Review: I had a month to month membership with Fitness Evolution.

I cancelled my membership after 1 month, poor maintenance: no hot water in the showers, and sharp concrete in the hot tub, if the hot tub worked at all.

Mebership starting in November 2015 ending in December 2015, I was charged and paid for an additional month January 2016. When I paid for the month of January my membership was reactivated, I contacted [redacted] at the corporate office and he told me that he took care of it.

I considered the matter closed until I was contacted by a collection agency today July 20th 2016.

They never called me or emailed me that there was a problem.Desired Settlement: I was contacted by a collection agency today (7/20/2016)and I don't want a negative report to go to a credit agency that would affect my ability to get an apartment in the future.

Response:

Hi,I have attached a transaction history for your review. On 12/21/15 we show that there was a returned ck/cc. The return item fee of $5, brought the amount due for December to $23.99When you made your payment of $23.99 on 1/3/16, it was actually covering the December charges that were returned by your bank. The January dues were never paid for, the $23.99 went towards the December balance. Also, we do not have a cancellation on file for your membership. However, we can settle this account for only the amount that was due in January, $57.99.

Review: I canceled my membership back in 2012. When I moved to another city. I wrote a letter and everything that was required. They then kept charging an old credit card that had expired. Then tried to charge late fees for the payment not going through. When it was an old card than they knew it. They charged me $260 to my account. 4 years later they still have me in collections.Desired Settlement: Take me off of collections.

Business

Response:

HiNotes on the account show a request for cancellation in 2011. The member was informed by phone and letter that the membership termination was denied due to return of payment for final termination fee of $25. We had informed the member that it must be paid in order for us to process the cancellation. We can settle the account and remove it from collections if the member makes payment for $25 termination fee that was initially declined and caused the account to stay active.

Review: A certified letter was mailed to cancel the gym membership in May 2016 as of July 2016 the membership has yet to be cancelled while still being billed for it. They say they can not find the certified letter but they have received it because there is a note in the account stating so. A corporate business should not be losing certified mail.Desired Settlement: I would like to receive my money back for the past couple months that I have been charged since sending the certified letter. This is a huge inconvenience to me.

Business

Response:

HI,Our records show the member sent in a cancellation letter after 5/1. The dues for 6/1 are valid. The member was contacted directly by our corporate office regarding the certified mail receipt, which we have not yet received. I have attached a refund form for the $14.99 July dues. If the member could please fill it out and send it back with their Revdex.com response, we will get it processed. Thank you very much.

Review: Fitness Evolution failed to not only fix my issue but made it worse. I paid for personal training for three months and one of those months I was charged twice. First they told me they were going to credit the amount in my account but never happened because they kept charging me month by month. Tried to cancel my membership since they have a large sign on the entrance saying no contracts, I could cancel anytime, but they kept putting me off by telling me to leave my phone number and name on a piece of paper. Kept contacting them because they never called me back and they gave me a fake number for their corporate offices. Now they changed management and staff but haven't helped to fix my issue. The new member of management told me I have in my account a free month of personal training but all I want is my money back. They gave me their real number to their corporate offices but they told me they only deal with billing and I have to contact my local gym. It's been months and nothing happens.Desired Settlement: They tell me I have to pay the balance for the months I didn't go but they have in their systems records of the last time I have scanned my key card because I wanted the issue fixed. Now I lost the key card and it would be useless for me to get another when I'm trying to cancel my membership. I really want my money back for the month of personal training I did not request.

Business

Response:

Hello, On 12/16/15, the member was sent a refund form for $312 in personal training mischarges. The company has not received the form back from the member in order to process and issue the refund. The member's account has since been terminated.

Consumer

Response:

I am rejecting this response because: I had never received a form for refund and never received refund. I'm currently trying to cancel but haven't been able because I have to pay two months of membership I never used since I've lost the key card. I'm going to cancel until I get my refund.

Business

Response:

Hi [redacted],The initial refund form was sent via email. We do not send those by regular mail. However, once I get your refund form back, your refund check will be sent regular mail.

Consumer

Response:

I have received the check, yesterday was delivered. Thank you so much for easing the headache with this company and fixing my problem. Again thank you so much!

Review: I paid for a 2 year membership on 4/29/2014 the cost was $249.00 , I was denied access to the area of the Gym I use which is the exercise room for 3 months prior to ending date 4/29/2016.

This is a loss of $31.60 and 3 months of non use.

I need physical exercise to stay mobile and healthy being I was injured in an auto accident around 1975. I use the Gyms exercise room to accomplish this especially on hot or rainy days. I practice Tai Chi / Qigong.

