reviewed your concerns and would like to offer the following information.
After further review of your account GM Financial was not able to confirm a conversation indicating you or anyone related to this account were told there was only 7 payments remaining, when in fact there were 9. All 9 payments have been made, however some of that money was applied to Excess Miles and Taxes. Our records do not support a conversation where GM Financial would waive the Excess Miles, as it is non-negotiable.
GM Financial is unable to honor your request to waive the Excess Miles. ”Per your Retail Lease Agreement (“Lease”) and the Addendum to Closed-End Motor Vehicle Lease (“Addendum”) you are still responsible for all contractual obligation as well as excess mileage charges as described within the Lease.

signed a Retail Installment Sale Contract for a 2010 Dodge Charger in the amount of $17,149.00 at an interest rate of 17.50%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $389.30 per month, beginning March 6, 2012.
On August 1, 2017, the decision was made to place the vehicle out for repossession, as allowed by the contract. At this time the account was 86 days past due. On August 8, 2017, Mr. [redacted] explained that he had not received any email from you on the date of July 22, 2017. Please understand that there can be no payment arrangement unless there is an agreement to the arrangement by GM Financial. Our records reflect that prior to the repossession an email was sent to you on July 27, 2017 requesting that you contact GM Financial.
In an effort to assist you, GM Financial allowed you defer the July 6, 2017 and August 6, 2017 installment due dates as part of your reinstatement of the vehicle. Please also understand that any calls made to you were made as a response to voice messages you left regarding the reinstatement of the vehicle. A cease and desist regarding contact via telephone is still in place on your account. Our records reflect that the reinstatement of the vehicle has been completed and that the vehicle was delivered to your address of record on August 15, 2017.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting of your account.

I have reviewed your concerns and would like to provide the following information. GM Financial reports to the credit bureau reporting agencies once per month. The payoff for your account was received on February 22, 2016, after the reporting date had passed on February 11, 2016. The next scheduled reporting date occurred on March 14, 2016. On this date your account was reported closed and paid, but more than 30 days past due at payoff. The “Date Closed” was reflected as February 22, 2016 and both the “Current Balance” and “Past Due Balance” were reported as $0.00.  The reporting of the account to the credit reporting agencies is done in accordance with the industry standard of the Metro II format in compliance with the Fair Credit Reporting Act (“FCRA”) and reflects the payment record of how the debt was paid. 48 month lease term with a monthly payment in the amount of $344.20 per month, due on the 23th day of each month.On July 2, 2015, at 8:11pm [redacted] submitted an ACH payment via the GM Financial’s automated system in the amount of $344.20. Confirmation for the submission of this transaction was 1113846. As this payment was submitted after 5pm and during a holiday weekend, the payment was not submitted for processing by Western Union until the next business day on July 6, 2015. This payment was applied to the June 23, 2015 base rent due date. On July 9, 2015, GM Financial received a return notice from Western Union of “No Account/Unable to Locate”. On July 22, 2015, at 6:28pm a payment in the amount of $344.20 was submitted by debit card online. Confirmation for the transmission of this transaction was 1197750. This payment was applied towards the June 23, 2015 base rent due date, when the lease account was 29 days past due.On August 19, 2015, at 3:27pm a payment in the amount of $361.41 was submitted by debit card online. Confirmation for the transmission of this transaction was 1333976. This payment was applied towards the July 23, 2015 base rent due date, when the lease account was 27 days past due.  On September 29, 2015, at 2:17pm a payment in the amount of $349.20 was submitted by credit card online. Confirmation for the transmission of this transaction was 1565134. This payment was applied towards the August 23, 2015 base rent due date, when the lease account was 37 days past due.  On November 9, 2015, at 3:49pm a payment in the amount of $699.75 was submitted by debit card online. Confirmation for the transmission of this transaction was 1844176. This payment was applied towards the September 23, 2015 and October 23, 2015 base rent due dates, at this time the lease account was 47 days past due for the September 23, 2015 base rent due date.GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. I am rejecting this response because: GM Financial just admitted above that I never game them that address that they sent correspondence to me to. Also, it is my understanding after speaking with the USPS that certified mail cannot be sent to a P.O box address. Therefore, GM Financial has knowingly sent legal notices that they are supposed to have confirmed I received and failed to do so.  They have not acted in good faith by purposely sending a letter to an address I am not associated with and to an address where it is impossible to confirm that I got it. They never sent any communication to any of the two addresses I gave them. Because of this oversight I am asking that GM FINANCIAL stop all collection activity and write off the remaining balance they claim I owe off the books. GM Financial is in clear violation of the law and knowingly contininugly violating the law by refusing to obey my request. All I am asking for is for them to stop collection activity and waive the remaining balance. They have already collected prior payments from me, a larger down payment,and have sold the car at auction. They have not technically lost any money from deal. Just take your profits and leave me alone! Why try to take more money from me illegally!?

I have done this before, it has been the company whom reported a "0" balance then immediately changed it back to an owed balance. Which is continually being reported as a balance owed when the account was settled in full. Immediately remove the item from all credit bureaus as I have file a complaint not only with Revdex.com, but the FTC and CPB. My next step will be a lawsuit for defimation of my credit as it is a closed/settled account and is now being re-aged to show it as a continuous debt.

Inadequate response to a serious issue involving GM Financial's Collection Agency. Terms were agreed to with Vital Recovery and GM Financial did not research/communicate with Vital Recovery to make sure the credit information is accurate per the terms of the settlement.

I am rejecting this response because: "Please be advised...."  Which being translated means, "We hear what you are saying, but we aren't going to do anything about it."  I will continue to reject any and all responses from GM Financial until my online account reflects the same information as provided in the payment summary.  Should anyone else read my responses......please do yourself a favor and do not do business with GM Financial.  They are consumed with corporate corruption and care absolutely nothing about the customer. I did speak to a representative last Friday, which was probably the fifth or sixth person to whom I have spoken since I've had issues with my account.  Never have I spoken to the same person twice.  I am extremely happy with my vehicle.  I am TOTALLY frustrated with the financing.  I will never do business with GM Financial again.  They only know of one way (their way) of doing business and have no interest whatsoever in taking a good customer's needs into consideration....even when I am trying to PAY AHEAD my loan.  If Daniel Berce cares about the company he runs, he should either fix this problem or resign.

As previously stated, GM Financial is an indirect lender and all credit applications are submitted through an affiliated dealer. On December 2, 2017, an application for credit was submitted through John Sullivan Chevrolet. GM Financial was not present during the negotiations of this purchase, however, our records indicate that GM Financial was unable to accept the initial terms requested. GM Financial is required to send the applicant a notice of Adverse Action. A secondary notice that reflects the specific reasons we were unable to offer you financing was requested on February 15, 2018. Please allow 7-10 business days to receive these notices via regular mail.
If you have any further questions or concerns regarding this matter, please contact your dealership finance department.
