Our District Manager contacted member to address his concerns and we cancelled the remaining term of his personal training agreement with no further billing or obligation

LA Fitness will process a refund in the amount of $for the remaining sessions (refund will be applied to the same account used for payment)Please allow 5-business days for the refund to post to the account

LA Fitness spoke to member’s mother [redacted] who was the one using and paying for the service, and she was reminded that the personal training agreement clearly states, in a section entitled the "Initial Term Acknowledgement" on page 1, that "unless cancelled", the agreement continues on the same 4-week billing cycle after the Initial Term until written notice of cancellation is providedAdditionally, this term is outlined again in the New Client Checklist which is provided with a copy of the membership agreement (copies of the agreement and New Client Checklist are included with this response)Thus member was properly billed after the Initial Term in accordance with the terms of the personal training agreement and was not entitled to a refundNevertheless, LA Fitness processed refunds for four billing cycles, totaling $720.00, on 6/3/and 6/4/Please note that we were not contractually obligated to provide this remedy, but this was done as a customer service consideration for our memberKati agreed that this would resolve the dispute and that she would use the remaining personal training sessions

LA Fitness followed up with member regarding his concerns and sessions have been added back and are available for him to utilize

Management spoke to [redacted] regarding the cancellation of [redacted] fitness membershipHe claims to have cancelled in May of however our records indicate we did not receive such request LA Fitness provides members with the option to cancel their membership at any location between the hours of 8-Monday thru Friday, but we strongly advise that member’s mail in a written cancellation request via certified mail to ensure return receipt This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly [redacted] member was cancelled on 12/22/and no further billing has occurredAs a courtesy, the balance has been waived and a refund in the amount of $ has been refunded back to the [redacted] on file Refunds take about 5-business days to be refundedWe believe this matter to be resolvedThank you

Member purchased personal training services pursuant to a written and fully executed agreement (“Agreement”)The Agreement was for a minimum initial term of months, beginning 9/21/(the “Initial Term”) Member paid a total of $up front, which included the enrollment fee, processing fee and payment for the first month of personal training sessions Member further agreed to make more payments, in the amount of $each, every month, beginning 10/21/15, automatically through EFT (Electronic Funds Transfer) for the remainder of the Initial TermThese terms are clearly and conspicuously set forth on page of his agreement and he acknowledged his understanding of these billing terms by initialing the three separate sections of the payment schedule section of the Agreement (a copy of the Agreement, is included with this response)Member’s personal training services agreement specifically provided him with a day right to cancel if these terms did not match his understanding (or for any reason) for a full refundHowever, he did not exercise this option within the rescission periodThus, under the clear and explicit terms of the Agreement, he is not entitled to terminate the Agreement and abandon his contractual obligations early without a feeMember’s Agreement also includes a voluntary cancelation provision, which affords him the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the AgreementLA Fitness will honor this cancellation provision in his Agreement should he elect to take advantage of itOtherwise, member should be expected to honor his Agreement as LA Fitness stands ready to provide the services for which he contracted

Management contacted [redacted] regarding her concerns that the HVAC at our [redacted] location was not working properlyWe appreciate our member’s feedback and concerns regarding our facilities and strive to provide a clean and healthy environment In some cases, remedial measures can take time to complete and we appreciate our member’s patienceAs a courtesy, we have processed a refund of $back to the [redacted] on file [redacted] has indicated the she appreciates the follow up and we assured her the issue with the HVAC has been addressed We believe this matter to be resolved at this timeThank you

Our District Manager contacted member to address her concernsShe has since resumed with the service with a different trainer and one of our other club locations and we added personal training sessions at no additional cost to compensate for her previous experience

LA Fitness contacted member regarding her concernsMember understands that her remaining sessions have expired in accordance with the terms of her personal training agreementHowever, we have added complimentary training sessions for her to use between now and 6/1/

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below The agreement which I signed was on a digital pad so I can't see on what terms I am signing onI had to take whatever the club manager said as truthHe promised me that I can cancel anytime without any cancellation fees if there is no LA Fitness nearby and also promised an hour long personal training sessions.But the training sessions are only for minutesThis is a business malpractice employed by the local club to fool people to sign the contract without actually reading itI don't acknowledge the agreement in it's current formIf this practice continues many more people will become victimsThe club manager lied on my face point blank that he did not mentioned about the miles radius clause.This is a sales misrepresentation and fraud on part of the club manager The club manager laughed at me for my naivenessI felt insulted by his behaviorI have more guys who signed up along with me who can testify my claimThere is no way any self respecting person can continue with them after this incident I kindly request you to please cancel my remaining term without any cancellation fees as promised by the club manager and provide a refund for the personal training session for the month of OctoberAnd I urge you to take an action against such sales persons who make sales on informations I hope I get the same level of great costumer service which other members on Revdex.com got for the same kind of problem which I am facing Regards, [redacted]

Management spoke to [redacted] regarding her experience with joining a Paid in full yearly membership, due to some confusion and misinformation it has been agreed upon to process an immediate cancellation and issue a refund in the amount of $back to the [redacted] card, $issued via check and $back to the [redacted] cardRefunds take approximately 7-business days to be completed We apologize for the experience [redacted] had and she is satisfied with the resolutionWe believe this matter to be resolvedThank you

Management has made several attempts to contact Ms [redacted] regarding her concerns related to the cancellation procedures for her monthly dues membershipMs [redacted] states that she has attempted to cancel via phone and at that time was provided acceptable cancellation optionsLA Fitness provides members with the option to cancel at any LA Fitness location with an Operations Manager between the hours of AM-PM on Monday through Friday, but we strongly encourage members to send a written cancellation request via certified mail to ensure return-receiptOur cancellation policy is not designed to make it difficult for our members to cancel, but to ensure cancellations are handled properlyOur records indicate we have received no such cancellation request from Ms [redacted] As a result, no cancellation was processed and the monthly billing continued based on the membership termsAs a courtesy, we have cancelled her membership to prevent future monthly billings and issued a refund of $back to [redacted] on fileWe believe this matter to be resolvedThank you
