in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I'd like to see what this supposed response was because I never received it.  I've been ignored and my emails remain unanswered for over a month.  I can't even go to the gym most days because of the change in hours at the kids club, this is incredibly unfair to paying customers.  I feel like I've been tricked into signing up for this gym for 2 years under false pretenses and a few short months later I can't even use it.Regards,[redacted]

reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.There was a follow up call from someone but all they did was deny responsibility and defend the actions of their corporation. There is no agreement to not be allowed to cancel without a 200.00 dollar termination fee or agreement to automatically charge an annual fee because these one sided fees  were not explained at the time of signiture where there is supposed to be a meeting of the minds.
I would not have agreed to membership if these things were explained to me and I highly believe that the salesman/manager do not have any incentive to explain these terms and purposely avoid them.Regards,[redacted]

Please note that we
recommend reviewing your bank statement month over month (April 2015 to date)
as it will indicate that your bank released the funds after our initial attempt
to pull your original payment in April; this amount was returned to us unpaid.
There was another attempt to collect payment owed in May at which time the
payment was successful. This payment has been successfully refunded to you per
our prior response. Since you were not charged twice as per your claim, there
is no additional refund due to you.
We suggest that you
contact your banking institution for further assistance and
clarification regarding the payment in question, as well as their handling of
the debit process.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.As indicated in my previous message, 24 Hour Fitness has not agreed to honor what their representative told us when we purchased the membership.  Although the membership agreement contains a clause permitting annual renewal increases, their representative told us that for a large upfront fee, we would only have to pay an annual renewal rate of $99, and the rate would never increase (this was apparently a very common practice by 24 Hour Fitness representatives - to get people to sign up for memberships, pay large up front fees, and promise that the annual renewal rate would never increase (for example, see [redacted] Under California law (Riverisland Cold Storage, Inc. v. Fresno-Madera Production Credit Assn. (2013) 55 Cal.4th 1169), evidence, other than the actual contract, can also be considered to show what the parties actually agreed to, and to show that there were misrepresentations made when entering into the contract.  By increasing our fees now, we feel that 24 Hour Fitness misrepresented the membership we purchased when we paid the large up front fee.   24 Hour Fitness also claims that the fee increase was "an important and necessary step to ensure we provide all of our members with a clean, friendly, well-maintained club experience."  However, at my club, I have not noticed any "steps" taken to ensure a "clean, friendly, well-maintained club experience."  So, this explanation does not even come close to addressing my complaint.In the end, I would have hoped that as members that paid their dues on time for several years, and according to the terms of the membership as explained to us when we purchased the agreement, 24 Hour Fitness would treat us fairly and honor what their representative told us about only having to pay an annual renewal rate of $99.Regards,[redacted]

r I am dissatisfied with 24 Hours solution, because it disregards the fact that their employee wrote me this email in response to my email. My solution is that 24 Hour should honor the 3 to 5 percent increase annually being that their employee stated this in writing. 24 Hour wants me to pay $129.00 per year plus tax, and be subject to unlimited increases with no ceiling. I feel I should only pay $ 29.00 per plus an increase of 3 to 5 percent increase annually plus tax. This amount would be $32.33 for 2016. 
I have also included [redacted] email also and my response. 
I will probably turn this over to my attorney, if we cannot to some type of resolution that is fair to both parties.
How do I handle my renewal until this issue is resolved?
