Finally, to help employers with their decision to purchase from Personnel Concepts, the mailer informs that, "If you are not completely satisfied with our products, return them within 30 days" for a full refund. The mailer also states that "individual posters are available for free from the government". Personnel Concepts regrets that the complainant does not see the value in the products received. Concepts documentation shows that two mail order cards were received from the company for the purchase of the Louisiana and Federal Labor Law Poster, both order cards were signed by the complainant. On 12/09/15 an agent from Personnel concepts contacted the company to confirm the information on the order cards. The records indicate that the agent spoke with the complainant who confirmed the information and advised the office has fewer than fifty employees, offers health insurance, has one posting location, and has no employees that only read Spanish. The agent reviewed some additional compliance requirements the company would need; the complainant advised he wanted to do some research prior to placing the order. Personnel Concepts waited one week for the complainant to respond then resumed efforts to contact the company for a decision. The orders were automatically released by the system on 01/04/16 due to the time sensitive information on the postings. Personnel Concepts has requested the Quality Assurance Team review these calls and to notify the Sales Manager of any issues found. Personnel Concepts clearly prints their 100% Satisfaction Guarantee on each invoice which advises the customer the they are not completely satisfied with the products they may be returned within 30 days less shipping and handling. Personnel Concepts Account Receivable Team made several attempts to contact the company regarding the open balance, Personnel Concepts has no record of any contact from the company prior to February 23, 2016, when complainant contacted the Accounts Receivable Department and advised he did not authorize the orders to be shipped. The representative that received this call advised the complainant of the return policy.

Personnel Concepts records show that an order card was received from the company on 07/25/16 with check number 1149 for the purchase of the Indiana and Federal Labor Law Poster, on 08/09/16 a representative from Personnel Concepts contacted the company and spoke with the Financial Secretary who advised she was the authorized purchaser, the records indicate that the complainant authorized the representative to add the OSHA Safety Poster and the FLSA Poster with a subscription service that provides the company updated posters each time there is a revision or change to the posters for one full year. The Secretary also authorized the purchase of the Affordable Care Act Poster and the National Labor Relations Act Poster be added to the order. The Secretary requested to be invoiced for the additional items. An agent from Personnel Concepts contacted the company to confirm the information as well as offer additional products to assist the company with their compliance needs. The agent spoke with the complainant who identified herself as the Executive Assistant and the authorized purchaser. The complainant approved to additionally purchase an OSHA Safety Poster and a Fair Labor Standard Act Poster and the HIPAA poster, with a subscription service that provides new posters each time there is a change to these guidelines. The employee also added an Interviewing & Hiring Program, and an Affordable Care Act Poster. The employee requested to be invoiced for the remaining balance of $239.19. This order shipped on was delivered to the company on 12/15/14 via UPS under tracking number 1ZXXXXXXYXXXXXXXXXX. Personnel Concepts clearly prints the 100% satisfaction guarantee on each invoice which advises the company that if they are not completely satisfied with the products they may be returned within 30 days, and requests the company contact the Customer Care Department at X-XXX-XXX-XXXX to arrange the return. Personnel Concepts records show that on 01/23/15 the complainant called in to request to return the merchandise. The agent that took the call explained the 30 day policy and the offered the complainant a 25% discount to keep the order, the complainant agreed to this arrangement. On 01/17/15 another representative from Personnel Concepts called the company and spoke with the complainant, during this call the complainant agreed to purchase the Equal Employment Compliance Program with a one year subscription service and the Emergency Preparedness Poster Bundle, and again requested to be invoiced for the total of $392.18. On 01/19/15 Personnel Concepts received an email from a different employee of the company requesting to cancel this order as these items were already being address by the company. Personnel Concepts responded to this email advising the products had already shipped and requested the employee contact Customer Care department to arrange the return of the products. On 02/03/15 the employee did call in and the return was authorized under return number XXXXXXXX, unfortunately Personnel Concepts has no record of the products being received back. In an effort to successfully resolve this complaint Personnel Concepts has issued full credit for both orders under credit memos XXXXXXXX and XXXXXXXX and confirms this account now has a zero balance and has been removed from all collection activity. Personnel Concepts has confirmed that all information provided on file for this company, has now been removed from all future mail, phone calls, and email; please allow 6-8 weeks for mail suppression and 30 days for fax suppression due to campaigns already in process. Personnel Concepts records indicate that a mail order card was received from the company for the purchase of the South Carolina & Federal Labor Law Poster. An agent from Personnel Concepts contacted the business on 01/22/16 to confirm the information on the order card as well as discuss additional items to assist the company in meeting their compliance needs. The documentation on the account indicates the agent spoke with the complainant who identified himself as the owner and authorized purchaser for the company, the complainant advised the agent that the company had zero employees, the agent advised that the company was not required to post the poster that was ordered and advised the complainant of the alternate merchandise that would assist the company with meeting the compliance requirements. Personnel Concepts records also indicate that the complainant spoke with the Accounts Receivable department on 03/04/16 and advised he did not authorize this merchandise and has not received the merchandise. In an effort to successfully resolve this complaint, Personnel Concepts has issued full credit for this order and has requested the refund for the payment received be expedited. Personnel Concepts has requested the Quality Assurance team review all call recordings to the company regarding this order and notify the appropriate management staff of any issues found for immediate handling.
