Review: I joined Fitness Evolution on Hamilton and Meridian in October. At the time the manager offered me personal training. We agreed to 3 months of personal training. I was told it would be 12 sessions per month for a total of 36 sessions. What the manager entered was 24 sessions a month. Who signs up for 24 sessions? That would be 6 times a week. I was charged 864 for 3 months on my charge card. I thought it would be around 1200.00. So when I was charged the second time I thought, okay I need to look in to this. Called Manager and he didn't call me back. I then got busy and noticed charge card charged again 864.00. That is what I'm disputing. I called headquarters the person in charge of training was rude and very flippant. She said go ahead and dispute it, we have your signature. I said yes for 12 sessions not 24. Wouldn't work with me. I told her I wanted a manager from headquarters to call. Nobody called. Called the manager 3 times and nothing. Several employees told me that this happens all the time. For a new company it is sad that they treat customers this way. I certainly won't recommend them to anyone. I want the third charge credited back to my account. I will pay the 1700.00 I already paid and work my trainer. Do the right thing. Why have bad review after bad review over this? Also, I was never told that I had 5 days to cancel the training.Desired Settlement: I wanted my credit card adjusted 864.00 dollars. I also want to see these "emails" I was told they have discussing the training with me. I have never received any emails.

Business

Response:

We apologize if there was any confusion, however, we show the member signed up for a 3 month term at $864 per month. The 3 months have already been paid and the company has cancelled any future payments for the member. We do not show that any charges are owed back to member.

Consumer

Response:

I am rejecting this response because: they didn't respond to the request for the emails that they said were sent in October discussing this with me. They have not credited my account back the 864.00 dollars, and they have not addressed the fact that nobody has called me when they said they would. Of course they are not going to charge my account, they have all my money. I did sign up for three months but not at 24 sessions per month. Refund the 864.00. Also, this is how slimey your company is I signed up for the 9.99 a month. I was then charged 19.99, the lady at the front desk said if you want the 9.99 then you have to pay 99.00 dollar member fee for the year. I said okay so if I don't pay that then my account will just be defected 19.99, she said yes, and you will get the massage table and tanning. Why was my account charged 59.00 in December? Do you see how they rip people off. I will let every person on [redacted], [redacted], and whatever social media outlet I can think of to avoid your company at all costs. Refund the 864.00 due.

Business

Response:

Per our previous response, the company would be more than happy to refund any money owed if member can provide proof of request to cancel by the 10th of December. All agreements are automatically emailed to the member by the system once submitted. Email on file at the time was [redacted].

Consumer

Response:

I am rejecting this response because: this is how back asswards this company is...it has already been settled and I was even given 5 free personal training sessions because of the debacle. This company is awful. Please rate them as low as possible.[redacted]

Review: This company refuses to give me session that I clearly paid for and I have documentation stating that I paid and my trainer even said it too. I have a text message from the main office saying I paid but I still I am refused. I work with a trainer and I can't train because they are have so many issues. I am not double paying. I have more documents but I can't put it up here.Desired Settlement: I want my money back or my sessions.

Business

Response:

The personal training is done by Professional Fitness they can be reacted at 800-856-1229.

Consumer

Response:

I am rejecting this response because: I have called them many times and it still has not got resolved. They don't answer or return calls.

Business

Response:

Professional Fitness would be the person to contact in regards to this as we do not handle the training in house.

Review: Overcharged. I have tried to cancel for 2 months and getting the run-around. Cancellation approved but being charged another rate lock in fee

I shend up for membership in July on a promotion, I was encouraged to go for the highest level and told I could cancel or downgrade at anytime. I placed a card on file for automatic payment. I started reviewing my charges monthly and instead of $39.99/month I was getting charged an additional $5. I kept inquiring with no reponse until I was told early September it is for paying by card.

