SUMMARY - Optima Tax's management has been in contact with the client in an effort to establish a line of communication RESPONSE - Optima Tax’s management has attempted to establish contact with the client to address his concerns as outlined in the complaintAs the client stated in the
complaint, he hired Optima Tax to represent him before the IRS regarding an outstanding liabilityAfter Optima Tax completed the initial Investigation and obtaining the IRS conditions, Optima presented our findings to the client along with our formulated strategy to finalize a resolution on the client’s behalfThe services that the client contracted Optima Tax to perform included, among other things, setting the client up on an affordable Installment Agreement based on the client’s financial situationAt no point did Optima Tax guarantee that the client’s overall tax liability would be reduced by any specific amountHowever, Optima Tax prides itself on pursuing every available option to ensure we obtain the best possible outcome for our clients, which may include a reduction of our client’s liability Prior to engaging Optima Tax Relief the IRS had already begun collection efforts against the clientAlthough Optima Tax is capable of obtaining a Stay on Collection activity from the IRS, the individual circumstances and complexity of the client’s case will ultimately dictate whether the IRS is willing to accept the stay of enforcement we negotiate on behalf of our clientMoreover, Optima Tax does not promise, guarantee or in any way insinuate that we can stop all collection activity, as the ultimate decision to accept a Stay of Enforcement is with the IRS While in the Resolution Phase, a client must be in complete compliance with the IRS, which means all tax returns must be filed, before Optima Tax can begin negotiating a final resolutionThe client was thoroughly advised of this requirement throughout the processOptima Tax did in fact prepare and file the client’s tax returns for and 2015, as was agreed to in the Client Service Agreement AddendumAs the client references, the overall liability increased upon the IRS accepting the and tax returns because of additional tax being owed for those yearsHowever, the increase in liability is not a result of Optima’s failure to act in accordance with the Addendum Agreement Although we understand that the client was hopeful of obtaining a reduced tax liability, Optima Tax clearly disclosed to the client that a reduction is not guaranteedBecause of the client’s dissatisfaction Optima Tax has offered the client a refund as a courtesy to him, to which he has declined as stated in the complaint At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophyWe take all complaints very seriously, and we do our best to turn them around when possibleOptima Tax believes it has addressed the client's concerns appropriately and will continue to reach out to the client until we come to a final resolvePlease do not hesitate to contact Optima Tax with any questionsThank you

After reviewing the complaint and thoroughly researching our data base, it does appear that
Optima Tax received an online inquiry and request to contact *** *** about our services
regarding potential tax liability
Optima Tax associates will not reach out
to a potential client
unless he or she submits an inquiry through our web portal and Optima Tax associates never
solicited *** *** prior to receiving the information onlineOnce *** *** indicated that he
was not interested in our services and requested that we remove him from our call list we
complied to his request immediately.
Based off our further internal review by our IT department, it appears that his information may
have been maliciously submitted by another individualWe do not cold call and since we are not
a telemarketing firm, we do not believe the Do Not Call Registry is applicable in this situation.
Beyond the aforementioned, this person is not and has never been a client of oursIn light of this
information, we respectfully request that this complaint not be published to the public and instead
be removed entirelyWe appreciate your attention to this and will anxiously await your response

When I first contacted Optima tax relief, *** told me they would handle and negotiate all my tax needsAfter I paid them $4045.00, they will only file state taxes and there will be no negotiating with the state franchise board
*** also told me that he would be my contact for the entire process, not trueI have been passed on to different people with their company
They rushed me to get all this paperwork in to them, threatening that if I don't, the IRS would garnish my wages sooner than later
The last time I heard from the via email was July, 27th I have emailed them since then and I haven't heard ANYTHING from themI am not able to call due to the fact that I work in construction with a hour commute each way and cell service is not very good
I have gone to their client portal and it states that my account is in investigationsI don't know what that meansBut, if they're investigating me, you would think that they would have questions for me and at least try to get ahold of me
I cannot believe that they have had so many good reviews which is the reason I decided to go with them in the first place
Be very cautious if you do business with Optima Tax ReliefI wish I would have used someone elseDon't get taken like I did

