For your reference, details of the offer I reviewed appear belowThe facts stated by Rushmore are inaccurate On the August 1st conversation, the associate confirmed that payment was receive 7/and not 'over the weekend' My address was changed(to a temporary address which I resided through 9/and continue to have access as necessary) on 8/and confirmed again on the 8/phone call These could both be verified if Rushmore had taken the time to review the recorded callsThey present that they received 'unable to forward' responses, the last date being 8/and never attempted to reach me by phone or email even though, by confirmation on the call 9/10, they had both of these documented accurately On the same phone call from 9/10, I changed the address to my now permanent address Again, had Rushmore even attempted to understand the issue via the recordings, would have been in a position to improve communication and resolutionThe bottom line;they should not have processed the withdrawal 8/1, they should have been able to process a refund immediately versus the ridiculous process of me requesting to have my own money back, they should have contacted me when they received the 'unable to forward' and should have taken care to represent themselves better as part of the resolution I've had to incur interest as part of not having my funds prior to 9/and this is a company that benefitted from year of on time payments Nice to know that a company appreciates your business

I have filed a previous complaint about the company forcing to charge unnecessary insurance on my behalfThe company has notified me that they stopped charging me (Certificate number: ***)However, they are still charging me extra money every monthAnd the recent statement shows they deducted money from my account for some hazard insurance.Desired Outcome: Adjust my payment (remove escrow amount: 223.59) and refund whatever amount was deducted for the hazard insurance that shouldn't exist in the first place

We have conducted an investigation in
regards to your concerns related to the call that you had with a Rushmore
employee on December 29th, 2015, as well as your request for reduced
terms as part of a permanent loan modification.
We take all such inquiries from our customers extremely seriously, and
we would like to respond to both parts.
First, we listened to the recorded call
referenced in your inquiry from December 29th, and we also listened
to all calls concerning your account that took place during the month of
December Rushmore did not find
anything said that was offensive or that could be taken the wrong way or out of
context. Specifically, we listed to the
call on the 29th, and did not hear anything to substantiate the information
provided in your inquiryFurther, our
records show that we have maintained consistent communication with you throughout
the loss mitigation review process. For
example, you were informed that because you completed the Trial Modification
Agreement that was executed by you on July 31st, 2015, there was not
an appeal process that could take place.
An appeal (where required) would occur when a loan modification is
denied. In this case, a loan
modification was approved, and an offer was made to you.
The second item that was mentioned
in your inquiry was a request for different terms for a permanent
modification. Specifically, the request
was for a lower monthly payment amount.
Currently, Rushmore does not have documentation from you reflecting
either a material change in financial circumstances, or with your income. If you would like to provide us with
documentation, we can review it upon receiptAlso, as of now, you have not agreed
with the terms that were offered for the permanent loan modification. Rushmore calculated your new Debt-To-Income
Ratio (“DTI”) at 18% with the newly modified payment that was offered, which is
well within the affordability guidelines provided by the owner of your loan.
Please note, as a consumer you have
the right to request the investigation documents relied upon to determine our
conclusion with regard to the inquiry that you submittedEnclosed, we have

judiciary stateRequires 30day prior notification of such a filing as well as
assignment of mortgage- Attached is the
complaint filed in along with the Bankruptcy Relief Order that allowed
Rushmore to continue on with our foreclosure actionWe did not restart the
foreclosure; therefore, no new notices were legally required
-They are not paying my taxes as
they claimed and are trying to recover in their latest modification offerI
received a delinquency notice from my town, they are quarters behind- Rushmore is currently researching any
potential back taxes on the propertyIf we find that there are delinquent
taxes, we will pay them and add that to the total debt owed
-They won’t tell me who my payments
go to, only trusts on the note- All
payments are to be paid to Rushmore Loan Management ServicesBut again, we can
only accept payments once we establish a written agreement that outlines a
permanent resolution to the accountRushmore offered the modification in May
and you rejected the offerWe offered the same modification again in
October and again you rejected it
-They send back my payments, stating
it doesn’t cover past due but did accept payments, October & November
2014- We will not accept any payments
unless we have a written agreement in place with the borrowerThe borrower
refused both of our loan modifications
-They ordered a market analysis for
the modificationIt showed my home is $less than balance, never reduced
the balance according to HAMP guidelines but are charging me in advanced
corporate feesRushmore is not legally
required to reduce the total amount owed by the borrower
-I haven’t been able to get a hold
of my case manager *** *** in over daysDoesn’t return phone calls or
emailsI have tried to contact her supervisor; I am told to call backNo
contact with anyone from Rushmore in over weeks- The Single Point of Contact (SPOC) was under the impression the you
wanted us to respond in writing prior to resuming phone contactWe have

I still stand firm that I have a mortgage loan contract that was written by *** Home Loans which is in effect until 2/01/ See copy of ***'s letter of 2/25/(copy herewith) If Rushmore Loan Management purchased my loan from ***, they are obliged to honor the terms of that binding contract

Rusmore Loan Management Services is by far the worst company I have worked withTheir customer service is rude and disrespectfulThe have continuously misplaced my escrow account causing my home owners insurance to not get paid forfeiting our contract and having to find other insurersThey did this again so I paid $owed to my insurance which we were still paying into every mortgage paymentIt took about a year to finally get the issue resolvedEver customer service person gave us a different story and different excuseOn top of that their online billing is just about the worst I have ever used their online account is constantly forcing me to reset my password then locking me out so I cant pay my billI try calling but they never answer then when I finally get through are nothing but rude and restate that they were here during the hours that I have called
As soon as I can I am refinancing just so I can get away from rushmoreI would recommend that anyone purchasing a home places a clause in their mortgage to not sell it to Rushomre