I was denied access in January in a very rude manner. I complained and received no cooperation form the Gym or their management. At or near the end of 4/29/2016 they offered me access to the exercise area offered a similar price but with no adjustment for the 3 months lost, they refused to refund my money and suggested I join a different Gym.

In addition their employees were rude , unconcerned and thoughtless

throughout the entire procedure ( Jan-April).

In the beginning they treated their members excellent , however as time went on the Gym Mangers changed , the employees changed , they became unfriendly and were not trained properly.

Example 2 friends of mine met me at the Gym , they came to look it over and perhaps join ,they were denied ( in a rude manner ) access by a new untrained employee whom was left alone to run the place.

I met my Grandson and my daughter their to exercise I was told no one was allowed in the exercise room ( which is part of their equipment ) adding he didn't know where the key was , or which key it was , this person was rude , new , working unsupervised ( as no one seemed to be working ).

The employees at Fitness Evolution seem not to care about people.Desired Settlement: I feel as they owe me an apology and a refund of 3 months membership.

Business

Response:

Hello,We are very sorry, but we had to restrict access to the group exercise room due to theft. The club does reserve the right to change amenities at any time, and we did feel it necessary in this situation. As a courtesy, the corporate office did approve use of the GX room by the member and was contacted by staff. We would like to issue the member 3 months free membership to the club.

Review: On 4/1/16, I cancelled the two other memberships on my account, but left mine active. On 4/5/16, I was billed for thesetwo accounts. I was told by a manager that it takes 30 days for the cancellation to be in 3ffect. I let this go and unwillingly agreed to the charges. Now, on 5/5/16, I was billed again for these two accounts. This is well over 30 days from my cancellation date.Desired Settlement: I want my money refunded and for this company to respect my cancellation. I should not be charged for a membership that has been cancel led. Be a respectable business and honor your customer's requests. I kept one account active so you are still getting my business. There is no need to charge me for two other cancelled memeberships. Since you are causing this stress, it is making me consider dropping all accounts. Do the right thing and stop charging me for cancelled memberships, please.

Business

Attached are the cancel forms that were submitted on 4/7. The charges for both accounts are valid per the agreement, we can issue a refund as courtesy for [redacted] and waive the 30 day notice. Review: This notice is in reference to our contract agreements that we would make automatic monthly membership fee payments plus annual dues once per year. In September of 2014 [redacted] signed agreement to a monthly payment of $9.95. [redacted] signed agreement to a monthly payment of $29.95. We made the payments as per our contract through November of 2014. [redacted] then revised his contract to pay $7.95 per month. Payments continued to be made by us on time monthly through August 2015 when [redacted] revised her contract to pay $9.99 per month. Payments continued to be made in a timely manner through March of 2016.

As of March 31, 2016 we are holding you in BREACH OF CONTRACT for the following reasons:

Between March 15, 2015 and March 16, 2016 Fitness Evolution made 26 unauthorized charges to our checking account totaling $524.70. I have documentation authenticating the charges.Desired Settlement: If this breach of contract is not corrected within 30 days of the date of this notice in the form of a refund by check or money order for the full amount owed ($524.70), we will take further action to protect our rights.

Business

Response:

Hi,I apologize for the late response. I have been reviewing your accounts from March 15, 2015 to March 16, 2016. For [redacted] and [redacted], I show all the of the monthly charges and annual fees just as you mentioned in your email. Nothing additional was charged during that time period. I can forward you the transaction histories for both accounts. If you could please forward me the document showing the additional charges, it will be very helpful. On 4/20/16 I do show that both of your accounts have a declined payment. It was unclear in your email whether or not you cancelled both memberships in the spring, if so, we do not have any record of a cancellation notice being received for either [redacted] or [redacted]. If you have proof of cancellation, can you please forward it to me in your Revdex.com response. Also, while reviewing your account, I did find a third person attached to your billing, [redacted]. Could this add on to your membership be the additional charges you are speaking of? Thank you.

Review: I went into the Fitness evolution to pay my balance and close my membership in April. I was told that it was done and that I did not owe any more money. I received a text in June saying I still owed $15.00 for my membership and $10.00 late fee. I called and said I was never told I would have to pay another fee otherwise I would have paid it while I was there. I told them I was not going to pay the late fee. I went in and paid the $15.00 and the front desk person said she would handle it and call me later, she never did. I got a call yesterday saying I owe $15.00. When I called back to speak to the guy that called he couldn't talk and no one called me back. I emailed the corporate office last night and I am still waiting to hear back.Desired Settlement: I want a written copy that my membership is cancelled and any monies that they say I owe to be dropped.

