As member acknowledges, he initially purchased a personal training program for a minimum initial term of monthsMember was coming up on the last month of his initial term and approached our Personal Training Director (“PTD”) about continuing his program beyond the initial term stating that he loved the program, had seen great results thus far and was ready to really commit himself to his health and fitness but was hoping to get a lower rateMember was paying $for sessions per month on his initial agreementOur PTD informed member that we had a month option that was available to him at a rate of $for sessions per month and included additional sessions It should be noted that our PTD informed member that he still had one month remaining on the initial term of his agreement but that his agreement included a voluntary cancellation provision that allowed him to terminate the agreement early by paying only half of the remaining balance due on the agreement (the “Termination Fee”)Member authorized the Termination Fee payment of $(half of $for the remaining month on the initial agreement term) to cancel the agreement and re-enroll at the new rateUpon signing the new agreement, our PTD asked member if he wanted a copy printed or e-mailed to him Member chose the paperless option and requested to have a copy e-mailed to himA Few days later, member returned expressing some concerns about the copy of the agreement that he received and the terms of that agreementIn light of any possible misunderstanding, the new agreement was cancelled and a refund in the amount of $was processed for the initial payment that was madeHowever, the circumstance does not otherwise affect the terms of member’s previous personal training agreementMember may pay the remaining $that was owed to complete his training sessions for the last month that was left on his original agreement but member is not otherwise entitled to a refund of the Termination Fee that he voluntarily paid to cancel that agreement early

Management contacted Mr [redacted] regarding the cancellation of his monthly dues membershipMr [redacted] states he understood his membership to be an account in which he paid two months and then would be month to month after that time frameMr [redacted] established a monthly billed membership which requires first and last month’s dues at sign up, then a monthly billing of the membership dues until a request for cancellation is completedMr [redacted] claims to have attempted to cancel via telephone, which is not an accepted form of cancellationAs a result, no such cancellation was processed LA Fitness provides members with the option to cancel their membership at any location between the hours of 9AM-5PM Monday through Friday, but we strongly advise that member's mail in a written cancellation request via certified mail to ensure return-receiptThis cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properlyAs a courtesy, a cancellation was completed and we have also agreed to a refund back to his [redacted] card on file in the amount of $Refunds typically take 5-business days to completeWe believe this matter to be resolvedThank you

LA Fitness has made several attempts to contact [redacted] regarding his concerns, but he has not returned our callsOur records reflect that he purchased personal training services pursuant to a written and fully executed agreement, beginning 7/11/(the “Initial Term”)Even if he felt pressured to buy, [redacted] personal training services agreement specifically provided him with a 10-day right to cancel, for any reason, by submitting a written notice of cancellation, for a full refund However, he did not take advantage of this option within the rescission periodThus, he is not entitled to terminate the agreement and abandon his contractual obligations early without a feeNevertheless, rather than force our members to complete the entire term of their commitment if their circumstances change, we include a voluntary cancellation provision which affords our members the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the agreementLA Fitness will honor this provision of [redacted] personal training agreement should he elect to take advantage of itOtherwise, he should be expected to honor his agreement as LA Fitness stands ready to provide the services for which he contracted

In light of any possible misunderstanding at the point of sale, LA Fitness cancelled member's personal training agreement and her regular fitness membership with no further billing or obligationAs of the time of this response, member has received credit from her bank for all of the payments made

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] I am very in happy with this response I only used about sessions and was not happy with the results and I did try to break the contract within the first days after I let the trainer now how in happy it was he told me there was nothing I can do about it and that I was basically st out of luck is this how big company in America get rich especially when taking money from the needy this is not common sense I did not use 12000$ worth of garbage min training sessions I know I'm not the only one in this position High powered sales tactics and I'm not happy that's why when I found out the Revdex.com can help I came here and further more I was kicked out of my gym and embarrassed by the way the staff treated myself and my wife I admit she became a little irrated but I kept my cool and was still kicked out If there is a way to resolve this I would appreciate to outright turn this onto a customer is wrong to me this money was hard work but to was just another dumb customerYours truly ***
