I understand Mr*** complaint correctly, he has disputed the charges
submitted for collection because he was physically unable to live in the 3rd floor unit and the apartment complex would not accommodate his request for a 1st floor unit. Additionally, Mr***
states that our Agency violated the UDAAP and FDCPA with threats and
intimidation and by denying him a payment planOur
Agency received Mr*** account in June of from our client,
Midtown on Main Apts., to assist with the collection of final move-out charges
with an original balance of $2,for the Lease Termination fee and
damages.Upon
receipt of this complaint, our Agency reached out to our client and received
documentation supporting the charges and validating the account. I specifically inquired with the property
representative about Mr*** request for another unit due to a knee
injury. The representative acknowledged
the consumer had presented their office with an emergency room document but had
no indication he was unable to use the stairs or would require other accommodations. Furthermore, He stated Mr*** was
instructed to provide additional documentation reflecting the need for
different accommodations, but it was never receivedAttached you
will find a copy of Mr*** move-out statement, itemizing the charges,
1st and last page of lease and Emergency Department DC Instructions
provided to our client, for your review.
A copy of these documents will be mailed to the address provided in this
dispute. Consumers often contact us with a
unilateral decision regarding repayment of debts and we are often faced with
the unenviable task of explaining to them that, while anything sent to our
office will be applied, that payment arrangements or settlements were not part
of the original agreement and that we are under no obligation to accept terms
of anything less than the full balance of the defaulted debt. That being said, our records reflect the Collection
Manager that spoke with Mr***, offered him an opportunity to settle his
account for less than the full balance with a payment to be made in June and the
remainder of the balance in July. Mr
*** stated he would try to meet the settlement agreement and set up a
payment to be processed in June. I apologize
if Mr*** experience with our office was anything less than he
expected. A review of the conversation
the collector had with this consumer reflected the collector would greatly
benefit from coaching as his attitude was in direct conflict with our culture
and the collectors pledge and has since been addressed internallyThis office
owes an apology and our appreciation to Mr*** in bringing the matter to
our attention.This
account was marked as “disputed” in accordance with the Fair Credit Reporting Act and at the
request of Mr*** “Cease and Desist.” The account will continue to report as “disputed”
in accordance with the Fair Credit Reporting Act as we feel the account has
been validated by our client and the balance is due. If Mr*** has any questions regarding

Please accept this as I.QData International’s responseIf I understand Ms***’ complaint
correctly, she has indicated the onset date and amount reporting on her credit
report for this account are inaccurate.
Additionally, she implies our agency is being “vengeful in her eyes” in reporting the account to her credit
reportOur Agency received Ms***’
account January of from our client, Prairie Creek Apartments., to assist
with the collection of final move-out and eviction charges associated with Ms
***’ vacating of the unit, with an original balance of $2021.71. The account was reporting the judgment date
of 12/06/as the first date of delinquency, we have changed that to reflect
her move-out date of 12/20/ Upon receipt of this
complaint, I reached out to our client and received validation of the
balance. Ms*** did pay $1,
on 12/5/2011, leaving a remaining balance of $however, there were
additional charges for late fees, court costs, removal of personal property, a
pet fee and carpet replacement that were applied after her actual move-out
date. Those charges are outlined on the
attached ledger.I
appreciate Ms***’ frustration in resolving her account and having the tradeline
on her credit report. It is not our
intent to be “vengeful” as Ms***
implies, as a Data Furnisher it is our responsibility to update the Consumer
Reporting Agencies of the status of an account Ms
***’ account has been marked as disputed in accordance with the Fair
Credit Reporting Act and while it is disputed our office does believe the
account to be validated and will remain in our office until resolved. Attached

If I understand, Mr*** has rejected our response because he is waiting for confirmation that the collection of this account had been deleted from hid wife's credit report.
In review of our records, we do not have a "Disclosure Authorization Form" on file for Mr***'s wife so we did not include any of her information in our responseWe have however, processed the inquiries into her credit report for IQ Data International and have mailed them directly to her
I hope that this will suffice as an answer and Mr*** is satisfied with our response.

Regarding complaint for *** ***Case# ***Dear Ms***,Thank you for giving us the opportunity to respond to Ms***’s complaint
Upon receipt of this complaint, our office has reviewed the accountPlease accept this as I.QData International’s response to the complaint
If I understand Ms***’s complaint, she is claiming her account is fraudulent. Ms*** states that she does not owe on this account because she never resigned a lease and the apartments did not follow through on moving her to a different unit. Furthermore, Ms*** states that only some of the Consumer Reporting Agencies are reporting the account
In review of this account, our client, *** ***, provided our Agency a copy of the signed lease that expired on August 31, 2012. Paragraph “LIKE TERM (RENEWAL) states the lease will terminate if a day notice is given, failure to give the required notice will automatically renew the lease and terms thereof. A resigned renewal was not required.
As to the conversations Ms*** had with the apartments agreeing to move her to a different unit due to hurricane water damage. Unfortunately, we cannot speak to conversations, events or actions that occurred prior to the account being submitted to our Agency.
MsH*** states that the account was removed from Transunion, but is still reporting on Equifax. The Consumer Reporting Agencies have various reporting criteria that may or may not have effected MsH***’s account reporting status. Our records reflect that MsH***’s account has been updated to the Consumer Reporting Agencies, Experian, Transunion and Equifax monthly since receipt of the account. Upon receipt of this complaint, our office reached out to our Client, *** *** for additional documentation however, we never received a response. It is our responsibility to respond to consumer’s disputes in a timely fashion, in response to this complaint, our agency has decided to cease collection efforts and has updated the account status as “Assigned in Error.” That’s not to say the debt is not owed however, our office will not proceed with collection activity. The updated information has been submitted to the Consumer Reporting Agencies, please allow 5-business days for processing. I appreciate MsH***’s frustrations regarding the charges on her account, she can be assured that our office will not be contacting her regarding this account, furthermore you will find attached a copy of the “Assigned in Error” letter mailed to MsH***.
