Intelius customers are presented with a two-tier pricing structure when purchasing reports on the Intelius websiteEach offer includes the standard one-time purchase price and a second discounted report price plus a one-week trial of the Intelius Premier Plus membershipIf the user elects to continue with their selected report type but does not wish to continue the Premier Plus membership they are instructed to cancel the Premier Plus membership within the first days and they will only be charged $for the Premier Plus trial membershipHowever, if the user does not cancel, the member is enrolled in the Premier Plus membership and their credit card will be charged a monthly fee of $(plus applicable taxes) going forward ? Intelius provides clear disclosures within the report purchase process of the Premier Plus membership offer.? Below, I have outlined the process and various places in which Intelius notified Mr [redacted] of the membership offer and details? On November 25, 2017, Mr [redacted] purchased a discounted People Search Report in the amount of $(plus applicable taxes), which included a 7-day trial membership of the Premier Plus membershipMr [redacted] was notified of this offer and trial membership when he selected his report type and again on the payment information pageAdditionally, he was required to manually select a checkbox on the payment information page before he could complete his report purchase that specifically notified him of the offer and the membership terms, including that his credit or debit card would be charged $(plus applicable taxes) if he did not cancel his day trial membership, a phone number to cancel his membership, that his membership benefits would continue through the last month for which he paid and that there are no refunds or partial month creditsMr [redacted] was presented with language in the same checkbox that by clicking the button to purchase, he agreed to the Terms of Service and Privacy Policy with hyperlinks to eachA representative copy of this purchase page is attached for your review ? According to our records, Mr [redacted] did not opt out of the Intelius Premier Plus membership or contact the Intelius Customer Care team about his membership prior to the expiration of his trial membershipAs a result, his credit or debit card was charged $on December 3, in accordance with the disclosures and the Terms of Service that he agreed to during his initial purchase? Per the Terms of Service, Intelius has a no refund policy, however as a courtesy, an Intelius customer care representative who spoke to Mr [redacted] via telephone on December 7, granted Mr [redacted] a refund of his membership fee in the amount of $and removed him from the membership programMr [redacted] should note this refund on his account within the next to days, depending on his financial institution’s billing cycle and internal refund policy ? Intelius is not currently offering gift cards for purchase, however, we would be happy to add search credits which match the value of his gift cards to his account.? Ms [redacted] ’s submitted her initial automated request on January 26, 2018, her information was removed from the Intelius database, as well as our affiliated websites no later than January 29, ?
