With our auto-delivery program, customers receive a... 35% discount off the regular one-time rate of a 4-week plan. They also receive free shipping (Continental US). Ms. Lescarbea received her shipment of non-frozen food on February 17, 2016, followed by shipment of frozen food on February 19, 2016. [redacted] subsequently cancelled her program on March 2, 2016.In accordance with our Money Back Guarantee and cancellation policy, if a customer is not 100% satisfied, they can call ###-###-#### within 14 days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping. Upon cancellation, [redacted] was issued a return shipping label so that she could return her non-frozen food. To date, our records indicate the return shipping label was not used, and therefore, we are unable to track any return.Although we are unable to confirm, as a customer courtesy, please be advised that [redacted] has been issued a full refund in the amount of $374.98. I called to cancel the system and stated twice that I was going to start cooking myself The representative asked me after how much weight I lost I told her lbs and then said I have been working out She immediately exclaimed, in way to suggest that she was questioning my commitment to the program, "you've been working out?!" I said yes and she said, in a short chastising manner, "the average weight loss is lbs" I felt, by her tone of voice, that she was purposefully trying to be unsympathetic and accusatory She gave me her name: DanielCustomers should not have to be subjected to any representative's scolding just because they may feel that they aren't reprehensible

I have had multiple calls from Nutrisystem marketing peopleI have asked them on occasions to take me off their list and that I am not interestedThey continue to call and harass meThey called yesterday and they called again todayI am tired of telling their representatives to not call me any moreWhat do I have to do to get them to quit calling meEnough is enough

the worst, most disorganized, poorly run company I have ever spdealth with in years I placed an order , verified it 4.times addres, etc and bc they send no shpin notices or details of shipment not that their cus serv pople have any idea of what contact means! Still on a $50+ order of cinnamon rolls they sent thm to an address I was at in 1999, I got no apologies , spent hrs trying to find a sollution bc they argued the pckage was left at the front doordidn't say the front door of avery OLD address The tried to send another one but would not overnight it bcthey didn't know how to do that even though this order was frozen items!! days turn around for frozen items!, Real healthy , huh! I asked for a refund of $50+which I have not seen in my bank acct The$was for cinnamon rolls each 2"x2" ($a piece,) not a very good deal with a very disreputable company!

March 23, Revdex.com Of Metro Washington DC and Eastern Pennsylvania Attn [redacted] John FKennedy Blvd., Suite Philadelphia, PA Re: [redacted] , ID [redacted] Dear [redacted] The complaint submitted by ** [redacted] was received in my office on March 7, [redacted] enrolled in the NutriSystem Auto-Delivery Program via telephone on February 5, Our customers have the option to choose a customized plan which allows our customers to choose the individual food products they receive or they can choose a favorites plan which includes a pre-selected variety of Nutrisystem® meals [redacted] chose the Women’s Basic Favorites Plan [redacted] did not choose the customized food plan and she was not charged for it [redacted] also enrolled with a promotional offer that gave her an additional free week of food with her orders The promotional free week is not customizable Please see [redacted] ’s order details attached [redacted] was shipped her first order on February 8, On February 26, 2016, [redacted] was sent an email indicating her second order was being processed for her [redacted] ’s second order included the Women’s Basic Favorites Plan, the Select day frozen package and the non-customizable promotional free week of food On March 3, 2016, [redacted] was shipped her second order On March 3, 2016, [redacted] contacted Nutrisystem indicating she was having difficulty customization her next order which was due to ship on March 29, The customer service representative that [redacted] spoke with applied a $coupon to her March 29, 2016, informed [redacted] that she could not customize the promotional free week of food, but could customize the rest of her order for an additional $ [redacted] contacted Nutrisystem on March 5, again indicating she was still having difficulty with customizing her order [redacted] indicated that her free week of food disappeared from her order while she was customizing her next order and the price wasn’t correct The representative adjusted the price of [redacted] ’s order and informed her that the promotional free week of food would be shipped with her next order On March 7, 2016, Nutrisystem received a Consumer Affairs complaint from [redacted] regarding the free week of food that was to be sent with her March 29, order [redacted] would have received the promotional free week of food (non-customizable) with her third order that was due to be sent to her on March 29, However, in the spirit of good consumer relations, Nutrisystem sent [redacted] a separate free customized week of food on March 8, On March 9, 2016, [redacted] contacted Nutrisystem and canceled her Auto-Delivery program [redacted] was never charged for customization, was given multiple coupons to adjust her price and sent a free week of customized food Nutrisystem did everything possible to address the issues that [redacted] was having regarding customizing her third order before she cancelled the program We are sorry that we were not able to satisfy [redacted] and we wish her continued success with her weight loss goals If you have any further questions, please do not hesitate to contact me at ###-###-####, or by email to [redacted] @nutrisystem.com, or you may write me at the address set forth above Sincerely, Donna D [redacted] Senior Corporate Paralegal Cc: [redacted]