I requested to cancel in person and was told by the manager ([redacted])it can only be done by mail. I was shocked that mail supersedes a verbal in person request. He insisted it had to be written. So I requested to downgrade that day and he charged me a $10 fee to downgrade which was never disclosed). I maied a letter on September 24th to the downtown location. I called to verify and I was told it was cancelled by [redacted] but I got charged with another fee so I called again and I was told they had no record of my letter and whoever told me it was cancelled was incorrect. I was told I needed certified mail. I requested to walk it in person and said it had to certified mail. I requested the corporate office phone number or upper management and I was told there is no phone number. I searched online and was unsuccessful. I then sent certified copies to every San Jose location which cost me $20. Then they called to solicit me for some special event. I had enough and I called [redacted] assistant manager at the SJ 3rd street location the [redacted] office where I signed up, he assured me that it is pending cancellation but even though they received my cancellation 10/9. It will only cancel 11/30 and I iwll owe $19.99 or if I do not pay there will be a ton of late charges. I argued and stated. Termination is 30 days form th day they receive notice but this is more than 45 days out.

I am exhausted so I went in to pay so there is no negative reporting. I then received a follow up call from [redacted] who took the payment stating I will be charged for the rate lock in fee of $39 in November to lock in my rate so that the rat does not go up. At this point I don'yt know what to do. They are a scam with no corporate contact phone number or upper management available to address concerns. They keep taking money and do not live up to anything agreed upon nor do they disclose fees caccuratley. I sent a 30 day notice which [redacted]y refuse to acknowledge and now they want to charge me for a rate guarantee when I have cancelled. This is extremely unethical and they should not be allowed to operate.Desired Settlement: I would like my membership fully cancelled and no further charges pending since I settled my account in person on 10/22/14. I have sent 4 letters since 9/24 to cancel. I would like to be released from any further obligation and removed from solicitation calls.

Business

Response:

I do apologize for any confusion however the cancellation procedure is clearly outlined. I can assure you that we are not misleading you or trying to take advantage of you. This is our policy regarding cancellation and it applies to all members. All termination request need to be submitted either via certified mail or in club with a Manager. At this time your account is terminated and not further action taken. I have blocked any email, calls, or text that we have on file to not receive any advertising.

Review: I visited the new facility in Brentwood as and explained to the representative that I would try your service/club for 3 months. The Fitness Evolution marketing states "month to month/no Contract" so decided to try the club for 3 months. I paid cash for 3 months and used the service for 3 months. After 3 months I told a representative that I had decided not to continue as it did not work out. In addition, I did not want to supply my checking account # for automatic monthly payments due to identity theft worries. I was told I had a statement fee that needed to be paid. Never have I received an invoice with any fees. I've explained to numerous representatives including the store manager that I was giving the club/service a 3 month try. A corporate Representative contacted me about this late statement fee which I explained I was only on a trial membership for 3 months. She said the fee needed to be paid which is ridiculous. No one in your business has been receptive to speaking with me in regards to this and I refuse to pay a statement fee that exceeds an annual membership. I was sent to collections which could blemish my excellent credit score. If it does, I will be forced to file a lawsuit. Your business has been very unprofessional about the way this matter was handled. I asked to speak to the owner or someone with authority. Never I have I received a call in regards. I received a call and a letter from a collection agency which is the first ever to me or my wife. This is a very serious problem for Fitness Evolution as this is a form of extortion and fraud in my opinion. Some one needs to contact me in regards and remove this NOW.Desired Settlement: DesiredSettlementID: Other (requires explanation)

I'm requesting someone from the corporate office to contact me direct to clear this matter and take this fraudulent statement fee off.

Business

Response:

We offer month to month memberships with a 30 day written request to terminate the membership. I do apologize for any confusion however it does state in the agreement you signed that it is a month to month membership, no where does it state it is a trial for three months. I have attached the agreement for your records.

Consumer

Response:

I am rejecting this response because: I clearly stated that I would give the service for 3 months with their representative. I paid CASH for the 3 months in advance. No one in their corporation would speak to me reasonably about this issue after the 3 months expired. No one said to or asked me to terminate the service in writing. They just sent it to a collection agency which has put a dent on my excellent credit score. Their flyer and corporate motto clearly states: only $9.99 per month "NO CONTRACT". This is very misleading.

In addition, I have never seen an invoice with the charges they claim I incurred. The service was used for 3 months and no other service was used afterwards. They are a fraudulent and misleading company that should be taken to court on this matter. I am sure they extort many additional fees to many others in the same manner. I would appreciate someone from their corporate office who knows how to speak to a human being in a reasonable fashion to contact me personally about this matter and take it out of collections in additions to an apology.

Thank-you.

