If they did ni messages were left on my voicemail so I would have no way of knowing they were trying to reach me.” [sic] Ms*** emailed Lexington Law Firm on 11/22/with her concerns and refund request, and her threat to go to the Revdex.com was also included in this emailWithin three hours, a Lexington Law Firm paralegal attempted to call Ms*** at the phone number she provided for her case, and the paralegal left a voice mail for Ms*** to return the callMs*** emailed Lexington Law Firm soon afterwards and said that someone called her regarding her refund request; she explained that she tried to call back but was placed on hold; she was unable to hold because she was at workMs*** then requested someone call her back later that eveningAt approximately 7:49pm, a Lexington Law Firm paralegal called Ms*** back, and they discussed the refund request, which was denied for reasons previously stated. In this Response, Ms*** goes on to state, “Second, it is true I called lexington law to inquire about the fluctuating of my credit score but had to sign up with their program to get answers. I was not at that time attempting yo remove anything from my credit because I filec bankruptcy in and all my new bills were recent.” [sic] On the day Ms*** opened her case, she reviewed her TransUnion summary report with a Lexington Law Firm Credit ConsultantDuring this review, Ms*** was surprised by a negative item that was unknown to herMs***’s response to the new information was “I want to dispute that.” She then continued to sign up for Lexington Law Firm’s credit repair services and stated that she had been doing it herself, but she wanted to try the services for at least a monthOnce her case was opened, Ms*** logged into the client website and manually selected what items to challenge and how she wanted them challengedAt no time did Lexington Law Firm force Ms*** to sign up for services or inform her that she had to challenge certain negative items on her credit reports. This is Lexington Law Firm’s formal response to Mr***’s Revdex.com complaintMr*** signed up for services with Lexington Law Firm on 11/22/15. He was informed that he had six days to cancel his services without being charged. On 11/30/15, Lexington Law Firm began
challenging questionable negative information on his credit reports. Mr*** was informed of the first work fee of $99.95. On 11/30/15, Mr*** called in to attempt to postpone his first work fee to 12/17/15; however, on that same day the first work fee drafted. Lexington Law Firm's policy is to provide up to days for the initial fee (i.e., December 07, 2015)Consequently, the first work fee was due prior to 12/07/and could not be extended out to 12/17/15. Regardless, Lexington Law Firm agreed to refund the $and redraft at a later date. Due to a clerical errors, the refund was not properly processed until 12/09/15. The $first work fee was refunded for client satisfaction, and the services were still performed. Mr*** has had at least negative items removed within that short time frame. Lexington Law Firm apologizes for the clerical errors regarding the delay of the refund; however, the first work fee could not have been extended past the first days. Mr*** became a client on July 25, after he signed the engagement agreementLexington began providing services and sent challenges to the credit bureaus and letters to creditors on his behalfLexington also provided Mr*** with identity theft insurance, online credit coaching and budget tools, and a monthly FICO scoreLexington drafted payments after providing the work as agreed uponOn one occasion Mr*** called to go over the billing date and amount owed, and on another occasion Mr*** made a payment to Lexington over the phone. This 'rebuttal' contains no new content. Neither does it address or counter the facts we provided. Once again, you were charged a total of for your case set up and four months of service that resulted in us achieving deletions from your reports. These are documented facts. Also documented is the fact that your bank declined our lawful and agreed upon charges for this services at least times. You may wish to verify this yourself as your allegation that we continued to charge you after you cancelled is presented in a disingenuous way here. We hope this is merely confusion on your part rather than a knowing omission. We were attempting to collect past fees which you did not pay on time. You were aware of this. If you could not afford the service, you must simply let us know. However you continued to allow us to work under our agreement on your behalf, yet did not pay as agreed. Additionally you attested you read and understood our contract, which is in plain language, and you signed it after agreeing you had fully read and understood. Additionally if you were ever confused, you could simply seek clarification from us on any part of our arrangement. Since there is no truth at all to your allegations we decline to refund you the fees we earned and invite you to accept the responsibility of your agreement with us. We could not have achieved the results we did, or even offer to help in any way without your agreement to pay for the service. You received a clear benefit, could have cancelled at any time, and your agreement to pay our fees for this service is a matter of record and is fully documented. If we ever err or a client somehow does not receive value for the service we render, we are committed to making it right, however in this case, there is simply no merit whatsoever to your allegations against us, as we've already shown. we made in your case, paid your bill each month as presented and agreed to, and actively involved yourself in communicating with us on other issues, including payment adjustments that seem to indicate your continuing understanding of our billing. Please understand that when our agent told you your husband did not cancel as you stated to us, we have proof. All calls coming in are noticed, even if brief, by our system. Every call we make or received is logged. We honored your cancellation the moment you made us aware. Additionally you were billed at the correct rate for months and we would be unaware of your confusion regarding our offer of a discount on the set up fee, unless you inform us. You did not inform us until months later, after accepting our billing each month at for each case. Your husband did not contact us on your behalf at any time during your service, and did not cancel your case. Additionally the credit bureaus themselves reported to us that they had deleted at least items on your individual case alone. This is far from your statement that we 'have not followed through'. Additionally as of January those results were still the there according to updates we receive as long as you are a customerHowever understand that if you are incorrect in your allegation of inaccuracy, a creditor MAY republish the item. This is why we get your written agreement that we do not dispute accurate items. Our work over the last couple of months is still causing an investigation and you may see even more results. However after having the opportunity to address your incorrect beliefs, we are returning all the fees we collected from you. Ultimately we want happy customer's and if you truly do not see the value we provided, and our need for an actual cancellation, so we don't just keep on working for you without payment, then please enjoy both our hard work and the great results we achieved, on us. Again items hurting your creditworthiness were deleted as a result of our work. You paid us a total of for this, over a six month period, and all of this will be refunded due to your lack of satisfaction with the service. Her spouse was the one who agreed to be billed after five daysHe does not live in the same state, so his contract has slight differences. He would have specifically agreed to be billed. Apparently this is causing confusion for her, and we understand. However we note that when she called us this was all explained again. She signed up online and could not have done so without explicitly agreeing to be billed after the five day grace period. All terms were disclosed and we can send a copy of this agreement to her if she does not retain her copy. Regarding her spouses case, we advise that he is being billed under the same card. We must hear from him directly in order to close the case, and cease our work on his behalf, or Ms*** can call us to remove the payment card if he does not wish to cancel, whereupon his case will close until we hear from him. The law does not allow any third party to direct a case without specific permission from a client themselves, regardless of who might be paying. We point this out to avoid future confusion. Again this customer was never billed for her case, she allowed another to use her card, and he agreed to be billed after the five days. We hope this explains the confusion.
