Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my dispute
Please enter your reason(s) for rejecting the business response below.GM Lease Assumptions stated at the start of the process, it would take 30-days to complete in full GM sent a document stating the process was complete Now, GM is stating no it wasn't, our mistake That is not how things work in an accountable corporate world I am requesting a refund in full for the July payment as this letter is written proof that GM had completed their process The statement saying that it took longer, is unacceptable
Regards,

Thank you for the additional correspondence sent to the Revdex.comI have reviewed your concerns and would like to offer the following information
On August 10, 2007, you signed a retail installment sales contract for a Chevrolet MalibuWithin the agreement, you promised to
pay the amount financed of $10,and a finance charge of $5603.90, which resulted in a total of payments of $15,705.60, if all payments are made on the due dateIt is important to understand that this Contract is a “simple interest” contract in which interest is accrued dailyBy signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 18.95% in installments of $
In review of your account activity and payment history additional interest accrued over the life of the loan due to payments being made after the scheduled due date and deferments that were processed at your requestThroughout the time the account was active; deferments were processed for the months of April and May of 2008, May and June of 2009, May and June of and April and May of The account has also been paid past the installment due date on numerous occasionsIt is important to understand that when payments are paid late or deferred, interest will continue to accrue on the unpaid principal balance
Our records reflect that the account matured on April 10, On this date a maturity letter was sent to the address of record advising you that the final balance had become due in fullAdditional review of our records indicates that GM Financial had verbal contact with you on April 9, and that the representative made you aware of the remaining balance at that timePayment arrangements were made to pay four installments of $monthly beginning May of with the final payment due in August of Our records reflect that only two payments of $were received on May 23, and June 25, These two payments did not complete the GM Financial approved arrangement
Please note a review of your account reflects that your loan charged off on August 30, GM Financial attempted to reach you regarding the status of the account and upon charge off regarding the deficiency balance remaining
GM Financial is required to report truthful and accurate information to the credit bureau reporting agenciesOur research concludes that the account status and payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting
Please be advised GM Financial is unable to release the title as a deficiency balance still remains on the account
Included for your review is a copy of your contractPlease note a copy of your account payment history is being mailed to your address of recordShould you have any further questions or require additional assistance with regard to this matter, please contact GM Financials Loss Recovery department at ###-###-####

The business did not disclose and inform me of the the simple interest information This was a sneaky way to do a contract and I will not accept the response from the business I overpaid the payments thinking my balance was decreasing and it was notAfter looking at the payment history, majority of my payments are going towards the interest, which is NOT shown on the website

The complaint has not been resolved fully The vehicle has been returned and I just received the payment history a few days ago in the mail I still awaiting a response from GM Financial on the credit reporting and reimbursement of fees for their error

??? I am very confused? You just reject what I am pointing out? Here is the law as the way that I understand it based on what I have read. What the Debt Collector Must Include in its CommunicationUnder the FDCPA, a communication from a debt collector must meaningfully disclose the identity of the debt collector and provide what is called a “mini-Miranda” warningThe communication must: identify the debt collector (name, employer, and telephone number) state that the communication is an attempt to collect a debt, and state that any information obtained will be used for that purpose.GM Financial is claiming they are leaving me messages but they do not fit this mold or the mold that they themselves put forth when they originally called me asking for my money from my insurance company The messages they leave and I have several copies now only includes the persons name a phone number along with a time to call back.I asked them about this law on the phone and now through this venue Is there not an answer for this? Did they actually do what they are allowed to do?It is a very sad day when a company like this has the ability to help one of their customers at no cost to themselves and they choose not to Then on top of that when you add this practice how would anyone know more than I did?I will not be ok with this ruling without understanding this law and if it is being broken or not. Regards,
Jeremiah Keisling