Review: I used to be a member of [redacted] fitness gym back in 2013 located on 150 S 1st St in San Jose, CA. About that time this [redacted]s fitness location was turned into Fitness Evolution. A few days prior my membership expiration, I received a couple of emails from Fitness Evolution warning that my membership was to expire in a few days. I decided not to renew the membership under Fitness Evolution. While enrolled under [redacted]s Fitness, I had a yearly membership that I manually renewed when it was time, [redacted]s sent letter notification to my home address warning that my membership was to expire. Last September 2015, after many months my membership expired, I found out that my credit score has been damaged by a debt claim posted by [redacted] LLC, located in Palos Verdes California. Such claim was posted on my credit report on 9/18/15. I called this company and informed me that the claim comes from Fitness Evolution for an unpaid membership. I asked this company why they didn't try to get a hold on me or contact me before making such report to the credit agency and damage my credit score, no response was provided. I called Fitness Evolution on 10/05/15 to inquire and they claimed my membership was on auto-renewal, claim that is not true. I never authorized Fitness Evolution nor [redacted]s to enroll me under auto-renewal. I contacted Juan Carlos Borja, regional manager with Fitness Evolution, and asked for proof that I agreed to be placed under auto-renewal, such proof has not been provided. I asked him why Fitness Evolution didn't make any attempts to contact me regarding their claim before sending it to a collection company and didn't get a response. Fitness Evolution didn't try to get a hold on me regarding this claim, never sent me a letter, never email me, never called me. They claim and un-paid fee of $108 which I paid to Fitness Evolution today 10/05/15 over the phone just to get this removed from my credit report as it has badly damaged my credit score.

Review: gold's gym extented my personal training contract without informing me, and put me on collection for not paying.

I was on gold's gym personal training contract. I had to freeze the contract for 6 months because of medical concerns. the contract ended in october 2012, but they extended it for 6 months without informing me. I paid november, december, january, and in april after the contract ended. and now they have me on collection for nearly $500. I don't think it's valid for them to extend the contract on top they charged me for extra 4 months. account# XXXXXXXX. they charged me $120 everymonth. I don't want to pay $500 more I think it's completely illegal.Desired Settlement: I want them to take me off from collection, and take off $500, which is completely invalid. they charged me 4 months already after the contract ended.

Review: I was incorrectly billed for $10.00 and sent to Swift Collection Agency for a total of $568.77. Fitness Evolution never attempted to contact me through any of my personal information on file to resolve the matter. I was contacted by the collection agency on August 3, 2015 and told if the matter was not resolved by August 5 2015 the debt would be reported to the credit bruea. Since contacting the manager on August 3,2015 the billing correction has been made showing I have a balance of $0.00 dollars, however unless the Fitness Evolution contacts Swift Collection Agency before August 5, 2015 they will post the debt that I do not have and am not responsible for to the credit bruea.Desired Settlement: I want no negative marks posted regarding my credit with the credit bruea's since I did nothing wrong. And I would like the remainder of my gym membership refunded to me in full since I will no longer be using their facility or any other facility Firness Evolution has a relationship with

Response:

Hello,The collections agency has already been contacted to remove the balance by Fitness Evolution as of 2weeks ago.Since this was a paid in full membership, and cancellation was not requested within 5 days, the member will not receive a refund. The collection issue, however, has been taken care of.

Review: I signed up for a 'no contract trial membership' with the Concord gym over two years ago online. I went ONCE. I informed a uniformed staff member at the gyms front desk, who identified himself as the manager that I would not be returning, and that I did not want to continue my membership. He assured me that he would take care of it and it would be a 'non-issue' as I only attended once. Nearly one year later without any other notice I was contacted by your corporate office that I owed $300 back pay for my membership that was not yet terminated. I verbally spoke to the corporate employee as well as emailed them stating my experience and my dissatisfaction. I stated that I did not want to be billed as it is ludicrous to charge someone $300 for one gym visit and not attempt to contact them with a bill for a year. I received no response or correspondence from anyone at your corporate office following my contact. Now it has been almost two years without contact. Last week I was contacted by a collections agency asking for $600 for a past due bill. I again called the Concord club to ask for resolution, who then directed me to a corporate phone number and email address to contact, again. I wrote as well as emailed this contact stating my situation, and the lack of any communication by your staff, as well as corporate members. I was assured by your staff member that I would be contacted by Monday June 15th at the latest; another month has gone by with zero contact.Desired Settlement: I am extremely upset and disgusted by the business practice of making zero effort to contact or communicate that a bill even exists. I have made several attempts, with no response; you're company simply continues to bill me and I've made it explicitly clear that I do not want to be billed, and would like this resolved immediately. Please remove this bill and/or mark from my account/credit immediately.

