Dear [redacted]:According to my records [redacted]'s past due account was sent to collections in May ’14. I am unaware of any payment plan set up between those two parties. The balance on the account in May was $254.93 and the membership was suspended in July, [redacted]...

[redacted] came to the gym and re-established her membership by providing new payment information. The payment terms of our contract are enclosed. When we collected the past due balance of $129,93 on 8/8/14 several of her payments to the collection agency had not been posted resulting in a credit balance to her membership account which will be applied to her future dues.There are no notes of explanations on her membership account referencing how or when the balance was to be paid, but memberships need to be current to be reinstated.Should there be any further questions, please contact our office.Sincerely,Sheila KBilling Manager

I am rejecting this response because: Regardless of what the policy was to terminate the membership, I was not told the letter had to be sent via certified mailuntil I received two returned letters and made 3 phone calls. There needs to be better communication between employees and members. Or maybe better training. Still requesting a refund and will continue to do so, because this is ridiculous. I know you have means to issue refunds. All businesses do.

sign the termination request or by sending in a certified letter to the facility.  The membership is set to terminate December 31st 2014 and there will be no further charges charged to your account.  Please note if the payments are returned for any reason included but not limited to charge backs, insufficient funds, etc. the account will remain active as we are unable to terminate memberships if the account is not in a good financial standing.

We took over [redacted] in April along with all of their memberships.  Your account was transferred over as an active account.  If you terminated your membership with [redacted] we would need the confirmation letter stating the account was terminated due to medical reasons.  Without proof...

I am rejecting this response because:No, you did not give your best attempt to resolve the issue, you gave me your corporate policies. There was no customer service or sympathy whatsoever. Keep the money you stole and go educate yourselves on hospitality and service.

I am rejecting this response because:
I clearly stated my intentions to Fitness Evolution at the time I signed up, to immediately cancel the membership after the two months. The employee helping me understood this and led me to believe this had been accomplished. The error was on the part of the gym, which either mislead me in thinking I had already completed the cancellation or misplaced the form. 
The gym can see that I never attended after the end of the two months. This is because I returned to my residence in Italy, just as the year before. 
I cannot understand why, when the gym was at fault, when clearly I did not and could not have used the membership past the two months and when I am clearly in good faith, they want to keep the money that was unduly charged and even held me to a 30-day cancellation policy when I contacted them to complain. It seems like a bad-faith money grab on their part.
I would like to have the three months from September to November fully credited to my account, or at the very least have them as gym credit towards a future membership.

Revdex.com spoke with a representative of the business who stated that they are no longer Fitness Evolution and in April of this year, bought the location along with the contracts and became Crunch Evolution. customer and they are unable to find any cancellation form on file. In the customer's records, the business confirmed that the last check in for the customer was January 2015. They also stated that the manager mentioned in the complaint does not work at this particular location, and is actually at a location in Sterling, Virginia, and this location is not aware of any previous attempts to cancel the membership. The business stated that the account has been cancelled, and that they are willing to offer a refund for the months that his account was a Crunch Evolution account in the amount of $99.95.

The response has been read.  Apparently the complainant refuses to adhere to the rules of the Membership Agreements signed by himself and his wife.  There is no further recourse at this point.

We spoke with the member in February and explained to her that in order to terminate her membership, we required that her past due amount on the account be paid. We can't complete the cancellation because of the past due amount. We are able to settle this account for $266.50.

An area of the gym that I used on a regular basis for the past eleven months has been cordoned off and designated personal training only.
I feel that when I joined this gym I had this area available and now I do not that they have reneged on what was I originally agreed upon.
I don't like to be crowded to a small place.
The owner/manager was very rude with poor people skills.
I would appreciate if my account was not debeted on feb. 15. I no longer intend to go there as the manager told me to leave.

I am rejecting this response because:  The club is being hypocritical about implementation of their rules.  They stated that any club member must be with a personal trainer when using the motion cage.  There was another club member using the motion cage by himself.  He was allowed to continue and I was kicked out of the club despite my being on the outside of the motion cage - all because he had paid personal training fees.  Again, the rules that were stated was the club member must be accompanied by a personal trainer for safety reasons.  Obviously, all they care about is making additional money.I would like a pro-rated refund!  ** does not personally like me because I objected to their change of the rules midstream disallowing access to the Motion Cage.  Upon signing up to the gym, the motion cage was made available.  2-3 weeks later, they closed off access to it.  The management team at Evolution Fitness obviously thinks they can do whatever they want and mistreat their customers.  There are alot of reviews on [redacted] about Evolution Fitness continuing to bill them after they cancelled their membership.  These guys are shady.The ethical thing to do is refund my unused membership since I paid in advance for 14 months.Thank you,[redacted]

The membership under your name has been terminated and I do not see any current charges being billed to your account.  Did you pay for another person's account, or did you allow someone to use your billing information for their membership?

membership was terminated. We are hereby terminating your membership effective immediately. Per section 18 of the membership agreement you signed you are in violation of the gyms rules and regulations regarding undesirable behavior. With that said it also states in the same section of your contract if we terminate your contract due to what we deem at our sole discretion to be undesirable behavior you will not be entitled to a refund of any portion of initiation fees or dues paid to the date of termination. In addition, since you are no longer a member of Fitness Evolution, you are no longer allowed on the premises. If you are found to be on the premises, we will consider this to be trespassing and the authorities will be contacted.   In regards to the other family memberships they are still active.  We do not issue any refunds on paid in full memberships.