Business

Response:

Hello,We do show that you came in to terminate on 4/21. The last month's dues were owed for 4/29 per the 10 day notice from [redacted]. The 4/29 charge was declined by your bank resulting in late fees. As a courtesy, however, we have waived the fees since the 4/29 balance has been taken care of. Your account is closed and there will be no further charges on the account.

Review: This gym, although claiming that the "non-contract" that I signed allowed me to cancel membership at any time, has made it impossible to do so. As I write this I am trying to contact the gym via phone having moved away and getting a message that they are not accepting calls. When I went in on a wednesday afternoon (almost a year ago) to cancel my membership I was told at the desk that I would have to schedule an appointment with a manager, who was not in, and the desk agent was not allowed to schedule an appointment for. I was told to go home and call the next day, upon doing so the manager was once again 'unavailable' at 11am on a thursday, I was told to try again either later in the day or the next day. This pattern continued for about a week before I made enough noise to get the manager on the phone. I was then told that appointments could only be scheduled monday-friday before 3pm (notice that these are the exact times I was constantly told there was no available manager). I happen to work those hours, like the vast majority of people, so they were making it functionally impossible to cancel my membership. They have now taken about $350 dollars from me. There is no way to contact the corporate headquaters, and you can only cancel at the location which you signed up at which in my case is 4-6 hours away. There are entire web pages devoted to the victims of this now bankrupt company (the facebook group victims of fitness evolution has 700 members!).Desired Settlement: I would like my account to stop being charged and a refund of the past 11 months (during which I have made many repeated efforts to cancel my membership) charges of $24.99 each and the hidden 'maintenance fee' of $44 for a a total of $319.49

Business

Response:

Our month to month members may go into the facility and sign a cancellation request, if they are unable to go into the facility they are able to send a certified letter requesting to cancel the membership. This is to ensure the member has a confirmation of the membership being cancelled. I do not show we have received any request to cancel the membership and it has remained active. What I'm able to is cancel the membership effective immediately, however there will not be a refund issued.

Review: I signed up for Personal Trainer services for six months - June 28, 2015, through December 31, 2016. I contacted the gym staff in January to be sure that they had discontinued monthly deductions from my account but was told that there was a 30-day notice requirement. I was never told about any 30-day requirement; however, they still charged my bank account for another month's fee. I was told when I signed up that after the 6-month period, I could extend my training for add'l months or stop the training at any time. I have been moving through the "chain-of-command" within this company asking for reimbursement of these paid services (8 days) which I do not want. Written complaint filed in March; Addt'l complaints sent to Corporate Office in April and May. No response to date.

I did continue training with a trainer in January and February to use up the carryover days left on my account from vacations I took in Nov and Dec. There are 3 days left. One of my trainers was a "no-show" on two separate occasions. I've asked for these five (5) days to be reimbursed as well. My 6-month training period was not what I was promised. From June 28, 2015, through February, 2016, I had 6 different trainers-got #7 for 1 day/getting #8 if I continue. I was promised training sessions which would be determined upon information from the trainers such as - monthly measurements and weigh-ins to check progress and change training options based upon that progress(I was measured/weighed only twice) and monthly nutrition counseling sessions (there were only 2). I discovered in December that all of my information was lost and that no information was being handed down from one trainer to the next - this led to each trainer having no information and basically starting from scratch each time. Based on this, I was unhappy with the handling of my training and did not want additional sessions. Staff say they have no authority to help me; management is ignoring my letters. Please help me get reimbursed for $455.00.Desired Settlement: Reimbursement of thirteen (13) sessions at the rate of $35.00 per sessions for a total of $455.00

Also, I've tried attaching my last complaint letter to this complaint; however, it tells me I have the wrong format and it won't take me to the next page with the attachment. It says the file can be a .pdf file which my file is - still won't accept it.

Review: On June 29, 2016, I was working out at the Fitness Evolution center in Pittsburg, CA. I was approached by a gentlemen who proceeded to call my "gay" and used other profanity for no reason that I was aware of. I don't identify myself as being anything other than a young man and the way that the General Manager handled the situation after I ran out of the gym in fear of my life was so not right at all. The General Manager talked with my mother first as she was really upset and then I talked with him and provided a description of the guy. The guy was still there and the only thing the General Manager said to him was, "don't do it again" This is so not right on so many levels. My son was a victim of a hate crime and all they say is that? My membership has since been cancelled after my mother called the corporate office and got the run a round but, I didn't receive an email as promised indicating my cancelled membership so I'm not sure what was done.Desired Settlement: I am requesting that Fitness Evolution refund my sign up fee so I can join another gym that has zero tolerance for this behavior.

