Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I enrolled with my local gym back in February of this year, a couple weeks later I went in for a free personal fitness assessment after receiving several calls from trainers at the gymDuring that hour I was there, I worked with a trainer named [redacted] After that long hour, in which I strained several muscles due to the fact he just jumped right into exercising, no warming up or stretching of any kind, leaving me exhausted from also being up since 5:am that morning, and ending the training session around 7:pmYour LA Fitness team member took me back over to his desk, where [redacted] advised me I should add on the personal trainer plan to my gym account, as it would provide me with further help in learning how to properly use equipment, exercises etcI asked about how long I would have to do keep it, and about pricingYour LA Fitness team member advised me of the cheapest plan which consisted of two training sessions a month for $each month, and that I would be able to change, remove, or cancel it at any timeI knew this would work perfectly since I didn't intend to keep it long and informed [redacted] of my intentionI signed up, had part of the payment withdrawn from my account [redacted] proceed to hand me a pen, and pointed to me where to sign on the papersBefore I had the chance to ask he told me the documents were only to give LA Fitness permission to withdraw the additional payments from my account, and a liability waiver, that released LA Fitness from any fault if I were to be injuredI didn't have any chance to review, or even g [redacted] at the documents, as each time I signed/initialed one, he would quickly pull it away from meYour LA Fitness team member also slid over an electronic signature pad, which he stated was only for the electronic signature for the same thingAfterwards I didn't get documentation to take home [redacted] mentioned I would get a receipt and all documents that I signed by email I did receive an email, however it just told me what I would be paying, the first bill date, and when I would be billed for the nextI split the first payment and down payment into two, paying $the first time, I was told I would have to comeback in to make the second payment of $During the month of March I didn't use the personal trainingIn fact I was barely able to make it to the gym because of workIn the beginning of April I ran into financial trouble sooner then I thought regarding my car, and would need to invest in a new carI was then charged on 04/13/a total of $which I was unaware of, since I was out of town I decided to wait till I returned to call LA Fitness and solve this problemHowever I was charged another fee of $right after, which was unexpected since I was told in order to make the second payment part of my sign up for the personal training I would need to do it in personThis was unexpected since I was told this could not be done any other wayI called LA Fitness to ask to cancel it, and for a refund of at least the most recent amount deductedTo my complete surprise a phone call I thought would be easy, left me in tears as the representative at a local LA Fitness told me I was locked in for a twelve month contracted, and in order to cancel I would have to buy out the contract which would be a little over $and that LA Fitness could not help meNow I needed to called the corporate number to speak about this problemBy discovering all this information I was lied to by the LA Fitness trainer in order for him to make a sale and get his commissionI felt betrayedI also discovered that the LA Fitness trainer was no longer working with your companyThe LA Fitness representative I spoke with during my first call was extremely rude and unprofessionalI tried to explained my issue and she continued to repeat as if she were a robot, "you must pay $500"I tried to requested to speak with her supervisor which she blatantly deniedThe LA Fitness rep then had the audacity to make a snide remark, suggesting she schedule me for a personal training sessionThe rep refused to listen to what I was saying and would not let me speakI ended this call since I could see I was getting now whereI have worked in call centers before and having been a supervisor myself and knew this was not a way to conduct customer serviceI called back shortly to speak with another LA Fitness repI explained my situation all over again, she began to tell me that I had to buy out the contract and I made it clear to her that it was not an option of me, neither was paying $a month for what I then discovered were only two minute training sessionsThis new rep would not let me speak with her supervisor, but said she would talk to the department that handled personal training accounts to see if there was a way to resolve this problemI heard back from her a few days later, she told me she spoke with the personal training manager located at my local LA Fitness, and that he stated that he trained his employees correctly and that the trainer that scammed me into a contract got a lot of salesI told her that based on all my work experience as well as experience training people, that just because they are trained correctly, doesn't mean that they will follow all the rulesWith no resolve to this call I advised her I would be filing a complaint with the Revdex.comThe rep said she would contact a manager in another department and get back to me with a response by Monday of the next week since it was a FridayI filed my complaint with the Revdex.com, who said they would be forwarding the information to the companyTwo weeks went by and I heard nothing at all from LA FitnessI did receive confirmation from the Revdex.com that my complaint was sent and received by LA FitnessI called 05/at 4:55pm, and spoke with a man named ***He was shocked to hear that I did not receive a call of any kind, and said that I would need to speak with a department that handled issues escalated to Revdex.com, and that since the lines were busy he would have them call me back within the dayFast forward to 05/08, I still did not receive a call, I called at 4:47pm and spoke with ***She attempted to contact ***, but was unsuccessful, and said she would forward my information to him so he could call me back within the dayFour days then went by and I heard nothingThis has been very stressful with the run around I have been gettingSo I called again on 05/at 4:and spoke with ***He said he could not handle a Revdex.com complaint and would forward information to a manager to have them call me within hoursAs I write this email today is 05/15, time is 8:35pm, and I have not received a call from anyoneThe only thing I have gotten is an email briefly discussing the personal training contactThis issue which has been ongoing for one month, has caused be such stress that it has begun to take a toll on me not only emotionally physicallyThe LA Fitness trainer who signed me up used my exhaustion against me, he never told me that I was signing a contract that I was locked into, or stated any terms or conditions of the packageIf he did review the contract with me correctly I would of never signed up for thisHe also attempted to sign my coworker up as well, telling her the exact same thing as I was told, that it was an additional plan to go with the member ship, and it could be canceled or changed at anytimeThe tactics your LA Fitness employee used are appalling, and after researching this issue with LA Fitness online, I have viewed thousand of customer complaints that stated similar issues to what I am experiencingI've been told I signed the papers, which I never got the chance to read and was informed that was liability etcPer a lawyer I ask for legal advice from I was told that this was a case of 'material misrepresentation', the elements of which are: 1.Misrepresentation of material fact.2.Made knowingly by other party.3.With intent to defraud.4.Justifiably relied upon.5.Causing injury to the party in terms of monetary damagesThese categories, which I fall under, are intentional misrepresentation or deceit to the other party (customer) which means there is no valid contract between the parties because of fraudI know there is someone in this company that has the ability to void the contract, and refund me in full for all the payments totaling, $I have not used any of the personal training servicesI want to resolve this with LA Fitness, however if necessary I will go to a lawyer to discuss further optionsI cannot express the heavy toll this has taken on me emotionally and now physically to the point where I am sickFor a company as big and popular as LA Fitness to act like this when it is the customers who put the company where it is today is beyond meIf I was in anyway aware of the contract I would of not signed up, or I would of canceled during the cancellation periodHowever as stated this is contract fraudTo have trainers scam people to sign up for personal training sessions is unethical without properly explaining the terms and conditionsI truly hope this issue can be resolved in a timely matter Management contacted Ms [redacted] regarding her experience when attempting to process the cancellation of her monthly dues membershipMs [redacted] stated she Bastiattempted to cancel via telephone, which is not an accepted form of cancellation and as a result, no such cancellation was processed A cancellation request for Ms [redacted] account was received on 7/10/There is no history of a previous requestNevertheless, as a courtesy, we have agreed to refund $back to her Visa card on fileRefunds typically take 5-business days to completeWe believe this matter to be resolvedThank you

