Complaint # *** Consumer: *** *** We are in receipt of the consumer complaint filed by Mr*** in connection with a Background Report he conducted on the Intelius website on June 27, Intelius customers are presented with a two-tier pricing structure when
purchasing reports on the Intelius websiteEach offer includes the standard full one-time purchase price and a second discounted report price plus a one-week trial of the Intelius Premier Plus membershipIf the user elects to continue with their selected report type but does not wish to continue the Premier Plus membership they are instructed to cancel the Premier Plus membership within the first days and they will only be charged $(plus applicable taxes) for the Premier Plus trial membershipHowever, if the user does not cancel, the member is enrolled in the Premier Plus membership and their credit card will be charged a monthly fee of $(plus applicable taxes) going forward Mr*** was notified of this offer and trial membership when he selected his report type and again on the payment information pageAdditionally, he was required to manually select a checkbox on the payment information page before he could complete his report purchase that specifically notified him of the offer and the membership terms, including that his credit or debit card would be charged $(plus applicable taxes) if he did not cancel his day trial membership, a phone number to cancel his membership, that his membership benefits would continue through the last month for which he paid and that there are no refunds or partial month creditsMr*** was presented with language in the same checkbox that by clicking the button to purchase, he agreed to the Terms of Service and Privacy Policy (with hyperlinks to each) Intelius does not currently offer membership subscriptions that include all report typesThe Premium Plus Membership includes unlimited People Search reports and one monthly Background ReportBackground Reports includes everything in People Search reports plus additional information such as criminal check, bankruptcies, lawsuits and marriage/divorces records for the specific state identified in the user’s original search queryThe user is offered both prior to the completion of their report purchase and within the purchased report product, to broaden their search query and include areports that include federal and nationwide record checksPlease see the attached copy of the report purchase and membership offer, report add-ons, the purchase page and the in-report federal and nationwide offers According to our records, Mr*** canceled his free trial within the initial days and was only charged $plus applicable taxesPer the Terms of Service Mr*** agreed to upon the completion of his purchase, Intelius has a no refund policyHowever, as a matter of customer courtesy, I have provided a refund of the Premier Plus trial membership fee in the amount of $plus tax ($total)Mr*** should note this refund on his account within the next to days depending on his financial institution’s billing cycle and internal refund policy This information should successfully resolve Mr***’s complaintShould your office or Mr*** have any questions or need additional information, please feel free to contact me at [email protected] Sincerely, Tara M*** SrIP & Marketing Compliance Manager www.intelius.com

different levels of information about individualsWe have removed the requested information from the US Search database, as well as affiliated sites.We recommend Ms*** review our privacy policy located on the US Search website at https://www.ussearch.com/about/privacyGenerally, we do require an individual’s identity to be verified prior to processing an opt out. To do this, we request that proof of identity be submitted along with the removal request. Proof of identity can be a state issued ID card or driver's license. When uploading, faxing, or mailing a copy of a driver's license, we require that the photo and the driver's license number be crossed out. However, we do need to see the name, address, and date of birth to ensure that all information is removed from our database. If an individual does not feel comfortable faxing us their driver’s license or other state issued identification, they can send a notarized statement of their identity.Additionally, it is important to remember that the procedure to opt out is temporary. US Search is constantly updating their database with new public records. It is possible that an individual may need to resubmit a request to opt out for any new records that may have been added to our database since their last opt out request. While we are unable to anticipate how, when, or if information will reappear on our site, we will be more than happy to remove an individual’s information upon request We appreciate your cooperation in resolving this issue and apologize for any inconvenience

Per Mr***’s request, we have removed his information from the Intelius database, as well as our affiliated websitesHowever, it is important to remember that the procedure to opt out is temporaryIntelius is constantly updating its database with new public recordsAt some point in the future, an individual may need to resubmit a request to opt out for any new records that may have been added to its database since their last opt out requestWhile we are unable to anticipate how, when, or if information will reappear on our sites, we will be more than happy to remove an individual’s information upon request.

