a written confirmation that my account has been terminated indefinitely and will no longer use my bank information and continue to charge me If my bank information is used I will sue for FRAUD and Illegal business practices .I would like a written confirmation from the company within daysThank you for your help in this matter

I never stated that the contract said we could cancel in the club, I stated I was told by the gym manager Jennifer that we could come in and cancelIf that is not the case maybe the managers need better training
