Please provide us with the proof of the both payment drafted so this may be reviewed.

We understand Mr. [redacted]' concerns. Unfortunately, our records indicate the Mr. [redacted] signed up for a month to month membership in which we have a signed membership agreement and Mr. [redacted] paid the $28.99 sign up fee.

I am rejecting this response because:Corporate has only returned one of my calls. They told me they have to verify my claims with the general manager that I spoke to at the time of canceling the personal training contract. They have since not returned any of my calls, or explained what these supposed costs are for. They continue to try and bill my account 3 times since I filed this complaint. Once for $480 and twice for $580. I've had to since close my bank account and this continues to cause stress and financial difficulties in my life. I want everything cancelled and all of the money I spent on the personal training sessions refunded since I never received a single legit training session.

I am rejecting this response because: As I have mentioned in my previous complaint, THIS IS FRAUD!! I will not be held responsible for this. I have never been a member and will never be a member at this gym. The documents you attracted, the receipt, has an address from Fair Oaks, CA. I am not from there nor have I ever been there. In a previous document you sent me it has the last 4 digits of a card number and now you are saying it was paid in cash. The other attached document that says "my account" is past due has only one person's name stating they called and a few text messages timed at 12:00AM!! My fake account that is now in collections and I supposably only received ONE phone call for it??  What this is showing me is that your company has poor communications with their "members" with any problems going on with their account. If I would have known about this fake account by being notified or any letters in the mail it would have been closed, immediately. How can such a company as yourself hold someone responsible for a fraud account?? You are not even trying to work with me on this issue. I need my information taken out of collections immediately. I have still not received any phone call back from your corporate office. You have such poor communication.

I show that the members received their refunds on 5/26/2015.

I am rejecting this response because:Once again you miss entirely my point, I was never actually presented with a copy of this paperwork at my signup, and was told repeatedly by your staff that I could only cancel my membership by appointment with the manager, as were several other people I knew. My roommate eventually called your original location and was told about faxing a letter to cancel her membership and promptly did so (this was approximately 4 months ago) only to discover last month that she was still being charged so I lack faith in your claims anyways. I am currently reaching out to others who have been robbed by your underhanded business practices and organizing them for public awareness. I will be contacting the press shortly, specifically reaching out to several popular news stations that run segments on poor business practices and swindled customers.

We recently acquired this location and the accounts were transferred "as is" in their system to ours.  It shows the there has been a balance of $132 running through the account since the initial sign up.  If this amount was paid we need confirmation so we may issue a refund.

Hi [redacted], we don't have contracts (meaning an obligation for a specific length of time), but do require a 30-day notice to cancel as part of our month-to-month agreement. I'd be happy to look into your account, but can't locate your membership. Could it be under another name?

In order to terminate the membership the account must be active and a 30 day notice is needed.  Any fees due during that period must be paid in order to terminate the membership.

Hello,Your Membership was transferred along with the purchase of all Fitness 19 agreements when the clubs closed. Per the original membership agreement, all memberships are transferrable, that is why your membership was carried over to Fitness Evolution, and the charges are valid. We never received...

any cancellation notice and we did attempt to charge the card that you had on file with Fitness 19. As a courtesy, however, we will waive balance that is currently showing on your account and close your membership.

Hi [redacted]. I see from the notes on your account that you would like to continue membership if this balance is waived. I just wanted to confirm that before reinstating your account.

In order for us to cancel a member's account, the account must be current and in good standing. Since the member stopped payment on her final monthly payment, we were unable to process fully her cancellation. Her account at this time remains open, since we still show a balance due.

We have contacted member directly on Friday and left a message. We will call again today to discuss charges as requested and process refund for $70 once we receive signed form back. We are unable to give a refund for [redacted] and [redacted] as the company has received chargeback notices for the  recent charges on their accounts. We will reach out via phone again today to further discuss the matter.

Hi,I do show that you have been talking with our company through [redacted]. We will go ahead and waive all remaining charges as indicated on [redacted] and close both accounts.I apologize for the confusion and will make sure the memberships are cancelled.

Fitness Evolution has already contacted the collections agency to see why the account is still reflecting a balance and to have cleared. The collection agency was  notified of the payment at the time it was made. Unfortunately, Fitness Evolution does not send the information to the credit agency, the collection agency does. They have been notified to correct the error as soon as possible.

We apologize, but there was a system error, and a refund is due to the member. Please find attached a refund form. The account was terminated as of 3/31/16

I am rejecting this response because I don't think the business has understood the point of my concern and my issue. When the business offered a cheaper plan it was done by their staff manager at the gym and it was done verbally. I was told the membership would go down to $19.99 per month; there was no mention of any annual fees. Secondly the business is claiming that I had signed the contract and that they emailed me a copy of the said contract. The gym staff a [redacted] showed me the online copy of the contract and I saw the signature on the contract it is not my signature. Then the gym said they are Initials **, anyone can forge initials and put them on the contract. Secondly then the gym claimed they sent me an email, I asked the gym staff what email address they had on file for me and they confirmed they did not have my email address on file so no email was sent to me. The point is they are saying I knew and signed the contract so knew about about the annual fee and I am saying that is not possible because I was never given the contract, it was all done verbally by their manager at the gym someone called [redacted]. Please note [redacted] no longer works there. I can wonder why. The point is they have not shown any evidence that I signed the contract and was aware of the fee where as I have shown that they did not follow due diligence in their gym membership sign-up process and hence I would like my annual fee refunded to me.

When we purchased Bally we purchased all the accounts as in their system.  We did try to reach out to the member when there was a balance due but did not hear back.  When we did speak to her in October we did reach out to try and settle the account but did not hear back.  There are no...

notes in regards to the account being either terminated or put on hold due to medical/health reasons.  If she terminated the membership we require a copy of the termination confirmation letter stating her membership ended with Bally prior to taking over.  If proof is not provided what I'm able to do is offer her a settlement payment of $116.32 to settle and close the account.

Never in initial response did the member mention her husband’s account. Her account was not charged again after April of 2015. I attached transaction history for her account. If she provides husband’s information, we can locate her account and look into transactions for refund.