Business

Response:

We would like you to know that our company does not tolerate this type of behavior and we do take it very seriously. I am confirming that your membership with Fitness Evolution has been terminated and there will be no further charges. Review: At the end of July 2015, I spoke with two Fitness Evolution Customer Representatives who assured me that my premium membership would be cancelled. However, it is nearly nine months later and a fee of $14.95 continues to be automatically withdrawn from my bank account. I have tried reaching out to the local business locations in my area, all of whom refer me to corporate which is seemingly inexistant. After countless hours of stressful research and being placed on hold for phone calls, I have resulted in filing a complaint through the Revdex.com as well as reporting fraudulent charges with my bank. As a struggling college student who is barely able to keep a minimum amount of money in my bank account until I must deposit money to pay a bill, this reoccurring charge sent me into the negative just enough for my bank to charge me an overdraft fee of roughly five times the amount that countines to be withdrawn from this business.Desired Settlement: I would be ever so greatful and relieved if I could just be treated fairly as many others who have filed a complaint with the Revdex.com have been treated. I hope that this business can refund the money that was unlawfully taken from me as well as figure out a way to resolve this ongoing issue with numerous other pre-existing customers.

Business

Response:

Unfortunately, the company has no record of the membership cancellation on file. If the member can provide us proof of cancellation, we can issue a refund for time that would have been outside of 30 day notice. At this time, we have set the account to terminate at the end of April.

Review: THIS CLAIM IS AGAINST FITNESS EVOLUTION DUE TO FALSE ADVERTISING. ON FEBUARY 3RD I WENT THERE TO SIGN UP FOR A REGULAR MEMBERSHIP WHERE I WAS GOING TO PAY 19.99 A MONTH, WHILE I WAS THERE TRYING TO SIGN UP THEY "EXPLAINED" TO ME ABOUT A GOOD DEAL THEY HAD GOING ON AT THAT MOMENT THAT WAS GOING TO COST $50.00 DOLLARS A MONTH A PERSONAL TRAINER AND NUTRITION BY PROFETIONALS, WT AND MEASUREMENTS AT THE BEGINING OF THE PROGRAM. THIS ENDED UP BEING A GROUP CLASS AND NO MEASUREMENTS THEY GAVE ME A PIECE OF AN OLD PIECE OF PAPER WITH FOODS I COULD EAT (NOT PROFESSIONAL) EVERYBODY WAS DOING THE SAME EXERCISES TO MY OPINION THAT IS NOT PERSONAL TRAINING. I ATTENDED TO THE CLASS FOR ABOUT 3 WEEKS AND MY BABY SON GOT SICK SO I COLD NOT GO ANY MORE BECAUSE HE WAS GOING TO HAVE SURGERY ON THE EARS. I WENT ON MARCH 5TH TO CANCELL MY MEMBERSHIP SINCE THE GUY HAD EXPLAINED TO ME THAT IT WAS GOING TO BE MONTH TO MONTH AND MY BILL CYCLE WAS GOING TO BE ON THE 5TH OF EACH MONTH AND THEY TOLD ME THAT I WAS STILL GOING TO BE CHARGED FOR THE MONTH OF MARCH THEY WANT ME TO PAY 90 DOLLARS WHEN HE SHOWED ME ON THE COMPUTER I WAS GOING TO PAY 30 DOLLARS FOR THE MONTHS BECAUSE I BROUGHT TWO MORE PEOPLE TO MY MEMBERSHIP

SUPPOSEDLY HE GAVE US A GOOD DEAL HE EVEN TOLD ME NO T TO TELL ANYONE ABOUT THE GOOD DEAL HE WAS GIVING ME. I TALKED TO TWO OF THEM IN THE GYM AND NO ONE WAS ABLE TO HELP ME SO THEY GAVE ME A NUMBER TO CALL AND NO ANSWER WAS GIVEN I TRIED CALLING 3 DIFFERENT NUMBERS BUT THEY TOLD ME TO GO TO Revdex.com THEY HAD NOBODY TO HELP ME THERE. I HAVE NOT ATTENDED TO THE GYM SINCE FEBRUARY 15TH AND I HAVE BEEN TRYING TO CANCEL SINCE MARCH 5TH BUT THEY ARE NOT LETTING ME BECAUSE THEY WANTS

ME TO PAY IN FULL FIRST AND I DO NOT AGREED TO THAT AMOUNT. THEY ALSO DID NOT SENT ME A COPY OF MY AGREEMENT. BUT THEY STILL KEEP SENDING ME ADVERTISEMENT THEY HAD THE RIGHT E-MAIL I DON'T THINK I OWE THEM ANYTHING. I'M ALSO NOT SURE OF TO GIVE THEM MY NEW CARD NUMBER SINCE I INFORMED THEM THAT MY BANK HAS SEND A NEW ONE.Desired Settlement: I DON'T THINK I OWE THEM ANYTHING I DID EVERYTHING WITHIN THE RULES AS HE EXPLAINED TO ME.

