We received a request to cancel Anthony's fitness membership on 1/7/They were billed $for [redacted] 's fitness membership on 2/5/We have since cancelled [redacted] 's membership and the $was refunded on 2/10/(the refund applied to the same account used for payment)

LA Fitness cancelled the remaining term of member's personal training agreement with no further billing or obligationPlease note that as of the time of this response, member had been charged $on 6/16/for the second month of serviceWe processed a refund for that payment on 6/20/ (refund applied to the same account used for payment)

Our records indicate a cancellation was received via mail PM 12/22/We received no prior requests to cancelLA Fitness provides the option to cancel at any location between the hours of 8-Monday thru Friday and we strongly advise mailing in a cancellation request viacertified mail to ensure return receipt as stated in the agreementOur cancellation policy is not to make it difficult for our members to cancel but to ensure cancellations are handled properly.No further billings will occurAs a courtesy a one month refund in the amount of will be processed back to the [redacted] card Should [redacted] provide proof of a prior cancellation further refunds can be discussed Thank you

Management spoke to [redacted] regarding his concerns with the club access included in this monthly billed membership and his frustration with the lack of responsiveness by a staff member at his local clubLA Fitness strives to provide excellent customer service to our members and we apologize for the experience he had As a courtesy, we have adjusted his membership to Premier Single State access, which will include access to all locations in WA with the exception of Signature clubsWe believe this matter to be resolvedThank you

Our District Vice President, [redacted] has attempted to contact member to address her concerns but his calls have not been returned Our records reflect that member contacted our Member Service Department on 12/15/requesting to cancel her personal training agreement because she stated that she was unhappy with the serviceOur Member Service Manager offered to set member up with a different personal trainer if she was unhappy with the service he was providing However, member stated she didn’t actually have an issue with the personal trainer, she simply couldn’t afford to pay for the service any longerThis does not entitle member to a refund or to terminate the agreement early without a feeMember was reminded that she committed to a minimum initial term of months but that her personal training agreement also includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the agreementMember elected not to take advantage of this provision at that time Nevertheless, LA Fitness remains willing to honor the voluntary cancelation provision should she elect to terminate her agreement earlyOtherwise, member should be expected to honor her agreement as LA Fitness stands ready to address her service concerns and continue to provide the services for which she contracted

Our District Vice President contacted member regarding her concernsMember has elected to continue training for the time being but LA Fitness will honor a cancellation with no fee should member’s financial circumstances change in the future

Management contacted Mr [redacted] regarding his concerns with the billing and cancellation of his monthly dues membershipLA Fitness provides members with the option to cancel at any LA Fitness location with an Operations Manager between the hours of AM-PM on Monday through Friday, but we strongly encourage members to send a written cancellation request via certified mail to ensure return-receiptOur cancellation policy is not designed to make it difficult for our members to cancel, but to ensure cancellations are handled properlyOnce a cancellation is completed, there is no new monthly billing processedHowever, any balances or charges prior to cancellation are owedThe prepaid last month’s dues are applied to a membership after cancellation, as time to access our facilitiesThe cancellation for Mr [redacted] ’s membership was processed on 6/5/2017, with his final billing on 6/2/Nevertheless, as a courtesy, we have issued a refund of $back to the [redacted] card on fileMember was satisfied with the resolution and we consider this matter to be resolvedThank you

Our District VP contacted [redacted] regarding the incident that occurred with the General Manager at our [redacted] locationWe apologized for how the situation was handled and reassured [redacted] that we do not condone how the situation was handledWe have addressed the issue internally and an apology was issued to [redacted] ***We advised that no refund is owed or due [redacted] understands and is satisfiedThank you

Management spoke to [redacted] on 12/9/regarding the monthly billings for his membershipIt was agreed upon to issue a refund in the amount of for months of monthly duesRefunds were processedback to the *** card and take about 5-business daysMember is satisfied

Member purchased personal training services pursuant to a written and fully executed agreement (“Agreement”)The Agreement was for a minimum initial term of months, beginning 6/14/(the “Initial Term”)Member paid a total of $up front, which included the enrollment fee, processing fee and payment for the first month of personal training servicesShe further agreed to make more payments, in the amount of $each, every month, for the remainder of the Initial Term These terms are clearly outlined on page of the Agreement and she acknowledged her understanding of these billing terms by initialing three separate sections of the payment schedule section of the AgreementHer Agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only 50% of the remaining balance due under the Agreement (the “Termination Fee”) This provision is clearly outlined on page of the agreementIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement with the initial term of months and the voluntary cancellation provisionThis Checklist was reviewed with her at the time of the sale, as acknowledged by her signature and initials on the New Client Checklist (copies of the Agreement and New Client Checklist are included with this response)Furthermore, member’s personal training services agreement specifically provided her with a 3-day right to cancel if these terms did not match her understanding (or for any reason) for a full refundHowever, she did not take advantage of this option within the rescission period Thus, under the clear and explicit terms of the Agreement, she was not entitled to terminate the Agreement and abandon her contractual obligations (which were very clearly spelled out for her and acknowledged by her) early without a Termination FeeMember expressed some concerns with the service she has received thus farOur District Vice President (“DVP”) contacted member to address those concerns and rectify any issues she experienced with the service However, member chose not to continue with the serviceOur DVP then offered to reduce the cancellation fee from 50% down to 25% of the remaining agreement balancePlease note that were not contractually obligated to provide this remedy, but this was offered as a customer service consideration for our member Member elected not to take advantage of the offer at this timeNevertheless, LA Fitness remains willing to honor the reduced cancellation fee should member elect to take advantage of itOtherwise, she should be expected to honor her agreement as LA Fitness stands ready to address her concerns and provide the services for which she contracted

Our previous response still standsManagement spoke to the member on 7/1/regarding his request to have his home club changedWe advised Mr [redacted] that this request has already been granted two times before and should he wish he can upgrade to allow additional access the upgrade fee would need to be paidmember declined and advised he would rejoin thru his workMember has been cancelled per his request and no further billing will occurThis matter has been resolvedThank you

Our District Manager contacted member regarding her concernsMember’s personal training agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only 50% of the remaining balance due under the agreement However, we offered to reduce the cancellation fee from 50% down to 33% of the remaining agreement balanceMember informed our District Manager that she would take advantage of the reduced cancellation fee near the end of the month