Intelius customers are presented with a two tier pricing structure when purchasing reports on the Intelius website. They have the option of paying the full price, or a discounted promotional price which includes a 7-Day Pass of the Intelius Premier Plus Membership. When a customer
selects the promotional price, they are presented the benefits of the membership and the terms and conditions of the offer, including billing. By choosing to proceed with the purchase at the promotional price, the customer agrees to the terms and conditions of the promotional offer.In this case, the promotional offer was accepted and the Intelius Premier Plus 7-Day Pass was activated As requested, the Intelius Premier Plus 7-Day Pass was canceled on 10/20/and a refund for $was issued on 11/2/2015. Additionally, we want Ms*** to be fully satisfied with her purchase from Intelius. Since she was not completely satisfied with the Assisted Phone Search Report, we have also processed a refund of $to her account on 11/2/2015. This refund ($7.95, $0.95) will appear on her statement in one of the next two billing cycles depending on the closing. Again, all charges have been refunded and no future membership charges will occur.We appreciate your cooperation in resolving this matter and apologize for any inconvenience

I am rejecting this response because I have never been attached to the email address: ***@yahoo.com. Perhaps this was part of the Yahoo hack or something -- but I never opened up this email address or have ever been associated with this email address. As such, any acknowledgement that I accepted terms of use would be invalid and therefore, I would request that Intellius refund the entire amount. Someone else using a fraudulent email address to use their service is not acceptable and I should not have to pay for that. Furthermore, I find it disheartening that despite all of my attempts to get customer service reps to solve this problem, they wouldn't figure this out until I got the Revdex.com involved. I had provided the Intellius team even a transaction ID, which I told they could not locate, which is also difficult to understand.However, the fact remains that ***@yahoo.com has never been my email account

Intelius customers are presented with a single page display offering enrollment in the Intelius Premier Membership. When customers accept the offer they enter their email address as an electronic signature and select the “Yes, Show My Report” button to confirm their acceptance of this
offer. The customer can also decline this offer by selecting the “No, Show My Report” button. All of the offer details and benefits of the membership, including billing, are listed on the offer pageIn this case, the promotional offer was accepted and the Intelius Premier Membership was activated The Intelius Premier Membership was canceled on 6/3/along with the pending charge of $ Additionally, Intelius does not state the number of criminal records that are available prior to purchasing a report. However, we want Mr*** to be fully satisfied with his purchase from Intelius. Since he was not completely satisfied with the Statewide Criminal Check, we canceled the charge of $on 6/4/2016. This will reflect on his statement in one of the next two billing cycles depending on the closing. Again, all charges have been canceled and no future membership charges will occur.We appreciate your cooperation in resolving this matter and apologize for any inconvenience

Intelius customers are presented with a two tier pricing structure when purchasing reports on the Intelius website. They have the option of paying the full price, or a discounted promotional price which includes a 7-Day Pass of the Intelius Premier Plus Membership. When a customer
selects the promotional price, they are presented the benefits of the membership and the terms and conditions of the offer, including billing. By choosing to proceed with the purchase at the promotional price, the customer agrees to the terms and conditions of the promotional offer.In this case, the promotional offer was accepted and the Intelius Premier Plus 7-Day Pass was activated Using the information Mr*** provided, we were able to locate an account for him which was in his name. Mr*** was only charged $for the Intelius Premier Plus 7-Day Pass and $for the People Search Report. The Intelius Premier Plus Membership was canceled on 2/13/and a refund for $was issued on 3/1/2016. Additionally, we refunded the charge of $for the People Search Report on 3/1/2016. The refund will appear on Mr***’s statement ($& $0.95) in one of the next two billing cycles, depending on the closing date. Again, all charges have been refunded and no future membership charges will occur.We appreciate your cooperation in resolving this matter and apologize for any inconvenience

While not required to do so, we do, as a courtesy, accept requests from individuals to opt out their personal information from our databases once they have verified their identity, usually with a government issued form of identification, such as a driver’s license
What this means is that your name as it appears in a particular record and the associated identifying information such as your address and phone number will be suppressed if you requestHowever, please note that any time your identifying information appears in a public record or in a publicly or commercially available manner, in a way that is different from the particular record you opted out, it may again appear in our databases
For example, if your address or area code changes, your new information -- including other associated identifying information may again appear unless you opt out the new recordSimilarly, if the way in which your name or address appears in a record differs from a record you opted out (e.g., "*** ***" instead of "*** ***," or "*** *** *** **" instead of "*** *** ***"), we may include the differing record

According to our records, Ms*** purchased her initial search report on December 18, Ms*** then cancelled her Premier Plus membership on December 21, Since Ms*** cancelled her Premier Plus membership within the first days, her account was charged the $trial membership fee rather than the full priced Premier Plus fee of $Since Ms*** cancelled the Permier Plus membership, no further membership charges will be billed to her account