Business

Response:

HelloThe member has signed Fitness Evolution agreement on file for the $50/month. I have attached a copy of the agreement. If the member had come in on 3/5 to cancel, that would have meant payment due in March would've needed to clear in order to process the cancellation. The March payment did not clear, which left the account with a balance due and out of good standing. The member would have needed to pay the balance on the account from March, and the April membership dues to cancel the membership. Accounts cannot be cancelled that are not in good standing. We do show that the $20 referral was not credited to your account. We have put that credit towards your balance due, however, however, all other charges are valid with the 30 day notice to cancel.

Business

Response:

We have contacted member directly on Friday and left a message. We will call again today to discuss charges as requested and process refund for $70 once we receive signed form back. We are unable to give a refund for [redacted] and [redacted] as the company has received chargeback notices for the recent charges on their accounts. We will reach out via phone again today to further discuss the matter.

Consumer

Response:

I am rejecting this response because: I talked to [redacted] over the Phone and she said that, the claim that I have through them was clased, she said the money was back in My account. When I finished talking with her I called My bank and they said that they are still waiting for the response from fitness evolution. She also told me that [redacted] and [redacted] money was refounded and when I talked to them they said no money was refounded to them either. I tried to call [redacted] and no one is answering My calls. I Know My account was cancelled because she sent me a letter saying that it was cancelled and I was going to get 70 dollars from Last month that I should not have had to be charged for. I am about to Start going to the Dr. Because this is stressing me out very much and I will incluye My bills into this. I would like you to Know That I will Take you to court If that's the next Step to take.

Review: On several occasions I have asked to have a monthly childcare fee removed from my account. I have contacted my home gym, I have called a "corporate number" they gave me as well as e mailed through the fitness evolution website.

I have never received a response. My gym says they can only put in a request they cant remove the charges directly. It is going on 3 monthsn that I have been trying to get a hold of someone to get this taken care of.

The location manager says he doesn't have that authority, the franchise owner is never available, the Corporate number I was given always goes into voicemail so im pretty sure that it is just some bogus number to passify unhappy customers.

I have no complaints about the staff or the amenities of the gym. However this problem should be able to be solved with a few computer clicks yet somehow no one can help me.Desired Settlement: I asked for this charge to be removed in February, it is now May. I would like a refund or account credit of the $90 I have unnecessarily paid for a service I have requested to stop.

Business

Response:

Our records indicate the childcare service was added in February. The member put in a request on 4/11/16 to cancel. I have attached our notes. Cancellation requires a 30 day notice which is why the member was charged on 5/1/16. Both Childcare options are currently cancelled with no more further charges.

Review: I bought a membership with Fitness Evolution. When I was signing up for the account, I was told that I could "cancel anytime" in person or by mailing a letter. I only ever used the services at one particular gym location, [redacted]. In January 2016 I called this location to cancel my account, they told me that if I came in person I would have to set up an appointment with a manager and those appointments were very difficult to schedule so I should "just send a letter." I confirmed that I could send the letter to their location. They did not mention anything about a "certified letter" or that I needed to send it to any other location or corporate office.

I sent a letter on January 4, 2016. I received a text message on March 16, 2016 indicating that my account was "past due." I immediately called the Hamilton Avenue Location. I explained the situation. They gave me an email address to contact of [redacted]. I immediately sent an email with my attached letter. I never received a response.

On July 22, 2016 I received a call from [redacted] They claimed I owed $140.95 debt to fitness evolution and that if I did not pay that same day they would place a negative report on my credit report. I explained it was a disputed amount. I immediately called Fitness Evolution Hamilton Ave location. I spoke with Alyssa who confirmed they made an error not closing my account and she would "clear the balance" and properly close the account.

I received a call from [redacted], she acknowledged receipt of my March email and that fitness evolution never responded to the email. She claimed I owed $89.97 for Jan-April, yet I did not sue the gym. I asked to speak to her supervisor and was given the name [redacted]. I've left multiple messages for [redacted] with no response.

