GM Financial Reviews (4045)

Complaint: [redacted]
I am rejecting this response because:As you can see from a letter I just received, GM FINANCIAL is reporting a credit tradeline over 90 days later for a lease that terminated on September 29, 2016. Additionally, as stated in my original complaint to the Revdex.com, State Attorney's Office, the CFPB and the FTC, GM Financial for some odd reason not only waited 9 FULL MONTHS to bill me for the lease that was completed successfully and terminated on 9/29/2016 but also NEVER NOTIFIED ME in any capacity whatsoever. GM Financial NEVER sent me a bill by US MAIL or EMAIL on record nor did they EVER CONTACT ME on my PHONE NUMBER OF RECORD, TEXT MESSAGE to the PHONE NUMBER OF RECORD, NEVER SENT ME EXPRESS MAIL, NEVER LEFT A VOICEMAIL and CERTAINLY NEVER SENT A PERSON LIVE EITHER TO MY HOME OR TO MY OFFICES OF RECORD AT ANY POINT WHATSOEVER.I VERY RECORDED DETAILED MESSAGE WAS LEFT WITH EUNICE PONCE stating the fact and stating that GM FINANCIAL has until 5pm this Friday August 4th to comply or I will be forced to file both a State and Federal Lawsuit for violating the Fair Credit Reporting Act and causing willful financial harm. To summarize, GM FINANCIAL leased a vehicle and was turned in on September 29, 2016 and for some apparent reason, they chose not only to NEVER send out a final bill to be reviewed and paid, but they waited 9 months to start the due date and without any notification whatsoever. Lastly, after receiving alerts on my credit report of a delinquent account, I caled GM Financial and they ask for all my information and said absolutely everything was 100% current on my current account and never again MENTIONED anything owed on this past account that was satisfactory and turned in (terminated) on 9/29/16.

Dear Mr. [redacted],
Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
As outlined in your Lease agreement,...

you are responsible for Excess Wear and Tear and Excess Mileage charges as described within the Lease. Total termination charges are calculated after the Lease Termination Inspection is done to the vehicle.
Please be advised the mileage exceeded by 851 miles at $0.25 per mile, for a total of $212.75 plus tax. GM Financial is unable to honor your request to waive the remaining Excess Miles, as it is non-negotiable. As of the date of this letter a deficiency balance is still owed on the Lease in the amount of $207.07. Our records reflect that the final bill was sent to the address on file on August 7, 2017.
A copy of the final bill is included for you review. Should you have any additional questions regarding this matter please feel free to contact Lease Customer Service at [redacted].
Sincerely,
GM Financial

I am rejecting this response because:well that's too bad for GMAC financing what a shame to treat your veterans and law-enforcement that way after 32 days and not 60 or 90  like any other company before reporting it to a credit report bureau.  While GMAC financing does have the ability to remove this from a credit report it is their choice to remain strict on their policy of 32 days delinquent while I veteran is overseas in the military Croatia what a horrible customer service company I will never ever Buy a vehicle through GMAC again and I will be forwarding all the correspondence I had with GMAC and the Revdex.com to all of my local TV stations and social media don't be surprised if you see it in the near future the way GMAC treats a veteran -  you can say all you want about following policy and strict guidelines but the general population is going to see otherwise on this particular matter - what a shameful company with no heart whatsoever I hope the story goes as big as the Applebee's manager who took away the veterans meal on Veterans Day.  Again what a horrible horrible customer service for United States veteran who was overseas to be bullied by GMAC on a credit report for 32 days delinquency shame on you!  Thank you for being patriotic GMAC I really do hope this goes viral you have been given an option and chose to do the wrong thing thank you!