Business

Response:

We show that the member only has a balance of $408.88. The member was contacted multiple times after thebalance was on her account. In June, July, and October of 2014 regarding account. We do not show that this account was ever cancelled by the member. Although we show that all of the charges are valid, we can settle the account with a total of $265.77.

Consumer

Response:

I am rejecting this response because: I was never given a copy of the signed termination request form that I filled out in the club. The manager at the front desk assured me it would be taken care of. It is ridiculous that I am just now hearing back from someone, after contacting the Revdex.com, and have been sent to collections without even being contacted; I never received a voice message or letter in the mail of any kind. This is an absolutely unfair and poor business practice. There should be a balance of $0.00 as I tried the gym once, cancelled the same day in person with a manager and previously paid my $19.99 +tax for one month of use of a ’No Contract’ membership. Please clear this from my account immediately.

Business

Response:

We do not have a cancellation notice on file for this member. I have attached a contact log showing the different dates that the member received a call regarding her balance. The contract she signed does state that a 30 day cancellation is required. We would still like to settle this account for $265.77

Review: Hello, I am trying to get a refund for training sessions that I didn't use. Back on July 24th I was charged $768.00 for personal training sessions on my credit card. I spoke to the manager her name is [redacted] the next day to let her know that I had to cancel the training sessions, as my husband was offered a job in San Diego and we will be relocating. She said that she filed a request with their corporate office to get a refund. She did say that it takes 30 days. It has been over 30 days now and I have called their corporate office several times no one returns my call. I have asked [redacted] several times to look into the issue and she said they are working on it. I was given another number for their personal training center, I have emailed them called and left messages and no one returns my calls. Review: My daughter, who is a minor, signed up for a membership with Bally's Fitness on 1570 Hamilton Ave in San Jose. This was a month to month and you could cancel any time. The club was purchased by Fitness Evolution. She nor any other existing Bally members were given any new Term of Service or any info of any changes of agreement. In August of 2014 we received a letter with an offer to extend our enrollment with Bally's/Fitness Evolution. My daughter decided not to continue. I called the number to cancel and got a recording stating that I needed to send a letter to a Washington, DC address with a request to cancel. I sent two letters not trusting that one would work. Today, February 4, my daughter got a call that she owed $27.96 for past due membership fees. Her membership had not been cancelled. We went to the club and spoke with a manager who said she could not waive the fees but could stop the membership. She said even though Fitness Evolution purchased Bally's they were not the same corporation and that we should have sent a certified letter (even though that was not in the directions) and we needed to take it up with corporate. She admitted no new Terms of Service were given out but it didn't matter.Desired Settlement: I would like a refund of my $27.96 and if my daughter was charged past August on her debit card for that to be refunded also.

Business

Response:

I do not show any request submitted to terminate the membership until the recent payment made in club. Without the termination confirmation or the tracking number of the certified letter sent in August I'm not able to issue a refund.

Review: I closed this account back in June or July over the phone. This company continued to bill me after I requested the account to be closed. I contacted them in Aug told then to stop charging my credit card, I do not authorize any more charges to my credit card . They billed my credit card once again after I told them to stop and cancel my account. I contacted my back and filed a charge back the money was refund to me . I received an email from [redacted] from HQ telling me my account is still active if do not send a certified letter to close account it stay active until it goes to collections. Unless I give her 158.00 today, I refused to pay this company and I closed my account. I do not owe them the 158.00. I hate the fact that they feel they can keep this account active until it goes to collections. This company will not let you cancel your account .Desired Settlement: Close my account asap not charge me the 158.00

I am rejecting this response because: your company policy needs to be held by your employees and not me. I called back in July to cancel my services I was told at that time my account was canceled. I also explained I do not want no further transactions deduct it from my credit card. And place a stop payment on your services

The recent interaction with your company found that this account is still active and you guys are actively still trying to collect money for an account that was canceled in July.

