The Customer Service Department sent another response sincerely apologizing and advised the complainant that no order was placed and the agent intended to inform the complainant to please allow 8-10 weeks for mailers to cease (this is due to campaigns already in process). Initial Consumer Rebuttal /* (2000, 7, 2015/11/12) */
(The consumer indicated he/she ACCEPTED the response from the business.)
I accept the response from the business. However, I would suggest to them that they not troll for addresses to send out their order forms to. Their order forms are clearly designed to make people think they'll be out of compliance with a law if they don't order the forms (which are freely available from the government). I can only assume they found my address in the Board of Psychology's list of public addresses, which is an inappropriate use of these addresses.

Personnel Concepts regrets the complainant did not accept the initial response.  Personnel Concepts mail campaigns are scheduled up to eight weeks in advance, and the mail vendors have the mailers staged at the Post Office to be mailed within this timeframe.  Once the account has been selected and the mailers have been received by the Post Office there is no way to have the mail piece removed.  This is the same process for the fax campaigns; the lists are pulled and sent to the fax vendor weeks in advance and are staged for automatic release.   This complaint has been escalated to the Communications Team for review of the current process to determine if any adjustments can be made.

Upon receipt of this complaint, [redacted] launched a thorough investigation. On 04/14/15 [redacted] received a mail order card with check [redacted] for the purchase of the Massachusetts and Federal Labor Law Poster. [redacted]...

[redacted] contacted the company to confirm the information on the mail order card. The agent spoke with the owner of the company who confirmed the information and also added the OSHA Safety Poster and the Fair Labor Standard Act Poster along with a subscription service that would provide the company a new poster when an update occurred for one full year. This order was paid in full by the company and no complaints have been noted to date. The posters the complainant recently received were part of this service, so there is no new invoice.
On 07/20/15 an agent again contacted the business and another order was placed for the purchase of the Equal Employment Opportunity Policy Poster, the Emergency Preparedness Poster Bundle, and the National Labor Relations Act Compliance Kit. On 10/21/15 the complainant contacted the Customer Care Department and advised the order was unauthorized, the agent that took the call immediately issued a return merchandise authorization number to the complainant and advised the call tag would be emailed the next day. The merchandise was received back on 11/20/15 and full credit was issued for this order. $252.89 when Personnel Concepts received a mail order form and check # 6620 for the purchase of the Michigan & Federal Labor Law Poster; a representative contacted the company and spoke with the receptionist of the company, who advised she is the authorized purchaser.  The records indicate the receptionist advised there were five employees, the company does not offer health insurance, and there are no minors and no employees that speak/read only in Spanish.  The representative discussed additional items available to assist the company with their compliance needs.  The receptionist authorized the representative to add the Employer Notification Subscription Service to the order, which includes the Labor Law Poster, originally ordered by the company and the OSHA Safety Poster, the FLSA Poster and includes a new poster whenever there are revisions or changes to the original poster.  The receptionist also authorized the I-9 Compliance Poster and the NLRA Compliance Poster. Personnel Concepts has requested the Quality Assurance team review all calls regarding this order and to notify the appropriate management staff of any issues found during this review.  A review of UPS tracking shows that the company did refuse the package, and it is out for delivery at this time.  In an effort to successfully resolve this complaint to the satisfaction of both parties, Personnel Concepts has issued full credit for this order under credit memo 61295710, and approved full refund for the initial payment received from the company.  Personnel Concepts confirms the account balance is zero.  Personnel Concepts has set the internal codes to permanently remove this company from all future calls, emails, faxes and mailers; please allow six to eight weeks for mail suppression and thirty days for fax suppression due to campaigns already in process.Personnel Concepts hopes that these actions will resolve the concerns raised by the complainant. Summary: Full credit has been issued for the order in question and refund for the payment received has been approved.  This company has been removed from all future contact.
