I have forward this information on to the regional Manager for this club In regards to the annual fee I have adjusted the account so the fee will not be billed in July

On 4/20/I filed a complaint with the Revdex.com against Fitness Evolution because they wouldn't cancel my account and they continued to charge me even ater I was told it was cancelledThe Complaint ID [redacted] The business responded they would no longer be charging my account the $a month and I was fine with that and I said the complaint was resolvedIn checking my account for this month instead of charging me $I got charged $I wanted my whole account closed that was the point of my complaintI suspect they are still charging me possibly for my husband who was on my accountMy whole account was supposed to be cancelledI won't resolve this complaint this time until I get confirmation that EVERYTHING is cancelled and I get my $refundYou said I would no longer get charged and I was partially chargedThis business is shady and will do anything to get over on you

I am rejecting this response because: even though my membership was cancelled, I was not reimbursed for money that the company took out of my account because their team member, ***, signed me up for a contract I did not wantHe did so to get me in the door through a cheaper rate but didn't tell me that it was beyond the amount of time that I wanted my membership for

I am rejecting this response because:Myself and several others feel we have been and continue to be harassed by Fitness EvolutionThere is now a Stanislaus County District Attorney/fraud division open and active investigation into Fitness Evolution's practicesI have reviewed the copy and bill you provided through the Revdex.comI have found several areas where you have violated the contractFebruary 2, was my 1st request to end our relationship and at that time a balance of $was owedOn February 26, [redacted] (your manager) called and stated she could not find the contract and was closing my accountI am willing to settle for $This proposal of settlement will require someone from Fitness Evolution to accept my in person payment and sign a paper stating that1- Fitness Evolution has received a final payment of $and has closed my account 2-Swift Funds Financial Services, any other collection agency, entity or person representing you will cease trying to collect on this bill/account 3- Swift Funds Financial Services, Fitness Evolution, nor anyone else on your behalf has reported this to any credit reporting agency.Please let me know so I can proceed in resolving this matter to bring a final end to our relationship[redacted]

The membership under your name has been terminated and I do not see any current charges being billed to your account Did you pay for another person's account, or did you allow someone to use your billing information for their membership?

I'm sorry, but the company does not have proof of a cancellation request on file for the memberThe last form we received from the member was a call to freeze the account for monthsThe account currently has a balance due of $If you are unable to provide proof of cancellation, we will offer to settle the account for $(months worth of dues and all fees waived)

5/21/15There seems to be issues in [redacted] complaint-one being her Personal Training Contract and the second being her gym membershipThe Personal Training Contract cancellation was requested on 1/19/with a final charge on 2/1/This is signed by [redacted] , the trainand the PT Manager PeteThe last charge was made 2/but due to NOT SUFFICIENT FUNDS the payment which included JanPT (returned in Janfor NSF) was returned for NSF and was not collected until 3/4/There was no charge for PT in March.The Gym Membership Contract is separate and distinct to the PT ContractThe Gym Membership cancellation request is dated 4/3/It involves a 30day notice (noted on both the original contract and the cancellation request) and May was the last charge for [redacted] Her membership will be cancelled on 5/31/As to the charge of "take more and more money...feel like you can take out," the contract clearly states that past due balances will be collected and return fees charged for any payment not honored by the bank [redacted] signed her agreement to this policy 5/9/ [redacted] is not due any refundSheila K Billing Manager

I am rejecting this response because I don't think the business has understood the point of my concern and my issueWhen the business offered a cheaper plan it was done by their staff manager at the gym and it was done verballyI was told the membership would go down to $per month; there was no mention of any annual feesSecondly the business is claiming that I had signed the contract and that they emailed me a copy of the said contractThe gym staff a [redacted] showed me the online copy of the contract and I saw the signature on the contract it is not my signatureThen the gym said they are Initials **, anyone can forge initials and put them on the contractSecondly then the gym claimed they sent me an email, I asked the gym staff what email address they had on file for me and they confirmed they did not have my email address on file so no email was sent to meThe point is they are saying I knew and signed the contract so knew about about the annual fee and I am saying that is not possible because I was never given the contract, it was all done verbally by their manager at the gym someone called [redacted] Please note [redacted] no longer works thereI can wonder whyThe point is they have not shown any evidence that I signed the contract and was aware of the fee where as I have shown that they did not follow due diligence in their gym membership siprocess and hence I would like my annual fee refunded to me

The member has received a credit to her membership accountWe show her and her husbands accounts still open and activeThe credit is showing on her accountI've attached the transaction history

Member requested to have the personal training stopped after two months There will not be a refund issued as member was passed the day grace period
