I am rejecting this response because this does not excuse the practice from being in itself predatory and does not address my overall concern with the process. The fact that I was offered a low rate for the resort booking does not excuse the fact that any of your vendors could turn around, offer an insanely low booking, and then make up their difference on the back end of the booking through additional fees that the then "locked in" customer cannot avoid. A simple disclosure of these items does nothing when a customer has specifically stated what price they want to pay and are offered that price through the booking. They have no option of choosing to not opt into a resort fee to obtain this price. By forcing your vendors to disclose these fees to build them into the actual price, you would avoid all of these incidents and give the customer exactly what they thought they were getting THE ACTUAL PRICE QUOTED FOR THE SERVICES DESIRED. It is akin to walking into a grocery store obtaining milk at the back of the store for a listed shelf price, paying for it, receiving a receipt, and then walking to the front of the store to be told that the total price of the milk is not what was originally quoted, but being forced to pay the difference or walk out of the store without the milk and the original funds paid to purchase said milk. It would be one thing if the fees your vendors are charging were optional, or the services optional, but they are not. The fact that you allow vendors to do this traps your customers into a much higher rate than they were expecting, or would normally have to pay. That is the predatory aspect. Simply pushing the problem off on a simple disclosure line or by saying you encourage your vendors to list their full price does not excuse the fact that your contracts with these people could specifically require them to disclose these fees, thereby not surprising your customers on the back end with them when they are already committed to purchase with apparently no option of a refund. You have a responsibility to your customers to ensure your vendors are not conducting themselves in this manner, or to give your customers the option. You have not.

correspondence. The consumer is requesting a refund for the airline ticket cancel
fee.
When the consumer booked the reservation, he was presented
with a Contract Page to review and initial. Under the "Important
Information" of the contract, we informed that the reservation you are
about to purchase is restricted and it is non-refundable, non-transferable and
non-changeable. When the consumer submitted the request, he/she indicated agreement
to the terms and conditions stipulated on the contract. By submitting the
request and clicking the "Buy My Tickets Now" button, the consumer
also indicated that he/she understood the information stated on the contract
that, "If we find an airline that
accepts your price, we'll immediately purchase your tickets using the payment
information you provided." An exception to the no-cancel policy was
granted to the consumer with the condition that the consumer submit a new
reservation with the correct information in order to obtain a refund for a
portion of the cancellation fee. We are unable to waive the cancel fee charged.
We are sorry that we are unable to
assist the consumer any further in this situation.

“Because of the conditions of the small
print in the contract, that I could not live with, I would now like a refund as

retail/published price reservations that offer free cancelation.  When selecting a reservation, and prior to purchase,
the consumer is provided with the cancel policy associated with each
reservation.
In this case, the consumer selected a non-refundable, non-changeable
Name Your Own Price reservation that provided greater savings and less
flexibility.
The screen shot provided by the consumer
indicates that the customer had clicked on one of the retail options for a Compact
vehicle, and the pop-up box for that specific retail selection appeared, (you may
note the words “[redacted] or Similar” in that image).  Then the customer
scrolled down the page while the retail option pop-up box was still in front of
it, and obtained a screen shot.
Attached hereto is an example of the actual
view of the retail option pop-up box when selecting rental car information for
a retail/published price option.
On each consumers’ contract page, (including the contract
page in question), we clearly and conspicuously place the following disclosure
regarding this issue labeled under Important Information.

Once

Rental cars are
non-refundable, non-transferable and non-changeable even if the reservation
is not used.

If your
offer is accepted, we will immediately lock in your reservation and charge
your form of payment. If your offer is not accepted, you will not be charged.

Additional
charges may apply at the counter if you pick up or drop off the car at a
different date, time, or location than you requested for your reservation.

Your
offer price does not include vehicle liability, collision or personal
accident coverage for your rental car. You should determine if you have
insurance coverage prior to pick-up.

rental partner will charge the driver at the rental counter for optional
items you add to your reservation, including any child seats or special

Only the
driver will be able to pick up the rental car at the counter and must present
a valid driver's license in his/her name. An additional driver can be added
at the counter for a fee payable directly to the rental car company.

The
driver will be required to present a valid credit or debit card in his/her
name for the refundable security deposit.


·       
The
amount for the refundable security deposit required at the rental counter
depends upon the car type, rental period, and optional items. Pre-paid cards
or cash will not be accepted for the security deposit. If the driver provides
a credit card for the security deposit, the security deposit will be released
back onto the card once the vehicle is returned. If the driver provides a
debit card for the security deposit, proof of round trip airline travel may