I'm extremely happy with the assistance I received from Optima Tax with my tax debt..I was kept well informed and well advised on decisions regarding this matter

As stated in our initial response, Optima Tax does not provide an accounting of time as we charge a flat fee for services based off the complexity of the caseOutside of preparing and filing the client’s tax returns, the assigned team made numerous attempts to obtain various financial documents to continue moving forward with resolving the casePer our records, the client sent in only a small amount of the requested financial documents Also as stated in our initial response, Optima Tax at no point advised the client that they were not at risk of having a lien filed against themTo further our statement, we have both written and verbal confirmation on file that we specifically informed the client that the IRS can at any point file a lien against the tax payerTo say that we advised the client otherwise is an inaccurate statement Although the client may not have spoken directly with one of Optima Tax’s Tax Professionals, the client worked directly with his Tax Preparer and his assigned Case Manager, who acts as a liaison between the Tax Professional and the clientGiven the fact that our Tax Professionals spend a vast majority of their time servicing our client’s cases, it can be difficult to schedule an appointment for our clients to meet with the Tax ProfessionalThis is precisely why we have a Case Manager in place to be the liaison between the client and the assigned Tax Professional We understand that the client has a certain expectation with regards to a resolutionHowever, his request for a refund is unreasonable given that Optima Tax was performing its contractual obligations prior to the client cancelling our servicesFurthermore, we presented the client with what we feel is a fair resolution in an effort to resolve this matter mutuallyWe will continue our efforts to come to a mutual resolve with the client

When I applied for help from Optima Tax,I had no idea what to expect.I was contacted by phone,informed what I had to do to get started with my account.They informed me of the cost,they gave me the information they required from me to start the application processA great group of case workers and very meany phone calls,Optima Tax produced a very agreeable settlement for us.It could not have been any more satisfying for us

In June of 2017, Optima Tax had presented the client with a partial refund, despite Optima Tax having fully performed its obligationsOptima Tax will continue to reach out to the client and go over the options we presented in June of Correct, we did not have a specific list of documents at the time of enrollment that the client would have to provideThe reason being is that each individual case is different, and the IRS will request different information depending upon individual circumstancesHowever, once the services began it had been determined that an itemized list of financial documents were needed for Optima Tax to review in order to establish the best possible resolution for the client with the IRSPer the Client Service Agreement, it stipulates that any requests for documentation must be provided to Optima Tax Relief within business days of the requestThe client failed to do so, and confirmed with his assigned team that he cannot provide the requested documentsThese documents are imperative when negotiating a favorable resolutionThe requested documents have everything to do with the caseGiven the particular circumstances of the client’s situation, the IRS requires substantiation to ensure that they agree to a resolution suitable for the IRS and the Tax PayerContractually speaking, all clients are required to provide Optima Tax with the requested documents in order to resolve their caseIn this particular case, the client’s inability to provide the necessary documents prevented Optima Tax from achieving the client’s desired outcomeAs stated in our initial response, the assigned team achieved a Non-collectable statusMeaning, the IRS will not proceed with collection efforts, so long as the client continues to meet the requirements for Non Collectable StatusAlthough the Non Collectable Status was not originally included in the client’s agreement, the client’s financial situation evolved during the course of services, and this result became the best option for the client’s situationThe resolution the assigned team negotiated on behalf of the client, puts him in a position where he does not have to pay the debt unless his financial circumstances change With a Non-collectable status the IRS will issue a lien against the tax payerThis is to ensure the IRS’s interest in the liability is protected if the tax payer happens to fall out of a hardship or obtains a large sum of moneyThe client had been thoroughly educated why a lien was filed while under the Non-collectable statusAt no point did the client inform his assigned team that the IRS levied his bank account and we cannot verify the veracity of this statement

