Thank you for bringing this matter to our
attention.
Ms. [redacted] received a membership card in the
mail, not a credit card.  As the complaint suggests, mailing of
unsolicited credit and debit cards is an illegal practice.  National
Funding has never sent such an offer.  While there are design similarities,
the differences between what we mail and a credit card are significant: 
The National Funding marketing piece contains no association logo (Visa,
Mastercard, etc.), and there is neither a magnetic strip nor a signature strip
on the back of this card.  Furthermore, the card specifically states that
it is a ‘membership card, not a credit card.’  The package is designed to
gain interest in our financing services, and is a commonly used format in the
financial services industry.
[redacted]’s business was prequalified for our
membership card based on the business information provided to us by Dun and
Bradstreet.   To activate the account, additional information would
have been required from [redacted].  We also check additional
business sources, such as the Secretary of State.
We apologize for any concerns that our
marketing piece may have caused Ms. [redacted] and we appreciate the opportunity
to address them. We will ensure [redacted] is removed from our system.

The company is engaged in an annoying and misleading blitz mailing campaign. Month after month you receive complaints from consumers about something that looks like a credit card (Company response "it's a "Membership" card") For an approved loan (Company response, "not approved, but pre-approved" whatever the hell that is supposed to mean) in some ridiculous loan, which bears no relation to the capital requirements of my business. And contrary to their assertions, this is NOT a normal marketing practice for a financial services company. Their peers advertise in the small business journals, and build their business through honest, competitive service and word of mouth. This crowd of shysters did a blitz e-mail campaign using the entirety of the Florida Department of State database of small business. They know nothing about me. They don't know what my business actually does, and they sure as hell do not know whether I need a business loan, and if so, in what amount.
An appropriate response would therefore be "We will stop this annoying and deceptive practice forthwith, and conform to the business standards of our peer companies". Their suggestion that they will simply remove me from the mailing list after I complained is just a further insult.
As for their assertion that it may take 60 to 90 days to stop the mailings, I assume that is a joke? I mean, you know what a database is, don't you? You go in, find the entry, hit the delete button, and if you print a mailing list three seconds after hitting the delete command, that entry will not appear. Unless of course they are suggesting that, notwithstanding the June 25 reply date to their initial begging letter, that they have mounds of follow ups ready to go out? Seems a funny way to run a business. In any event, in this regard, I have a counter-offer. If I receive anything further from them by mail (other than a complete and abject apology) I will take this complaint to the California Department of Business Oversight, and to the Florida State Attorney General (because I have a pretty shrewd idea that they are not licensed to offer financial services in Florida, and even if they have an associated company there who originate the loan, then from a legal standpoint they should have sent the mailing)
To you in the Revdex.com, if you receive the same complaints month after month, and the same anodyne response from the company, why do you not punish it with lower ratings?

Good Morning,
Mr. [redacted] called in off a marketing piece in June and applied for a loan. We were unable to approve him for that loan due to low annual gross sales which we explained to Mr. [redacted] at that time. Our marketing pieces are generated weeks before they are actually sent out so it appears...

that prior to the decline another piece went out to Mr. [redacted]. Unfortunately, we are still unable to complete a loan for Mr. [redacted]. We apologize for any confusion the second marketing piece may have caused.

They establish accounts WITHOUT CONSENT OR PRIOR KNOWLEDGE of account owner. Top front of Mailer: YOUR NEW ACCONT HAS BEEN ESTABLISHED. I received a letter stating this. THIS BY ITSELF MAKES THEM UNTRUSTWORTHY.

card number. We apologize for any inconvenience our mail piece may have caused,
and we have removed [redacted] from our mailing lists. Total
removal may take 60-90 days. After this time, Mr. [redacted] will no longer
receive mail. We have also mailed this response to Mr. [redacted]’s address.

I do not think I want to put it on a temporary hold.. I had already said my rebuttal within the initial complaint and the replies that followed.. If that wasn't clear enough, here's more.
My complaint isn't about not being funded, it's about the lie that I was funded and to go find vehicles. The complaint itself is about the time and money wasted on not only myself or my company but also that of the vehicles owners and of the vendors in paperwork, including giving out routing and account numbers. The vehicle that was setting at the dealership was costing them money sitting on their lot being held for me because National Funding told them that the funds would be sent soon only to ask for additional paperwork every time we turned around. If the funds weren't going to be made available, why tell me and waste my time finding vehicles? That's the point of this whole complaint. That they (National funding) wasted my time, money, etc to the point that if I add up all the labor hours wasted it comes to $4,800 just for my company's man hours alone. We charge $75 an hour for our time. Going up to look at the two vehicles in question was 32 man hours taken away from our company. This translates to the $4,800 wasted hours. Not counting the hours in paperwork involved, paying notary fees, etc. for my company. Not counting the wasted hours on the vendors side and their fees involved in holding the vehicles... 
I have every document recorded and every phone call recorded. When they said you're approved up to the X amount and to go find the vehicles up to that amount, I took them at their word that I was going to get funding up to that amount. Not go pick out vehicles, and the funds would have to be approved again based on the picked out vehicles. None of that was said, none of that was written down. This is what the foundation of the complaint is. The fact that I was lied to and the rabbit hole of wasted time, energy, money, etc. that followed..

Man hours wasted going to look at vehicles was 20 for the first vehicle and 34 hours for the second vehicle looked at. Which would come to $4,050 of lost revenue for both the President and Vice President to waste our time.

1. Please notice the language outlined on the cover page that talks about additional fees and site inspection fee is listed.

3. Please Notice the last 2 sentences of page 3 section 1 where it clearly explains interim.
4. Please notice section 5 where it talks about our ability to do a site inspection
5. Please notice Equipment exhibit A lists the original vendor Power Protection Services
 
Customer paid for the equipment after this set went out because the private party, that he chose to work with, was requiring that we cut a check to him personally. His personal name was not listed on the title so we could not cut a check to him personally. The only entity we could cut a check to was the legal owner on the title which was the business.

1. Please notice the language outlined on the cover page (AGAIN) that talks about additional fees and site inspection fee is listed.
2. Please notice the payment on the front of the EFA $521.59

This is the set that was countersigned by us and fully executed by both parties.
 
Cover letter that was sent out with customers set of fully executed docs.
Please notice the section on this letter that also references interim and any charges associated with the finalizing of this deal.
 
This customer was put on notice of all the amounts due twice with the first set of docs, twice with the second set of docs, and again once the deal funded and the final copies were sent out to him. We then followed up with an invoice that broke down the fees that were due and the dates they were due.