I cannot locate a corporate office address or phone number to speak with anyone to resolve this issue and avoid a negative credit report.Desired Settlement: I am asking Fitness Evolution to contact [redacted], Inc and remove my account from collections. Further, I am asking Fitness Evolution to consider my account at a zero balance and properly cancel my account as of January 2016.

Business

Response:

Hello,I appreciate your patience while we looked into your account. The company doesn't show any record of you cancelling your account on January 4th. Even though we do not have the proper cancellation notice on file, we have closed the account and we have also contacted the collections agency to remove your account from collections.

Review: I used to have a membership with golds gym which is not fitness evolution in Modesto, Ca. It's been since 2010. I noticed last year in February that I had been sent to collections by fitness evolution for a amount of 795.00?! I called and spoke to them to ask them why I had an amount owed and they stated that it was from an account I had from 2010 for personal trainer fees? I told them I had cancelled that a long time ago and why I am being notified of any fees 5 years later? Long story short they wouldn't take it off and I asked them to go through the files from back then and they would see I cancelled it and shouldn't owe Anything. They didn't budge and I told them I wanted it taken off so it can be taken off my credit report because I was in the process of buying a house. I settled it and paid them 515.00 and I received an email showing it was going to be taken off the beureus and it was. Now this year I get an alert on my credit report that I have a collection amount for 795.00 as of February 2016?! I tried to contact them email and call , and spoke to a [redacted] she sent me an email stating that it was a mistake sorry for any inconvenience and that she would contact someone to get it removed. She also told me that it would take 3 to 4 months to be removed off of my credit?!!! Really?!! This was your mistake. One week later I called the collection agency and they stated to me it is still showing up as I owe them 795.00 and that no one has contacted them from fitness evolution. I have sent 4 emails and tried to call continuously and no returned calls or emails from them. My credit score has dropped 20 points from this being on my credit as negative and is effecting me drastically! This company is unorganized and doesn't know what they are doing. They are trying to make money off people and ruining credibility. This needs to be stopped immediately. All I wasnted was their help in removing this from my credit report and it seems impossible to get anything out of these guysDesired Settlement: All I want is for this to be removed from my credit report immediately. This was an error that they made on their end and they are telling me that it would take 3-4 months to be taken off of my credit report. I want this taken off immediately. I also would like a letter stating it is taken off and all taken care of. This is very disturbing to know that this company is getting away with things like this that can effect people in many different ways. This company has no credibility

Business

Response:

I do apologize for what is happening with the account. We did notify the collection agency when that payment was made on 6/18/2015 and have sent a follow up email in regards as to why this is showing back up on your credit report. A letter was also sent to you in regards to this matter.

Consumer

Response:

I am rejecting this response because: the message states it was from last year in June 2015. What I am trying to get resolved now is something new. They put it on my credit report as if it is not paid and as it was never paid. It shows on my transunion credit report as of this yea. When I contacted the collection agency they stated I still have a amount due for 795.00 I told them I settled this last year and they didn't show it was paid. I need this cleared . This is ridiculous that the business obviously does not know what they are doing

Business

Response:

Fitness Evolution has already contacted the collections agency to see why the account is still reflecting a balance and to have cleared. The collection agency was notified of the payment at the time it was made. Unfortunately, Fitness Evolution does not send the information to the credit agency, the collection agency does. They have been notified to correct the error as soon as possible.

The only cancellation notice on file is from February 2016. Per MCR agreement, the member must give 30 day notice in writing. If member can submit proof of cancellation prior to February 2016, Fitness Evolution will gladly issue a refund.

Review: I am now a honorably discharged U.S. Army veteran and I am from here. I was stationed in Fort Campbell, KY and have done one tour in Afghanistan 2013-14.

Event 1:

Wife wants to downgrade from Premium to Basic.

Company will let her for a 560 dollar charge that is NOT disclosed in the contract nor was it verbally told us at the time of signing up, in fact we were told that we could downgrade at any time WITHOUT charge.

Event 2:

Wife Brings friend for "Guest Pass" Which there is a sign posted on the wall to do so.

Company let it slide this one time however mentioned that is only for last years members... it is July and does NOT state this.

Event 3:

Wife's Friend has a advertisement flyer from Fitness Evolution stating 1 month free trail. Goes to redeem said trail.