April 7, Revdex.com Of Metro Washington DC and Eastern Pennsylvania Attn: [redacted] John FKennedy Blvd., Suite Philadelphia, PA Re: [redacted] ***, ID [redacted] Dear [redacted] ***, The complaint submitted by ** [redacted] ** [redacted] was received on March 17, On February 21, ** [redacted] enrolled in the NutriSystem Auto-Delivery Program at www.nutrisystem.com With our Auto-Delivery Program, customers receive a special discount off the full retail value of a 4-week plan with an auto-delivery purchaseYou also receive free shipping (Continental US) By clicking the Submit My Order, customer’s authorize us to automatically charge and ship their order every weeks unless they cancel If they are not 100% satisfied, they can call ###-###-#### within days of delivery of their order and send the remaining non-frozen food back to us for a full refund, less return shipping If our customers decide to cancel before the second shipment and after the day guarantee period, they authorize us to charge a $early cancellation fee If they cancel any time after they receive their second month there is no fee After reading this language, customers click to “submit their order” The terms and conditions of the auto-delivery program are also posted under the Terms and Conditions on the site (please see attached) The auto-delivery terms and the cancellation fee are conspicuously displayed at the “submit my order” button (please see the attached page) ** [redacted] submitted his order and agreed to the terms prior to purchasing ***’s order was shipped to him on February 22, On March 16, 2016, ** [redacted] contacted Nutrisystem he wanted cancel his Auto-Delivery Program because he was not satisfied with his weight loss ** [redacted] was informed he would be charged a $early cancellation fee in accordance with the terms and conditions of the Auto-Delivery program he chose to cancel before accepting and paying for his second order ***’s Auto-Delivery Program was cancelled and he was charged the $cancellation fee ** [redacted] did not indicate he had any concerns with sodium or health issues when he called to cancel the program All Nutrisystem plans are designed to deliver sodium levels that are in line with dietary recommendations for a healthy population, which are set at = mg/daily (USDA Dietary Guideliens for Americans 2015-2020) The consumption of food that ** [redacted] provided in his complaint is not correct The maximum contribution of any one Nutrisystem entrée would have towards the daily sodium intake is 26% Not the 55% ** [redacted] indicated In addition, Nutrisystem does not currently offer any plans that include meals + snacks + shakes If ** [redacted] was concerned about his sodium intake Nutrisystem counselors are available to work with our customers to customize their plans so that lower sodium meals and grocery food additions are selected Nutrisystem could have worked with ** [redacted] to customize his next order so that it was lower in sodium for him Nutrisystem has two different policies in place for our customers to get a refund in the event that they are not satisfied with the program NutriSystem offers a day money back guarantee in which our customers can try our foods for days and if they are not satisfied for any reason they can return the remaining weeks of food for a full refund, less shipping Nutrisystem also offers a Return Policy in which our customers can return any unopened food item within days of receipt of their order for a full refund, less shipping (I have enclosed copies of these policies for your review)** [redacted] did not indicate he wanted to return any food when he cancelled his Auto-Delivery program We are sorry that ** [redacted] was not satisfied with the program In the spirit of good consumer relations Nutrisystem issued ** [redacted] a credit for the $cancellation fee ** [redacted] should see the credit applied within 5-business days We wish him continued success with his weight loss goals If you have any further questions, please do not hesitate to contact me at ###-###-####, or by email to [redacted] @nutrisystem.com, or you may write me at the address set forth above Sincerely, Donna D [redacted] Senior Corporate Paralegal Cc: [redacted]
