Complaint: [redacted]
I am rejecting this response because: Stating a 2 bills or statements were sent out to my address of record is a fabricated lie. I have had GM Financial for over 4 consecutive years, including presently with another car lease and they are infamous for sending out bills AND calling your number on record. They never sent a final bill whatsoever. Additionally, As of August 1st, GM Financial states the account is 109 days old. This would put the account notice as a start date in MAY 2017, yet again, GM Financial states they sent out a 2 letters in October, nearly 8 months after they allegedly sent out a bill.  Still also, ironically not one phone call or voicemail ever in 9 months this supposed bill and past due bill was sent. It's time they forward this information to their General Counsel or their Chief Compliance Officer to avoid litigation. They insist on giving excuses and the same redundant generic answers.  As an attorney myself, why wouldn't I pay a $700 bill when its due yet pay $500 a month on-time with my current lease with GM Financial. It is time for GM Financial to answer in a court of law.   Revdex.com- I thank you for your all your efforts.

Complaint: [redacted]I have reviewed the attachment and it not correct there are no payments shown in November 2016, I paid in cash at a Western Union in the amount of $140 and it is still not showing and I called several times to speak with someone about my account and they did nothing and did not even take the time to see why my account was past due in September and it was not ever looked or options to see how to correct on my end as well, and the one CSR I dealt with was rude and was trying to get payments from me after she would not tell the exact amount and still in December no one could tell me where the payment in November was and they were not posting the amount on the right month and it automatically caused it to be one month behind and accrued late fees.  I was at a 0 balance in January and logged into my account and had a 600 or more balance and I made January payment and I still have 600 balance it is February 10, 2017 I do not feel that amount is correct and this what happened last year.  Also when I called in December the CSR I spoke to told me there was a payment of 2000 made and I made a payment of 1430 so that is not correct and the December Statement is not on my account and there are amounts on my transaction history that are not correct.  And when they came for the car the CSR was trying to get me to make a payment and told me then finally they located the payment of 143 in November and that's not true and she never would try to communicate with me via email ever and that's inconvenient for me because I work and I cant call all the time during the day so they did not make several attempts at all and everytime I called it was a different story and it was that way in Jan. also.  I am  rejecting this response because:

Thank you for the additional correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information. On November 15, 2014 you signed a Retail Installment Contract and Security Agreement (“Contract”) for the 2015 GMC Acadia in the amount of $45,794.26 at an interest rate of 4.9%. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance. If all payments are paid by the due date, the account will be paid in full on the contract maturity date On August 19, 2015, our records reflect that you requested to defer the monthly installments for June 30, 2015 and July 30, 2015. Please understand that deferments are not a contractual obligation and are not always available. At the time of your request, approval of this deferment was subject to the receipt of the deferment amount and management approval. Our records reflect that the deferment amount was due on August 21, 2015 and that numerous phone calls were made, to both parties of this account, and voice messages were left in an effort to discuss the status of the account from August 24, 2015 up through the date the repossession occurred. E-mail correspondence was also sent to [redacted] regarding the status of the account on August 31, 2015, September 8, 2015, and September 16, 2015; prior to the date of the repossession. On September 2, 2015, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was 64 days past due. The vehicle was repossessed by Countrywide Asset and Auto Recovery on September 17, 2015.  Per your contract, if you default, you agreed to pay our costs for collecting amounts owing, including the costs and fees for repossession.  The amount you paid to reinstate the vehicle was $2,536.00. This amount included the past due amounts for the June 30, 2015, July 30, 2015, and August 30, 2015 installment due dates, the late fee balance owed on the account in the amount of $225.00, and the repossession fees of $395.00. Per your contract, a late fee is assessed when you fail to pay your scheduled payment in full within 15 days of the date it is due. When a vehicle has been repossessed, the account must be current in order to reinstate; this includes payment of the late fees. In an additional effort to assist you, the decision was made by upper management to offer you a deferment for the September 30, 2015 and October 30, 2015 installment due dates. Please be advised that the repossession company is an independent contractor and is licensed as such. Any claims against their company, like those regarding the damage to your driveway, will need to be addressed directly with their company and/or licensing authority. Included for your review are copies of your contract and account payment history. Should you have any further questions, please feel free to contact GM Financial at ###-###-####. Sincerely, GM Financial

Thank you for the additional correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
GM Financial understands that customers may face financial hardships throughout the life of their loan. Please understand that...

deferments are not a contractual obligation and are not always available. At this time, your account is not currently eligible for this type of payment assistance. If in the future, the deferment option is available and your account is eligible for this type of payment assistance, please be aware that all deferment requests are subject to management approval.
Should you have any further questions or require additional assistance, please feel free to contact GM Financial at [redacted]4.
Sincerely,
GM Financial

Here is my account number that they are asking : [redacted]. Thank you.