Company states she must pay for the trail. False Advertisement

Event 4:

Child in day care but constantly getting hurt and given items we expressly told not to. The adults in charge said they don't know how they get the items nor deny giving items. So are they not watching the kids. Also, I doubt this is a legal operation due to I generally see more then 10+ kids per adult generally 1. I go to cancel and they wouldn't waive the next month payment even though they weren't providing proper services.

Event 5:

Go to cancel on June 30th

Oh you will be charged the 39.99 for each member regardless of you canceling now even though it would be due in July due to the 30 days of payment you are required to pay after notice of cancellation. Maybe call "corporate" I call number 4 times and left voicemail... no contact.Desired Settlement: Refund and terminate my Service IMMEDIATELY

Hello,I have tried to address all your concerns from your email. 1. Regarding a downgrade fee, our rewrite to a basic membership is $49. That is the company standard rewrite fee in order to bring your membership from a premium to a basic $9.99 membership. The fee we charge is half of what the normal enrollment on the basic membership would be ($99). 2. The sign on the wall is referring to guest privilege rules, which are available to add on to a membership for $5 per month. 3. I'm sorry, but that specific marketing promotion you mentioned does not sound familiar. The latest offer was enroll for $1, and get the rest of the month free. We don't offer a one month free trial. If you are able to send me a copy of the promotion you are referring to, I will be able to review. 4. We would be happy to address your concerns with the staff, however I am not sure what "items" are being referenced in your email. If there is something specific, please let us know so we can bring this up to the staff immediately. 5. All month-to-month accounts are a 30 day notice to cancel, meaning anything owed within the next 30 days would be due to cancel. I do not show that cancellation paperwork was submitted on 6/30, however I will cancel out the agreements with no further charges. Both accounts will expire on 7/31, which would have been the date if we received cancellation notice on 6/30. Both accounts have been processed for cancellation.

I am rejecting this response because: 1. You 1st inquiry with " Event 4: Child in day care but constantly getting hurt and given items we expressly told not to. The adults in charge said they don't know how they get the items nor deny giving items. So are they not watching the kids." I am referring to markers and crayons. We told the staff to not give said items and they were still given or child wasn't being watched. Here is what happened. We finish our workout and come to get our daughter. Marker marks all over her arms and a few marks on her face and nose along with a scab. There were marker marks on her shirt as well. So, we ask what happened, We told you she couldn't have these. They go to say oh we felt bad about the other kids having them, so they ignored our request. Then we ask what happened to her face with the scab , they give us a puzzled look. My wife says was she being rough? They ran with it like a free bone "Oh yeah there was some scuffling"... riiight. So this just told us they didn't know and were not watching my child. That is why I didn't care for your 30 day rule due to this is not a simple cancellation but a warranted cancellation due to of lack of services and betrayed trust my daughter would be taken care of. If I sound annoyed, well I was heated before and still has a bad taste in my mouth. I am honestly surprised they don't do what Professional daycare do and separate the kids by age. 0-2 on section with no small objects or markers/crayons and 3+ in other part. What prevents a 1 and half year old from sneaking a crayons and choking on it? I just bring this up because I dont want to be working out and hear someone freak out because their kid is choking and now makes all of us parents frantic and getting upset. 2. I don't accept you cancelling my membership due to I have already paid the 39.99 fee for my wife and I,S what your saying you get the 80 dollars for free? I don't think so. I will accept a cancellation IF you reverse the 80 dollars (2 x 39.99) in fees. I was told not to cancel on June 30th and to just call the number and see if I would be taken care of. I will send screenshot of the calls. 3. The sign does not state a 5 dollar fee so this is misleading. If this were the case you have to put "see staff for details" or "with a separate service" otherwise you will have confused members and new people walking in will think what any person would think of "Oh cool I can bring my friend maybe, Sign me up that's a cool perk". Also, when asked to the staff about it I get " Oh that is from last year's premium membership, we don't know why we have that sign" 4. The trial card I will send you, I will cut you off before you say " oh it is for changing of a club, due to it saying : Member of another club?" Well anyone can have a club and I can form one with a few veteran buddies and make workout videos with some equipment so that is a very vague statement and can apply to anyone. I have read your reviews on [redacted] and maybe you should address them, because if I wouldn't have taken my fathers word for this place and read the reviews I wouldn't have signed up. In Tennessee companies don't treat people who served their country this way. I am getting a feeling California is different, hope I am wrong. How hard is it to make me the customer happy and let me downgrade for free due to it NOT being in the contract nor DISCLOSED by staff during the sign up? Are you guys just that disconnected from customer service guide lines to downgrade my wife for free and me an unemployed Veteran? I am seriously come on. I will go for the next few months until my Academy Date with the Sheriff department then I will be out of your hair but my wife will still come due to the staff in general are very nice and she has a few friends there. I have been in TN for the last 4 years and I forgot how to be heartless, I just want things to be square, ya know? I will add 3 attachments 2 of the promo card and 1 of the sign. I like your gym in general has a couple of veteran s I talk with and I have muscular gains. Hey one tip, put like cardboard or something on the vent facing the treadmills. That freezing air just cuts into your throat when running haha. I hope we can come to a mutual agreement. The front desk staff were unaware of my findings with the "Downgrade" fee not in the contract nor they even admitted to not regularly telling customers about it. To make me happy? Reverse the 39.99 fees (If you wish to cancel us)(80.00 total)And an apology for what had happened to my daughter. [redacted] Not Cancel us and let my wife downgrade to basic for FREE no 49.99 fee.Apologize for what happened to my daughter The above two are not some insane request is it? Sincerely, The [redacted] Will send attachments separate it won let me , keeps erroring out

