I was told by your representative the first time that they would call me back. No one told me that they were going to do nothing. The second time it happened I called and your company representative told me that a promise to pay would prevent it running a second time. I was deceived by your company. That is fraud. Had I known it was going to run again, I would have borrowed money to prevent my account from being overdrawn. Once again, I was told by your company's representative that it would not run again. Yet it did.The first time I didn't know it was going to happen. The second time I did and I was proactive. I was told by your company that it wasn't going to go to my bank again. They lied. It did. They deceived me, whether intentional or not, I was lied to by your company and it caused me to be charged $120 in overdraft fees - this is the second time I am referring to. Not the first.When your representative called me after it ran a second time, she mocked and mimicked me. Made fun of the way I speak. Insulted me and hung up on me. I have dealt with crappy customer service before. I don't start Revdex.com complaints over a sassy CSR, I was mocked. I was treated as subhuman, and it not only made me feel uncomfortable, I felt harassed. It was even more disconcerting that this person has my address and phone number. After she hung up on me, I almost started to cry. Then she called me back and continued to verbally accost me. Regards,

I am rejecting this response because: Stating a 2 bills or statements were sent out to my address of record is a fabricated lie. I have had GM Financial for over 4 consecutive years, including presently with another car lease and they are infamous for sending out bills AND calling your number on record. They never sent a final bill whatsoever. Additionally, As of August 1st, GM Financial states the account is 109 days old. This would put the account notice as a start date in MAY 2017, yet again, GM Financial states they sent out a 2 letters in October, nearly 8 months after they allegedly sent out a bill. Still also, ironically not one phone call or voicemail ever in 9 months this supposed bill and past due bill was sent.It's time they forward this information to their General Counsel or their Chief Compliance Officer to avoid litigation. They insist on giving excuses and the same redundant generic answers. As an attorney myself, why wouldn't I pay a $700 bill when its due yet pay $500 a month on-time with my current lease with GM Financial.It is time for GM Financial to answer in a court of law. On March 31, 2014, you signed a retail installment sales contract for a 2013 Chevrolet Sonic in the amount of $27,251.50 at an interest rate of 9.90%. for the 2011 Nissan Murano in the amount of $16,630.44 at an interest rate of 7.90%. Within the agreement, you agreed to a repay the loan in 72 monthly installments in the amount of $291.73 per month, beginning on June 7, 2015.Please note that GM Financial places a high priority on adhering to all state and federal laws. The state of Wisconsin requires a cure period or notice of repossession be mailed prior to repossession. This notice was sent by United Stated Postal Service (“USPS”) Certified Mail to your address of record on November 19, 2015 with a tracking number of 9307 1200 1910 0039 6724 31. According to the USPS website, this item went Unclaimed and the Max Hold expired on December 12, 2015. GM Financial has not yet received this item in returned mail.On December 8, 2015, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was 61 days past due and no firm payment arrangements were in place. The account history was reviewed thoroughly and it has been determined that the handling of the account, including the repossession, was in compliance with your contract as well as all state and federal laws.Our records reflect that the vehicle was recovered on Saturday, December 18, 2015. Please understand that the Reinstatement Department is a fairly small department and all calls and voice mails are responded to in the order they are received. Our research concludes that the account status and payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the account and credit agencies.
Please be advised GM Financial is required to send a 1099-C to the Internal Revenue Service when an identifiable event occurs, pursuant to the Internal Revenue Code and the attendant Treasury Regulation. GM Financial determined an identifiable event pursuant to the Internal Revenue Service regulation occurred for calendar year 2016 and sent a 1099-C to you as required by the Code and Regulations. Please understand that the debt was not canceled or forgiven rather it was discharged and deemed as a loss to the company. The 1099-C was sent as required by federal law.

I am rejecting this response because:GM Financial is ignoring the problem caused on their end by a computer problem in December, and putting all the corrective action effort on the customer. I have confirmed with my bank, [redacted], that payment was made in early December, well ahead of the due date. I also confirmed payments were made in the previous month (November) and the month after (January) the payment in question. Because GM Financial lost the record of my December payment (but did cash the check!), I have filed a claim with [redacted] who will be contacting GM Financial directly.