Management spoke to [redacted] prior to this complaint regarding his monthly billed fitness membershipHe claims to have only signed up for a month membershipHowever, per the agreement he signed on August 12, his membership is a month to month membership that will continue to bill until [redacted] requests properly to cancelWith that being said as a courtesy a refund in the amount of $has been refunded back to the [redacted] cardRefunds take about 5-business days to be processedWe believe this matter to be resolvedThank you

District Manager spoke with Ms [redacted] regarding her concernsMs [redacted] states that her membership was never cancelled and she left for China 11/Management has since cancelled her membership and refunded three months onlyAs a courtesy resolution, District Manager agreed to refund additional months of dues ($29.99) from 11/21/through 7/21/Refunds typically could take up to 5-business days to complete and will go back to the [redacted] Card we have on fileWe believe this matter to be resolvedThank you

Member purchased personal training services pursuant to a written and fully executed agreement (“Agreement”)The Agreement was for a minimum initial term of months, beginning 3/29/(the “Initial Term”)Member paid a total of $up front, which included the enrollment fee, processing fee and payment for the first month of personal training servicesHe further agreed to make more consecutive monthly payments, in the amount of $358.40, beginning 4/28/2016, for the remainder of the Initial TermThese terms are clearly outlined on page of the Agreement and he acknowledged his understanding of these billing terms by initialing three separate sections of the payment schedule section of the Agreement His Agreement includes a voluntary cancelation provision, which affords him the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the AgreementThis provision is clearly outlined on page of the agreementIn addition, his agreement included a New Client Checklist which outlined key terms, including his acknowledgement that he received and read a copy of his personal training agreement with the initial term of months and the voluntary cancellation provision This Checklist was reviewed with him at the time of the sale, as acknowledged by his signature and initials on the New Client Checklist (copies of the Agreement and New Client Checklist are included with this response)Thus, under the clear and explicit terms of the Agreement, member is not entitled to a refund or to terminate the Agreement and abandon his contractual obligations (which were very clearly spelled out for him and acknowledged by him) early without a fee If member no longer wishes to continue with his valid Agreement, LA Fitness will honor the voluntary cancellation provision of the Agreement should he elect to take advantage of itOtherwise, he should be expected to honor his Agreement as LA Fitness stands ready to provide the services for which he contracted We believe this sufficiently addresses the concerns brought forth, but please advise if we can be of further assistance