Response:

Thank you for being more specific about the experience in our babysitting center. We do apologize for any inconvenience and our corporate office will be contacting the management immediately regarding your child's experience.Regarding the sign that you sent over, it is referring to our our "free guest" policies because we also have "paid guests". Anyone is more than welcome to inquire at the front desk regarding the guest policies. I do apologize if the guest policies were not clearly communicated to you at the time of inquiry.Thank you for including the marketing material. It does state that if you are a member of another club, we have a trade in special. Was your wife's friend a previous member of another Club? If so, her friend could qualify for that promotion by bringing in proof of cancellation to get a free month added to the dues. The promotion, however, does not mean that they don’t have to become a member of the club and can just use the club for a month at no cost. If you would like to keep your membership accounts open, we can reactivate them and adjust the dues to $9.99 for your wife as a courtesy. I hope I have responded to all the concerns. Please let me know if you would like to continue your memberships and we will make that adjustment to your wife's account.

Response:

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me.

Thank you, I appreciate you wanting to keep us. I will accept your offer of staying with this club and my wife being adjusted to 9.99 as a courtesy. Thank you, I look forward to our long professional relationship and continue doing business together. This helps us a lot and reinforces the idea that there are companies like yours that do care about its customers and veterans of the united States. Thank you! Sincerely, The [redacted] Family

Review: I signed up with Fitness Evolution at the end of April - I signed up under the following verbal pretenses: $19.99/month taken on the 1st of every month and an additional $39.99 on August 1st for maintenance. I agreed. I never received a copy of my contract due to the misspelling of 'Yahoo'. And still have not received it despite multiple requests.

I was charged on June 15th for $39.98 - Not the date or the agreed upon amount. I was charged again on July 16th for $58.99 - Again not the date or agreed upon amount.

It was a run-around to get in contact with anyone to discuss. When I did get in touch, I was informed of the contract I signed. Not apologized to that the club level reps are giving out incorrect information and not properly educated. There was no concern for the level of misinformation being given by the club level reps. I was told that the amounts were correct despite the fact that I had agreed to something different and never received a copy of the legal document I signed.Desired Settlement: I would like compensation returned for the fees I feel I was overcharged. In addition, I do not think I should have to pay a yearly maintenance fee as I only had the account for mere months and not once utilized any center. In addition I would like a copy of the legal contract I signed. Due to the fact that I never received this regardless of asking multiple times, I cannot be held liable for information that I am unaware of and that this company does not feel necessary to provide to me.

Hello,I have attached the transaction history for your membership. The $39.98 that was charged on 6/15 was from the initial first months dues that were not paid and for your June dues. There was only one annual fee charged. Although it is a valid charge per the 30 day cancellation notice, we can issue a refund for the $39 rate guarantee, as a courtesy. I have resent the agreement to the email you listed on Revdex.com. Please check your spam folder if it is not in your inbox. Please fill out the refund form and return it with your Revdex.com response and we will process your refund. Thank you.

Review: Last year in July , 2015 I signed up at Fitness Evolution gym in Natomas, Sacramento. I have only went there to workout twice since I signed up and decided to cancel the membership since I really couldn't go to gym due to working full-time. So I decided to cancel membership and I did in Aug. 2015 by returning the keytag/key and gave a written statement (about canceling the membership) to the receptionist who was present at the gym at that time. And today I received a call from collection agency that I owe 240.88 dollars to them and they collect it. I have never received any contact from that gym regarding this. I owe them this much amount. They also charged me for child care services, which I never signed up for.Desired Settlement: To stop the billing and contact the collection agency and seize the billing.