your policies need to clearly be stated by your employees. I'm not liable for anything past July nor do I wish to continue services The fact that you guys are still charging me and will not cancel my account is unreasonable. And with threats to have this reflect on my credit is unacceptable. So I do not except a response

Review: I was a member at Fitness Evolution in Stockton from June 2012 until January 2013, when I was then employed as a customer service representative with the company. According to company protocol, my membership was to be terminated after six months of employment. In June 2013, after the six month period, my membership was terminated and I continued to work there for three more months. After quitting in late August 2013, my checking account was drafted $34.95 five months later in January 2014 for no apparent reason. The manager, [redacted], a one-time coworker of mine, told me I had no company number to call and I was to contact their offices through email to resolve the issue. She also proceeded to contact their headquarters in Modesto and told me I was to be reimbursed my money for wrongful drafting, but not for another three months. I then closed this checking account and had my bank reimburse my money, attempting to completely cut off ties with the gym. I had been told all my information was to be deleted, but it never was and, after following up on January 15, 2014 to ensure the wrongful billing was fixed, I was informed that my information would stay on file even though I have not been a member at the gym for seven months nor employed there for five months and that I now had a balance of $54. [redacted], the manager, told me that she would attempt to fix the issue, but the pace at which this is accomplished is unsettling, ambiguous, misleading an unacceptable. It is very uncomfortable knowing they will have my information and the ability to destroy my credit by drafting fees for a nonexistent service. Will I be reimbursed my money? Will I continue to have to check up on my "terminated membership" to ensure its balance is at $0? As an employee, I had to deal with these complaints on a daily basis, so now that I am on the receiving end of this injustice and understand the intricacies of the Fitness Evolution company, I proactively ask that a course of action be undertaken.Desired Settlement: Reimbursement of funds and deletion of my financial information on company databases.

Business

Response:

The complaint was resolved with our corporate office. Mr. [redacted] placed a stopped payment on the charge through his financial institution prior to us receiving notice of the billing error. The account is now at a $0 balance and has been terminated.

Review: When my first payment was due, I noticed they charged my account twice. They could not help me over the phone, so I went down there. They told me I had two accounts. They could not credit me back, but would delete the other account. They charged me twice again the next two months. I went down after each time. There was not anyone there that could help me. Even though they said they would take care of it. They would not even give me a name or number of someone at the main office. Customer service is awful. They are not helpful. The only thing for me to do is pay a fee at my bank to put a stop payment on it.Desired Settlement: I have been trying to get a refund for the extra charges.

Review: On September 2, 2015, I went to the Fitness Evolution (FE) on 3rd Street in San Jose, CA to cancel my month-to-month membership with FE. At that time, the FE employee at the front desk informed me that I didn't have any outstanding balance [in fact, in August 2015 I paid FE for the month of September. FE had my credit card information and would automatically charge my credit card every month.]. I also received a receipt confirming that I applied to terminate my membership with FE. Then around mid September my credit card was charged around sixty dollars [which was my normal month rate]. I contacted the 3rd Street FE by telephone about the transaction and the FE employee I spoke with refused to take the charge off. Then about a week later I received a phone call from a FE employee who said I owed FE an additional $20. I told that FE employee about the situation and he dropped his request. Then around mid-October 2015 my credit card was charged again by FE for $69.99. I haven't step foot in an FE since September 2, 2015 yet I continue to be billed by them.Desired Settlement: I would like a refund for the $69.99 that was charged to my account in October 2015. I specifically asked what I would need to do if I wanted to cancel. I was told I would only need to give 30 days notice and that would be all. I was also told there were no annual fees. I electronically signed my membership, never seeing a copy of what I was signing and never receiving a copy of what I had signed. I went in for one session the day after I signed up. then I got a session with a personal trainer on may 2, 2013. during that session I fell and hurt my leg. it is now july 12 and I am still on crutches. I figured I would cancel my membership since I couldn't be exercising for a while yet. I was surprised that they had still been taking out membership fees. so I went in today to cancel and was told it would cost 58.87 to cancel. they would not give me any corporate number to call. I feel that they misrepresented themselves when they sold me the package and didn't mention the annual fees because I would not have signed up if there were any. I think they do this on purpose. I see there are several other complaints for the same reason so this appears to be a normal practice for this company. Desired Settlement: I would just like to cancel my membership and not have to pay the cancellation dues that they did not mention.