Management has made several attempts to contact [redacted] to discuss his concerns regarding the membership agreement he signed on August 17, at our [redacted] location However, we have not received a return callWe encourage [redacted] to return our call so we can adequately respond to his concerns Thank you

Corporate Management contacted [redacted] regarding her additional concern related to the amount of time between her request and when the session adjustment was completedWe have agreed to refund the remaining sessions, for a total amount of $Please note that we were not contractually obligated to provide this remedy, but this was done as a customer service consideration for our member We believe this resolves the matter, but please advise if we can be of further assistance

Member’s claim is not consistent with the clear and conspicuous language in the training agreement she signed and she was properly billed after the initial 6-month period in strict accordance with the plain language of the agreement she signedIn particular, the "Initial Term Acknowledgement" on page of the membership agreement clearly states that "unless cancelled", the agreement converts to a month to month agreement after the Initial Term until written notice of cancellation is providedAdditionally, member acknowledged the month to month conversion by initialing the specific section of the "New Client Checklist" which is also provided with a copy of the membership agreement and reviewed with member at the conclusion of the sale (copies of the agreement and New Client Checklist are included with this response)As such, it was member’s obligation to notify us that she did not want to continue with her membershipFurthermore, member shall be deemed in default of the this agreement upon failure to comply with any of the terms and conditions of the agreement including the obligation to make payment when dueUpon default, member will not be able to utilize the services provided in the agreement including any unused accrued sessionsThus, by disputing the payments with her bank, member has defaulted on the agreementNevertheless, our District Operations Manager, [redacted] **, has made several attempts to contact member regarding her concerns in an effort to resolve her dispute but his calls have not been returnedWe encourage member to return Peter’s call for further assistance

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.Hello [redacted] I've had a pretty awful experience with LA Fitness and have been lied to numerous times during the process I tried to cancel my membership in person prior to leaving [redacted] , in late October 2015, but was told that the manager was the only person who could cancel my membership, and the manager wasn't in that day I was told that I could cancel over the phone, or come back another day With all of the hassle of moving, it slipped my mind for a few months, so in February, I called and tried to cancel my membership, and was told that I couldn't I talked to the manager, and he still refused to cancel my membership I was told it could only be done in person or through the mail, making what was told to me earlier a direct lie I asked for an exception, because I had moved somewhere that was literally hundreds of miles from the closest location I was refused I then downloaded the cancellation form and sent it in After three months I was still getting charged, so I filed the Revdex.com report because it was clear that LA Fitness was running a scam preventing me from canceling the membership LA Fitness showed that they continue to try to cheat their customers, as they charged me for an additional month after making contact, having confirmed that they'd seen my complaint in writing After having been lied to so many times from LA Fitness employees, I requested that all communication occur in written form, which is a very rational demand, but the management of LA Fitness has refused, so they can't be caught in their lies or falsehoods I have not used a single piece of equipment from October to the present (and I still have an active, paid membership, as they continued to charge me after acknowledging this request), so I have caused them no undue hardship I want my money back for this period of time, as would be fair Thank you, [redacted] ***

Our District Vice President contacted member regarding her concernsThis is no provision in her personal training agreement that entitles her to downgrade at any time during the initial term of the agreementHowever, we will extend the expiration date of her sessions for an additional months after the end of her initial term so that she has enough time to complete any remaining sessions

Member is correctShe was paying $per month, not $We apologize if there was any confusion about the rateHowever, the cancellation provision is designed to protect member from pre-paying for services or to relieve member from her obligation to continue to pay for services she might otherwise not be able to use because of her disability It does not, however, entitle member to a refund of services that were available to her but she did not use prior to such a cancellation for disabilityNevertheless, LA Fitness will allow member to use any remaining unused sessions once her doctor clears her for workouts again in the future