GM Financial and/or Americredit: It is my understanding based on your response that the amount that is alledged I owed of $1576.58 of a late fee balance has been satisfied by my payment of $1000 and any remaining balance of fees including the $576.58 has been waived and my debt to GM Financial or Americredt has been satisfied. I am also of the understanding that my compliance with your company's request on June 30th at approximately 5pm. to send in a payment of $800 in 48 hrs to satisfy this debt and allow the waiving of any future balances to go forward was the only option available to me in order to receive my car title. The sending in of a cashier's check was only offered on my part because I had no written commitment of our verbal agreement. Unfortunately to avoid the cancellation of the agreement altogether, I sent in a check by overnight mail, because 48 hours did not afford me time to have my bank issue me a cashiers check and get it there by July 2, 2015. I would like to thank all involve for assisting me with resolving this matter and hope that the receiving of my 2005 Ford Expedition title ends this business and financial relationship with your company.

Thank you for the additional correspondence sent to the Revdex.com. I have reviewed your concerns and would like to provide the following information. On January 10, 2010, you entered into a Retail Installment Contract and Security Agreement (“Contract”) with Rapid Motor, LLC...

for the purchase of the 2008 Dodge Durango. GM Financial employees were not present at Rapid Motor, LLC (“Dealer”) during the signing of the contract and GM Financial was not an original contracting party in any agreements between the two parties. The contract was subsequently assigned to GM Financial. You promised to pay the amount financed of $18,149.00 and a finance charge of $15,378.52 which resulted in a total of payments of $33,527.52, if all payments are made on the contracted date they are due. It is important to understand that this Contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on page one of your Contract under “Promise to Pay and Payment Terms”. By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 22.50% in 72 installments of $465.66.  A review of your account activity and payment history reflects that additional interest accrued over the life of the loan due to payments being made after the scheduled due date, two due date changes, and deferments that were processed at your request. Throughout the time your account has been active; 6 deferments were processed for the months of June and July of 2010, September and October of 2010, December of 2012, and January of 2013. Because of the due date changes and deferments processed at your request, the maturity date of the account moved to August 15, 2016. On page two of your Contract under “General Terms”, it is also explained that the actual amount you will pay may be more or less depending on your payment record. The deferment agreements were e-mailed to [redacted] on October 27, 2010, December 31, 2010, and December 3, 2012. Our records reflect that the agreements were signed electronically on the following dates with the following acknowledgement numbers:October 27, 2010 with an acknowledgement number of 800152  January 5, 2011 with  an acknowledgement number of 518068December 4, 2012 with an acknowledgement number of 279426 Within this agreement you were advised that interest will continue to accrue during the month(s) deferred on the unpaid balance of the contract at the rate specified in the contract and any deferment fee collected may not be sufficient to pay this accrued interest, and that this would result in a final higher payment due at the end of your contract on the new maturity date. On August 15, 2015, one year prior to the maturity date of your contract, the Simple Interest Maturity Notice was mailed to all parties to the Contract at their last known address. This notice advised you of the balance of your account as of the date of the notice and that based on your payment amount and the balance of your account, it was anticipated that your final payment due at maturity will be more than your regular monthly payment amount. Interest accrual was again explained within this notice. GM Financial is unable to honor your request to refund an amount of $3,259.62 or release the title to the vehicle. Finance Charges are being assessed as per your Contract and within the maximum amounts permitted for this sale by state or federal law. Copies of your Contract, Account Payment History, and the Simple Interest Maturity Notice mailed to you on August 15, 2015, as well as the electronically acknowledged deferment agreements have been mailed to your address of record. Should you have any further questions or require additional assistance, please contact Customer Service at ###-###-####. Sincerely,GM Financial
