LA Fitness cancelled the remaining term of member's personal training agreement with no further billing or obligation and processed a full refund (less the initial payment)The refund was applied to the same account used for payment

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.The intention of my rebuttal is to complain about LAFitness on [redacted] *** denying my personal training for the third timeI filed a complaint on 01/03/Reopened the case on 01/20/Now I am reopening the complaint today 03/03/15.My membership with LAFitness initiated in [redacted] on [redacted] **in January I joined the gym with my children, [redacted] ***It was explained to us at that time our the personal training would be honored at any LAFitness locationI paid for months of personal training at $per month plus the initial $for the first month.LAFitness responded to the Revdex.com in February that my personal training would be honored and I would be able to bridge the sessions to my location in DallasThis however is not the case.Today I inquired about scheduling personal training with [redacted] He told me there was nothing in my files to reflect such an agreementAfter giving him my information he still refused my explanation of the terms which I had been given re the Revdex.com response from LAFitnessI further explained that I had changed my membership bar code due (reducing the monthly rate through my employment benefits) in January 2015, but continued to belong to the gymThis information did not deter [redacted] recognition of the agreed upon terms to the response to the Revdex.com in February 2015.At this point, I am more than a dissatisfied customerI have no faith in LAFitnesses "word" and consider this to be a breach in contract and a gross thief to meI work hard for my income and have every intention to stay healthy and in good faith trusted the word of LAFitnessMy trust has been dissolved and I find this situation to be no longer reconcilableI ask for a full refund of the moneys I have invested into my unused personal training from LAFitness.I am thankful for the Revdex.com and it's dutiful staffI am optimistic that I will receive my refund and wish no harm to anyone.I am a USAF veteran and currently an RNI have faith in our judicial system and the rights of citizens against injustices from these situations I am complaining about.Thank you, [redacted]

Management spoke to [redacted] regarding [redacted] monthly billed membershipHe claims to have cancelled both memberships in December of However the cancelation was only processed for his membership and he has continued to be billed for [redacted] membershipAs a courtesy we have processed an immediate cancellation and issued a refund in the amount of $back to the [redacted] cardRefunds take about 7-business days to be refunded [redacted] is satisfiedThank you

We appreciate our member’s feedback and concerns regarding our facilities and strive to provide a safe and functional environmentManagement contacted our facilities team to investigate the issues raised in Mr [redacted] complaintIn addition, we have informed him of the steps we are taking to address her concerns and remedial measures have commenced, but they will take time to completeWe appreciate our members' patienceShould Mr [redacted] have any further concerns Management provivded their contact number for further assistanceWe believe this matter to be resolved and Mr [redacted] is satisfied with the follow upThank you

Member’s Agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the AgreementFurthermore, upon cancellation, all sessions purchased must be completed within days of the last paymentThese provisions are clearly outlined on page of the agreementIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement with the voluntary cancellation provision and session completion provisions This Checklist was reviewed with her at the time of the sale, as acknowledged by her signature and initials on the New Client Checklist (copies of the Agreement and New Client Checklist are included with this response)Thus, under the clear and explicit terms of the Agreement, member is not entitled to terminate the Agreement and abandon her contractual obligations (which were very clearly spelled out for her and acknowledged by her) early without a fee or an unlimited amount of time to use the remaining sessions If member no longer wishes to continue with her valid Agreement, LA Fitness will honor the voluntary cancellation provision of the Agreement should she elect to take advantage of itIn addition, we would be willing to honor a reasonable extension for member to use any remaining sessionsOtherwise, she should be expected to honor her Agreement as LA Fitness stands ready to provide the services for which she contracted

Our position has not changedMember's concerns were addressed in our initial responseLA Fitness will extend the expiration date of the remaining sessions or, we will honor a refund in the amount of $in lieu of reinstating the remaining sessions

Management has made several attempts via email and by telephone to contact [redacted] regarding his concerns related to the billing on his parent’s monthly dues membershipHowever, we have not received a return callWe encourage [redacted] to return our calls so we can adequately assist him in resolving his concernsThank you

Member declined our offer to push her billing date out by weeksWe do not take responsibility for member's not receiving their insurance reimbursement and the insurance companies agree that members need to take responsibility to ensure their check in's are registering through out the month granted the member is checking themselves into the club upon usage properlyNo further action will be takenThank you

As of the time of this response, member has disputed the payments with her bank and defaulted on the agreement termSince it is apparent that she now has no intention to fulfill her contractual obligation to the remaining personal training agreement term, we have released her from her obligation to make the remaining payments due under her agreementAdditionally, LA Fitness will not pursue her for the outstanding balance she currently owes on her personal training agreementPlease note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our member

Management contact [redacted] regarding her concerns with the experience she had at a local club when attempting to activate a guest passWe strive to provide the best customer service to our members and guests and regret that [redacted] felt that a local staff member acted in an unprofessional manner Management attempted to locate a charge in our system with the information [redacted] provided but have been unable to locate an active membership or charge [redacted] expressed that she simply wanted to voice her concerns related to her experienceWe provided direct contact information should [redacted] need any additional assistanceThank you

Management spoke to [redacted] regarding his complaints As a courtesy, we cancelled memberships and refunded $back to the [redacted] on file Refunds typically, take up to 5-business days to completeWe believe this matter to be resolvedThank you

Management spoke to [redacted] r on 5/6/and explained to her that in order to use our Signature locations their is an interclub feeShe has been advised that her type of membership does not have access to our Signature locations unless this fee is paidMember understandsNo further action will be taken

Management emailed [redacted] regarding concerns with phone calls he received for [redacted] monthly membership, that is an add on to his primary accountWe assured him that his contact information has been removed from her accountPer his request, a cancellation for her membership has been processed and an email confirmation has been sentWe believe this matter to be resolvedThank you

Per [redacted] request we processed a cancellation on 12/30/and no further billing has occurredThe balance in the amount of $for January dues has been waived and no further balance is owedShould [redacted] *** wish to discuss his concerns further we encourage him to contact his home clubThank you

Member was paying a rate of $for sessions every weeksAny unused sessions from billing period to billing period did roll over and were available for member to use during the Initial Term of his agreementHowever, member’s personal training agreement clearly indicates under the “Session Completion Date” section on page of his agreement that all sessions purchased must be completed within days after the end of the Initial Term or, if Client renews or continues the EFT/CC payments agreement beyond the initial term, within days after the completion of that additional period In addition, his agreement included a New Client Checklist which outlined key terms, including his acknowledgement of this session complete dateThis Checklist was reviewed with him at the time of the sale, as acknowledged by his signature on the New Client Checklist (copies of the agreement and New Client Checklist are included with this response)Member also claims that his regular fitness membership should have been cancelled when he cancelled his personal training membershipPlease note that member was provided a cancellation confirmation receipt via e-mail when he cancelled his personal training membershipHowever, LA Fitness has no record of a request to cancel his regular fitness membership at that timeIf member had cancelled his fitness membership, he would have been provided a cancellation confirmation receipt for that membership as well Thus, he is not entitled to a refund of unused sessions or fitness membership dues processed prior to the cancellation request made on 3/28/With respect to the personal trainer, Andrew S., that he worked with, we received no indication from member (or any other members) at the time that he worked with Andrew that there was a problem with the service that he providedHad member brought his concerns forward, we would have addressed his concerns accordingly and placed him another trainer on staffAlthough we are not contractually obligated to do so, LA Fitness is willing to extend the expiration date of the remaining sessions, should member elect to use them