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.
Please enter your reason(s) for rejecting the business response below.
I was told by your representative the first time that they would call me back. No one told me that they were going to do nothing. The second time it happened I called and your company representative told me that a promise to pay would prevent it running a second time. I was deceived by your company. That is fraud. Had I known it was going to run again, I would have borrowed money to prevent my account from being overdrawn. Once again, I was told by your company's representative that it would not run again. Yet it did.The first time I didn't know it was going to happen. The second time I did and I was proactive. I was told by your company that it wasn't going to go to my bank again. They lied. It did. They deceived me, whether intentional or not, I was lied to by your company and it caused me to be charged $120 in overdraft fees - this is the second time I am referring to. Not the first. When your representative called me after it ran a second time, she mocked and mimicked me. Made fun of the way I speak. Insulted me and hung up on me. I have dealt with crappy customer service before. I don't start Revdex.com complaints over a sassy CSR, I was mocked. I was treated as subhuman, and it not only made me feel uncomfortable, I felt harassed. It was even more disconcerting that this person has my address and phone number. After she hung up on me, I almost started to cry. Then she called me back and continued to verbally accost me.   Regards,

The request we/I have been making is simple: I want you, GM Financial, to show the actual breakdown of the interest for each deferment, for my loan. Show us the exact calculations. A blank worksheet does not provide that.  Why won't GM Financial provide information to consumers regarding their account? Does it have to be requested through court? If so, please provide me with the mailing address.

Re: Complaint ID: [redacted]

Dear Ms. [redacted],
Thank you for the additional correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance. The Total Sale Price shown in the Truth-In-Lending Disclosures on the face of your contract assumes that all payments will be made as scheduled. The actual amount you will pay may be more or less depending on your payment record.
In review of the account activity and payment history, more of your monthly payments were applied to accrued interest due to payments being made after the scheduled due date. Please note that throughout the time that the account has been active, six deferments have been processed per your request for the months of February and March of 2007, October and November of 2007, and May and June of 2008. Please understand that when a payment is deferred or delinquent, interest still continues to accrue.
If you have any further questions or are in need of additional assistance regarding this matter, please contact GM Financial at [redacted].
Sincerely,
GM Financial

Dear Mr. [redacted],
Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to offer the following information.
Thank you for forwarding the additional correspondence.
Please be advised that GM Financial has not changed our position regarding the account.
Thank you for your time and insight regarding your experience with GM Financial.
Sincerely,
GM Financial

Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to provide the following information. On December 10, 2012, you signed a Retail Installment Sale Contract (“Contract”) for the purchase of a 2012 Chevrolet Cruze in the...

amount of $21,046.32 at an interest rate of 10.90%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $401.21 per month, beginning on January 24, 2013. Please note that GM Financial places a high priority on adhering to all state and federal laws. The state of Pennsylvania does not require a cure period or notice of repossession be mailed prior to repossession. On November 19, 2015, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was 56 days past due for the September 24, 2015 installment due date. The vehicle was recovered on November 22, 2015 and reinstated on November 24, 2015. On June 23, 2016, the decision was again made to place the vehicle out for repossession, as allowed by your contract. At this time, the account was 60 days past due for the April 24, 2016 installment due date. The vehicle was again recovered on June 24, 2016. The account history was reviewed thoroughly and it has been determined that the handling of the account, including both repossessions, are in compliance with your contract as well as all state and federal laws.  Please understand that due to the bankruptcy filed and discharged, GM Financial is unable to issue a monthly billing statement; however, our records reflect that you were advised verbally in February, March, April, and June of your monthly due date and the past due balance owed on your account. All payments that you have provided proof of have been accurately accounted for within the payment history of your account. Based on a review of this information, it appears that payments are not being made every single month, and this led to the delinquency of the account and the assignment of the vehicle for repossession.  The State of Pennsylvania is a redemption state, meaning that if we repossess the vehicle, you may get it back by paying the unpaid part of the Amount Financed plus the earned and unpaid part of the Finance Charge, any late charges, and any other amounts lawfully due under this contract. GM Financial made an exception and allowed the reinstatement of the vehicle in November of 2015. Since the reinstatement of the vehicle, you have not maintained strict compliance with the terms and conditions of your Retail Installment Contract or the Reinstatement Agreement; resulting in a second repossession of this vehicle. GM Financial is unable to make any further exceptions, and in order for you to get the vehicle back; you will have to pay everything owed under this contract in full, prior to the vehicle being sold at auction. Our records reflect that you were advised of this information on June 27, 2016. Additional copies of your contract, payment history, and Reinstatement Agreement have been mailed to your address of record. Should you have any further questions or require additional assistance, please contact GM Financial at ###-###-####. Sincerely,GM Financial