I like the way that Optima Tax Relief does business They're very professional They're open, honest and up front about details They don't keep you in the dark about anything They're honest about their chances of helping you; given your present situation with tax issues Their fees for services seem to be moderate Without their help my problems could have turned into a night mare Thanks to Optima Tax relief, my predicament with the IRS was resolved most favorably

I had a 60K tax debt to pay off and no chance of doing so I did my research and ended up contacting Optima Tax Service and they got back to me right away From the beginning, I was treated with the utmost respect and kept informed of the process each step of the wayIt took a while for the process, but they kept the IRS at bay during that time They were able to reach a resolution which will allow me to make payments on an Offer in Compromise for the amount of 9K I would recommend them to anyone that is looking for a resolution to their problems

client stated, he hired Optima Tax for representation as they had outstanding IRS tax liability balances for various yearsOur approach to each case we assist with has remained the sameThe first phase, Phase one, we investigate the client’s liability, gathering information from both the client and the IRS, and analyze and formulate a strategy to help resolve the case and present it to the client accordingly Once we completed our Investigation the client received a thorough breakdown of our strategy and decided to hire Optima Tax as their representatives to help resolve their caseThereafter, the client's assigned team went to work immediately and finalized his case as outlined in the Client Services Agreement provided to the client While reviewing the complaint, the client stated that he can submit a hardship letter that could reduce the feeWe are assuming the fee he references is our Resolution Retainer to take on his caseAlthough we have an option that we can offer our client’s that find themselves in a position where affordability ultimately is the deciding factor to move forward this is in no way unethicalThis is an option the client can take advantage of if it brings financial relief Additionally, based off our Investigation the client was never on a payment plan with the IRS prior to contacting Optima Tax as they have claimedFurthermore, the client was deep into collections activity with the IRS which required Optima to negotiate a hold on the collection activityAlthough the client did not have a lien in place the IRS at any time can file a lien against a tax payer to protect their common interest in the outstanding balanceConsidering the client’s balance exceeded a certain threshold it is likely for the IRS to issue a lien in these situations Lastly, the client was thoroughly informed of the services Optima Tax will be providingThe Resolution Addendum Agreement was provided to the client before any payment was drafted from their accountThis Agreement thoroughly explains the services to be provided and outlines all details of the client's enrollmentTo ensure that the client had a full understanding of the services Optima Tax was to provide they went through a voice recorded Verification Call that covers all legal disclosuresAfter each disclosure is given the client must respond with a yes answer acknowledging they fully understand the disclosure before they are able to move forwardWhen we disclosed the services Optima Tax will provide, the client promptly answered with a yesThose disclosures also state that a reduction is possible but not guaranteedAgain, the client answered with a yes and continued moving forwardFor the record, Optima Tax submitted the necessary paperwork to the IRS in an effort to reduce any penalties associated with the balance and achieve the best possible outcome for the client At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophyIt’s unfortunate that the client is dissatisfied with our services but we worked their case as agreed uponWe do take all complaints very seriously, and we do our best to turn them around when possibleOptima Tax believes it has addressed the client's concerns appropriately and will continue to reach out to the client until we come to a final resolvePlease do not hesitate to contact Optima Tax with any questionsThank you

For your reference, details of the offer I reviewed appear below.As I stated in the dispute form, the investigation phase was never completed. Per multiple emails with *** ***, The investigation phase consists of, “providing a stay of collection, conducting the investigation, and building a full financial profile.” Per the contract that I signed, after completing the investigation phase, I would receive a final investigation consultation, in which you would “go through the details of my Personal Tax Resolution plan and explain why you recommend this course of action. At this point, you would also provide a breakdown of costs to implement my Tax Resolution plan and an estimated timeframe to complete my plan.” I never received a Personal Tax Resolution plan, nor a discussion of why you recommended this course of action nor a break down of cost or a timeframe to complete my plan. As this is a major component in the “Investigation Phase”, I do not feel that Optima Tax Relief completed what was promised to me in writing by *** *** or what was also contractually signed for