Business' Initial Response

We apologize for any inconvenience to Ms [redacted]. Unfortunately the full termination policies and procedures are stated on the signed membership agreement at was provided to Ms. [redacted] via email at time of sign up. The signed membership agreement also states the annual fee. Ms. [redacted] please refer to the signed membership agreement for full details regarding termination and the annual fee.

Consumer's Final Response

(The consumer indicated he/she DID NOT accept the response from the business.)

at this particular time I just want to be done with this. I am actually afraid to say anything bad in case they decide to charge me more cancellation dues...retaliation I believe it is called. I was never provided a copy of any paperwork at all. I was lied to from the beginning....there were bait and switch tactics used....at this time I have paid for another month and I have paid the cancellation dues so I just want to be set free..I believe at a hundred and twenty dollars I have paid for my 1/2 hour session they have taken enough of my money.

Business' Final Response

Ms. [redacted] any and all dues owed during the thirty day cancellation period must be paid in order to cancel your agreement. This is in accordance with your membership agreement. Thank you

Review: In August 2015 I sent a certified letter to Fitness Evolution on [redacted] asking that they cancel my husband, [redacted]'s membership. Per our contract that is what was required of me to cancel the membership.

Fitness Evolution has charged my bank account an additional 4 months at $19.99/month. I have contacted multiple people, [redacted] and even went down to this location multiple times trying to get my $79.96 back. I have been told multiple times that I would receive a refund in a matter of days, yet my checking account keeps being charged and as of 1.5.16 I have not received any of my funds back.

Per our contract I have done everything asked of me to cancel the membership.Desired Settlement: I would like a total refund of $79.96 that I am legally owed.

Business

Response:

Member was already contacted regarding the refund. Refund pending return of refund authorization form.

Consumer

Response:

I am rejecting this response because: They form they sent for refund did not reflect the correct amount. They owe me $79.96.

Business

Response:

Hello,The amount on the refund form is correct. The cancellation letter we received was mailed on 8/28 and received by us on 8/31. I have attached the tracking information. This would make September the 30 day cancellation notice and the September charges valid. The refund amount of $59.97 is for the months of October, November and December. I have attached a billing summary. I hope this helps to clear up the refund amount due the member.

Review: I was a member of Bally's Willow Glenn site. Bally's closed that site and sold all the membership info to Fitness Evolution. I had cancelled my membership with Bally's way before that took place but some how it was never handled. I got a call from a collection agency saying I owed $179.00. I was never notified that charges were even being accrued. I was never sent any information from Bally's explaining that they "sold my information" to another company. No one will help me even though I have not been to the gym in over a year due to health issues. I have never signed in at the new gym. I spoke with the manager at Bally's [redacted] and he just said its out of his hands. The info was sold to Fitness Evolution so I must take this up with them. I cant even get in touch with fitness evolution customer service since they only have an email. No phone number!!!! Then I emailed many times. Finally I got a number. I spoke with someone and was told I would be contacted the next day. Never heard from anyone again.At the end of the day I have been sent to collections for no reason. Bally's says its business and they can do that. It's not right to send people to collections without proper notification that there is a problem. Other people have also filed complaints through the Revdex.com against this similar location and business. You may also refer to Yelp to review complaints from many others .Desired Settlement: 1) I would like my name removed from their system as an active member of that club. I have never been there to sign consent.2) I want my name removed from a The Collection Agency. I never was made aware that charges were being accrued. I never received notification that I was even a member. Nothing was sent to me about billing issues. }

Response:

When we purchased Bally we purchased all the accounts as in their system. We did try to reach out to the member when there was a balance due but did not hear back. When we did speak to her in October we did reach out to try and settle the account but did not hear back. There are no notes in regards to the account being either terminated or put on hold due to medical/health reasons. If she terminated the membership we require a copy of the termination confirmation letter stating her membership ended with Bally prior to taking over. If proof is not provided what I'm able to do is offer her a settlement payment of $116.32 to settle and close the account.

Review: I cancelled my membership with Fitness Evolution but they kept assessing fee and made my account delinquent and threatening w bureau reporting.

I cancelled my membership with Fitness Evolution but they did not accept my cancellation and also kept charging me unexplained fees when I have not even used the gym at all. They assess fees and made my account delinquent and are harassing me with collection efforts as well as threatening that they would report me to the bureau.

