Management contacted [redacted] regarding the cancellation of his monthly billed fitness membershipHe states he was misinformed regarding our cancellation policyLA Fitness provides members with the option to cancel their membership at any location between the hours of 8-Monday thru Friday, but we strongly advise that member’s mail in a written cancellation request via certified mail to ensure return receipt This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly No prior cancellation request was received therefore he is not owed a refundHowever, Per his request an immediate cancellation has been processed and no further billing will occurAs a courtesy, a refund in the amount of $has been refunded back to the [redacted] cardRefunds take about 5-business days to be refundedMember is satisfiedThank you

Member’s personal training agreement includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the agreement (“Termination Fee”)This provision is clearly outlined on page of the agreementIt is LA Fitness’ policy and practice to provide our members with a complete copy of their agreement at the time of enrollmentIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement with the initial term of months and the voluntary cancellation provision This Checklist was reviewed with her at the time of the sale, as acknowledged by her signature and initials on the New Client Checklist (copies of the agreement and New Client Checklist are included with this response)Furthermore, member’s personal training services agreement specifically provided her with a 3-day right to cancel if these terms did not match her understanding (or for any reason) for a full refundHowever, she did not take advantage of this option within the rescission periodThus, under the clear and explicit terms of the agreement, she is not entitled to a to terminate the agreement and abandon her contractual obligations (which were very clearly spelled out for her and acknowledged by her) early without a Termination Fee Nevertheless, our District Vice President has made several attempts to contact member regarding her concerns but she has not answeredIf member no longer wishes to continue with her valid agreement, LA Fitness will honor the voluntary cancellation provision should she elect to take advantage of itOtherwise, she should be expected to honor her agreement as LA Fitness stands ready to provide the services for which she contracted

After researching [redacted] claims, in addition to the fully executed agreement (including a New Client Checklist that acknowledges he received a copy and reviewed all of the terms) it is LA Fitness’ policy and practice to provide our members with a complete copy of their agreement at the time of enrollment A copy of the Agreement was also included in the Purchase Confirmation e-mail he received at the time of purchaseAccount history also reflects that [redacted] was contacted to complete a follow up call to review the terms of his Agreement, but he declined and advised the representative he would rather not do the welcome callAdditionally, he contacted our Customer Service department previously to see if there was an option to suspend billing and then requested cancellation At that time he was reminded of the Voluntary Cancelation provision which allows a member to cancel at any time, for any reason, by paying only half of the remaining balance due under the Agreement [redacted] elected not to take advantage of this provision, so the billing continued pursuant to the terms of the contract If he no longer wishes to continue with his valid Agreement, LA Fitness will honor the voluntary cancellation provision of the Agreement should he elect to take advantage of itOtherwise, he should be expected to honor his Agreement as LA Fitness stands ready to provide the services for which he contractedWe will work with him to make sure we can reasonably accommodate his schedule and provide him with the service he contracted for if he will allow it

We have investigated the circumstances of the sale but found no evidence to support member’s claimIn fact, in reviewing the text message exchanges between member and the Personal Training Director who sold the program, it was clearly evident that member loved training and had no issues with the programHowever, it was member’s father who wanted the program cancelled because he didn’t want to continue paying for itIt should be noted that member’s personal training agreement includes a provision that allows her to terminate the agreement early, without a fee, if she can no longer use the service because of a significant physical disability verified by an appropriately certified physicianLA Fitness received evidence of such a disability, postmarked 9/15/Accordingly, we cancelled the remaining term of member’s personal training agreement with no further billing or obligation
