I am rejecting this response because: I understand where the funds went, however I was not informed this would be happening If I had at least received an email, voicemail, anything, I would have been prepared I called the gym to find out why I hadn't received a reimbursement I was then told it was applied to my gym membership.There was never any response to my repeated calling No one ever picked up the phone for a "corporate" office I continued to contact the gym to at least speak to someone.Very unprofessional.As for the cancellation, I was not told it would be days before the cancellation went through.This could have been already resolved, but because there was never any communication on your part From my understanding, this company strives to make their members satisfied Clearly that is not true

I am rejecting this response because:This is untrueI went in several time as well and was always told that the manager was not inI said that [redacted] and I wish to terminateThey said that July would be my last payment but I had to come sign paper work with Manager but they were not inI made appointments and was also to receive personal training in which also didnt happenThey say you get personal training session each month but then when you actually wanna take it they say you have to pay for personal trainer and the one offered is only to upkeep if you take the classI had notified them a few times prior to 6/30/about cancelling my account as well as ***sThey always told me that the manager wasnt in and even on 30th when I went in they said that manager had to leave rescheduled for 2nd and still not available thenThen on 15th they over charged me $on each account $total for my final paymentI file police report and the officer said that they have heard multiple complaintsI also know several others that are experiencing these issues with this place

Fitness Evolution does have a membership agreement on file for this memberWe will remove the account from collections as a courtesy to member

I am rejecting this response because:when I inquired about cancellation, I was not told that it needed to be via certified mailS I have already submitted my cancellation and my membership card to the locationAgain, after reading other customer complaints, I am not the only one having this problem with things falling through the cracks with change of ownershipI would be happy to send my cancellation later that I have saved on my computer again, but I still would like to be refunded since JanuaryThis is ridiculous

5/21/15There seems to be issues in [redacted] complaint-one being her Personal Training Contract and the second being her gym membership.The Personal Training Contract cancellation was requested on 1/19/with a final charge on 2/1/This is signed by [redacted] , the trainand the PT Manager PeteThe last charge was made 2/but due to NOT SUFFICIENT FUNDS the payment which included JanPT (returned in Janfor NSF) was returned for NSF and was not collected until 3/4/There was no charge for PT in March.The Gym Membership Contract is separate and distinct to the PT ContractThe Gym Membership cancellation request is dated 4/3/It involves a 30day notice (noted on both the original contract and the cancellation request) and May was the last charge for [redacted] Her membership will be cancelled on 5/31/15.As to the charge of "take more and more money...feel like you can take out," the contract clearly states that past due balances will be collected and return fees charged for any payment not honored by the bank [redacted] signed her agreement to this policy 5/9/[redacted] is not due any refund.Sheila KBilling Manager

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because it does not actually respond to the refund request made in my Revdex.com complaint filed 11/13/15, and explained at greater length in my original letter of August 26, delivered directly to Fitness Evolution In addition, Fitness Evolution’s short response includes erroneous and misleading assertions Specifically, my original letter, and the subsequent Revdex.com complaint, did not request a refund under the contract Instead, I have acknowledged that the manager informed me that he would not refund my money, and that the contract states that there will be no refunds But the manager also indicated that I could send a letter to “the Ownership Group” to seek review of his decision All along, I have only asked for a refund as an exercise of discretion by the owners of the franchise, in view of the fact that (1) I sustained a back injury during my free personal training session on June 17, 2015, with Fitness Evolution’s Director of Personal Training; (2) the back injury caused me to seek medical evaluation and physical therapy at considerable out-of-pocket expense; and (3) the personal trainer with whom I was working and with whom I arranged a schedule that could be completed before his departure at the end of August, did not show up for the second session that we scheduled (on Friday, August 14) and subsequently informed me that he would be leaving sooner than originally expectedFitness Evolution's response to my Revdex.com complaint does not address the grounds for my refund request But it does state a few things that require comment and correction: It is irrelevant to my request that the contract does not allow for refunds or for the services of a particular personal trainer My request was for a refund because of the circumstances described in my letter and subsequent complaint It does not matter that "a liability release is a prominent part of the PT contract." I have not filed a claim for damages as a result of injury sustained during personal training under the contract My back injury occurred on June 17, 2015, during my free personal training session I did not sign a contract until the following day, on June 18, It is not true that "[t]he only appointment for training was made on 8/ I also had a specific appointment for 8/14/15, for which the personal trainer did not appear and did not let me know in advance that he would not be there In addition, I had arranged with the personal trainer that we would finish up my sessions over the last few weeks of August before his departure But he advised me on August 14, after he failed to show up for my session, that he was going to be departing immediately rather than at the end of AugustThe message left for me on 9/regarding the opportunity to complete my sessions with another trainer made no sense The manager knew that I had submitted a letter on August requesting a refund Why would I complete my sessions with another trainer while I was waiting for a response to my refund request submitted several days earlier? Asserting that I "refused the assistance of another trainer" is therefore quite misleading In the event that I am ultimately unable to obtain a satisfactory refund, I will consider the "offer" to allow me to complete the sessions that I paid for back on June 18, Thank you for this opportunity to reply to Fitness Evolution's response to my complaint [redacted]

The only cancellation notice on file is from February Per MCR agreement, the member must give day notice in writingIf member can submit proof of cancellation prior to February 2016, Fitness Evolution will gladly issue a refund

I am rejecting this response because:I refuse to pay anything to this company, I tried to cancel my contract on the 6th day from signing upThe attached is what they mailed to my home and the notes I've kept from each time I called to try and resolve the charges! That's not even counting how many times I went in person to their gym and speak to their general manager [redacted] We signed up on 3/21/16, their contract says that we have a day cancellation right, so I called them on 3/25/to ask if the $balance was waived off the accountThat's when I spoke with [redacted] who confirmed with me that the balance would not go through due to their promotionThen the April came around and the charges were applied!! So we went in person to talk to [redacted] who gave me their corporate phone number (that they never answer or return calls) and their "reps" e-mail (who also Never replies) and nothing was correctedWe tried to clear it numerous times in person, on the phone, and by e-mailSo no, we Do Not Owe them Anything because we tried to cancel within the allowed time and we were lied to!?!? This place is advertising!! I didn't seek their business, they looked for mine! It is so frustrating that this place is in business of lying to consumers and no one is doing anything for the protection of the consumer!! I cancelled my five year membership with fitness for this BS!! Where are the rights to the consumer? I trusted these people, I gave them my account information for god's sake, and this is what they do?!?! Lie, string customers along so that the time to cancel expires and Oh now you owe me this?!?!?

I am rejecting this response because: Fitness evolution obtained a sale of membership by using deceptionAfter my request to have the membership closed it is still openAs noted in my prior statement they refuse to close the account when I went to the gym to have it closed and now another bill is being accumulatedThrough their own admission it is still open forcing me to stay in membership as I stated beforeI want a refund based on deception and the account closed!!!

I am rejecting this response because:I was not given what I was promised when I singed the contract with the clubI have tried to contact the company many times and no responsethe trainer I signed up with can no longer train me as well as the new trainers times do not work with my scheduleattached is the letter from my doctor stating to cancel, I am being treated for a problem which this dilute is making worsethe company has no care for its customers