I disputed the charged with my bank and they settled my account with the gym in my favor and returned me my money. They are still keeping my account delinquent and this is a very difficult situation.Desired Settlement: I want Fitness Evolution to cancel all the charges on my account and close my account in good standing and not report false information to the bureau.

Response:

In order to complete any termination request the account has to be in good financial standings and the last month needs to be paid. You submitted your certified letter on 8/28/14. We accepted the letter, however, you did not authorize the payment that was due for August which denied the cancellation request. In order to complete the request that outstanding balance of $93.97. That balance include the months of August, October, and December: as well as the annual rate fee and decline fees. To make a payment you may contact your local facility or call ###-###-####.

Response:

I am rejecting this response because:I do not agree with your fee assessment. I do not believe that there should be any dues on my account. I requested cancellation of my gym membership in July and after multiple run arounds I was given the information for registered post and everything. You guys got it and then you agree that my account is cancelled and then charge me an ANNUAL MEMBERSHIP FEE? FOR WHAT? I am not even using the gym - why would you charge me an annual fee. I disputed the charge and you worked with my bank to agree to settle in my favor. Why would you charge my account again? And why would you assess more monthly fee when we both agree that I am not using the gym and we are trying to resolve the billing issue? I just don't get it. Please take this matter professionally and realize that I DO NOT have any dues to your gym. Please close my account in good standing. Best,[redacted].

Business

Response:

In order to terminate any membership the policy applies to all members, the account must be in good financial standings in order to terminate the membership. There is a 30 day written termination request that needs to be submitted either in club with a Manager or via certified mail, any and all fees incurred with that time needs to be paid in order to complete the request. If the fees are not paid the account will remain active. I do show you made a payment over the phone to the local facility on 12/11/2014, at this time your membership is terminated. Please note if the payment is returned for any reason included but not limited to charge backs, insufficient funds, etc. the account may be referred to collections.

Review: I called to end my membership with Fitness Evolution and was told the only way to cancel my membership was to take a letter to my local gym or do a certified letter. So one month ago 06-16-2014 I took a letter to the gym. When I got there I was informed by [redacted] at the front desk that I needed to do a certified letter or make an appointment with a manager. I told [redacted] about my conversation I had with an extremely rude person from the corporate office and I was never told I needed a appointment with a manager. She told me she was sorry for the misunderstanding and that she dealt with a lot of frustrated people when it came time to cancel their membership. I was told by [redacted] she would make sure that the letter got to the manager and she took my email and phone number down for the manager if she had any questions. 2 weeks went by and I never got a call or email, so I called in to check the status of my membership and it is still active and I was told they will not cancel it with out a meeting with a manager or certified mail. My membership needs to be canceled as of 06-16-2014. It should not be this difficult to cancel a membership. The customer service is poor and the lack of professionalism is horrible.Desired Settlement: I would like my membership canceled as of 06-16-2014.

Response:

We have been in direct contact with Mr. [redacted]. Several of our corporate managers have informed him of the proper steps to terminate per his signed agreement. To date we have not received a proper termination request per Mr. [redacted] membership agreement. The agreement states that there is a full 30 day notice prior to the next billing date that must be submitted via certified mail or in club with the manager via appointment with payment of the $25 termination fee. We have exhausted our efforts in informing Mr. [redacted] of the proper steps to terminate. It is in Mr. [redacted] hands to follow the policies and procedures he agreed to in his signed membership agreement.

Response:

I am rejecting this response because:

When I spoke with the person from the corporate office I was told certified mail or I needed to bring my notice to the gym, they did not tell me I needed an appointment to do so. I understand its a 30 day notice and I have to pay a termination fee. For them to say they have exhausted all efforts is laughable. I gave them my 30 day notice on 6-16-2014.

Business

Response:

Mr. [redacted],

I am one of the representatives that you spoke with here in the corporate office. I can assure you that both myself and the other representative informed you that if the request is done in club it must be with a manager by appointment to fill out the proper forms as the manager is the only representative in the facility that has access to change the status of a members account. Again, we have not received the termination form that would be filled out in club with a manager or a certified letter request as per your signed membership agreement. Also, the termination fee must be paid at the time of the request per your signed membership agreement. Unless the proper termination policies and procedures are followed per the signed membership by the member the account will continue to bill and remain active.
