Member purchased personal training services pursuant to a written and fully executed agreementThe agreement was for a minimum initial term of weeks, beginning 10/31/(the “Initial Term”)She paid a total of $up front, which included the processing fee and payment for the first four weeks of personal training sessionsShe further agreed to make more payments, in the amount of $each, every four weeks, beginning 11/28/14, for the remainder of the Initial TermMember’s personal training agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only 50% of the remaining balance due under the agreementOur records do not reflect that member has paid such a fee to terminate her agreement earlyThus, billing has continued in accordance with the terms of her agreementIt should be noted that her personal training agreement also contains a provision that allows her to terminate her agreement early without a fee if she becomes physically unable to avail herself of a substantial portion of the servicesSuch a cancellation shall be authorized upon member furnishing certification of such a disability by a physicianLA Fitness will honor either of these cancellation provisions of member’s agreement should be elect to take advantage of themOtherwise, she should be expected to honor her agreement as LA Fitness stands ready to provide the services for which she contracted

Member purchased personal training services pursuant to a written and fully executed agreement (“Agreement”)The Agreement was for a minimum initial term of months, beginning 10/19/(the “Initial Term”)Member paid a total of $up front, which included the enrollment fee, processing fee and payment for the first month of personal training servicesShe further agreed to make more consecutive monthly payments, in the amount of $216.67, beginning 11/19/16, for the remainder of the Initial TermThese terms are clearly outlined on page of the Agreement and she acknowledged her understanding of these billing terms by initialing three separate sections of the payment schedule section of the AgreementHer Agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the Agreement This provision is clearly outlined on page of the agreementIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement with the initial term of months and the voluntary cancellation provisionThis Checklist was reviewed with her at the time of the sale, as acknowledged by her signature and initials on the New Client Checklist (copies of the Agreement and New Client Checklist are included with this response)Additionally, member’s personal training services agreement specifically provided her with a 3-day right to cancel if these terms did not match her understanding (or for any reason) for a full refundHowever, she did not take advantage of this option within the rescission period Thus, under the clear and explicit terms of the Agreement, member is not entitled to terminate the Agreement and abandon her contractual obligations (which were very clearly spelled out for her and acknowledged by her) early without a feeLA Fitness will honor the voluntary cancellation provision of the Agreement should she elect to take advantage of itOtherwise, she should be expected to honor her Agreement as LA Fitness stands ready to provide the services for which she contracted

Management contacted [redacted] regarding the cancellation of the monthly dues membership for his father [redacted] *** [redacted] stated he attempted to cancel both memberships via telephone and in person in January The history on [redacted] ***’s account reflects that a cancellation was received and processed for only his membership LA Fitness provides members with the option to cancel their membership at any location with an Operations Manager between the hours of 8AM-5PM Monday through Friday, but we strongly advise that member's mail in a written cancellation request via certified mail to ensure return-receiptThis cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properlyThere is no history on [redacted] ***’s membership regarding receipt of such a cancellation request Nevertheless, as a courtesy, we have completed a cancellation for [redacted] ***’s membership on September 7, We have also agreed to a refund in the amount of $90, which was comprised of charges after the date [redacted] *** states he requested a cancellation for both membershipsRefunds typically take 5-business days to completeWe believe this matter to be resolvedThank you

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below I did elect for a reduced buyout as the business was not willing to stop withdrawing funds from my bank account while I was waiting for them to respond to my complaint through the Revdex.com I was disputing the personal training contract and was is discussions with the corporate office as well as the location however when I requested that they stop withdrawing the funds from my account I was advised there was nothing they could do and they withdrew another $from my account for May sessions They continued to withdraw money from my account for service that I was not receiving leaving me no option but to take the reduced buyout to get them to stop As I did not receive the service they have been paid at no fault of my own, it was their error as they did not have a personal trainer then I should have been given the option to exit the contract without any further penalty Regards, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below They are not the same termsThe electronic document has an initiation fee, and the paper contract that I signed has no initiation feeThis changes the contract terms despite the same dollar amount total and was the basis for my disputeAlso, the electronic contract that I didn't sign was attached to my account and not a copy of the paper contract (as accessed from the lafitness.com login)I had a problem with this when I noticed it, immediately addressed it, but my concerns were not answered until months laterIn addition, SOF means signature on file which is on the second page of the electronic document, but clearly there is a signature (squiggly line as an LA Fitness called it) that does not say SOF or Signature on File on the first pageI haven't used the gym until I got this resolved and would at least like to be credited for the previous months since the end of November, which is the last time I entered the gym Regards, [redacted]

Our District Vice President contacted member regarding her concerns and we cancelled the remaining term of her personal training agreement with no further billing or obligation

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below It's not a "customer service" when there was complete misrepresentation and trickery of the personal training membership Anyways, I went ahead and cancelled my membership in November and was refunded the $for the last month of usage of my gym membership that I had paid when joining This covers a refund for my November membership because we didn't use the gym but I do need a refund processed of $for October because I requested that LA Fitness cancel my gym membership immediately, and that request was made on October 16th, well in advance of the billing date for my gym membership They did not comply and charged me for October despite the fact that my husband and I didn't use the gym at all in October Please refund me the $for October as my husband and I didn't use the gym Regards, [redacted]
