We have met with the customer regarding these items. The subcontractor agreed to rework the carpet seam and the paint on the back door will get fixed. As for the flatwork finish, we are working towards a resolution.

The Company's response fails to address the oral agreement created between us (as evidenced by the course of conduct-ordering and storing the windows). I am disappointed that the Company is relying on some provisions buried deep in its multi page boilerplate contract. With such unequal bargaining power between the parties to the contract, as well as circumstantial evidence of a breach of the duty of good faith and fair dealing. I would have hoped that the Company would try to satisfy a new customer, especially since their employees seem willing to do so. In conclusion, I ask the management once more to honor the oral contract it created with me. It is a small matter for them, and I have already agreed to pay for the labor and materials. If the Company refuses, I will likely pursue legal recourse, either individually or as part of a class. Among the hundreds of complaints online relating to the companies that merged to form the new CalAtlantic, I have noticed several attempts at certifying a class and will ask my attorney to contact the various groups and see if there are patterns that can be discerned. I intend to first contact the [redacted] Law Group, LLC (the NV firm that recently certified a class to sue [redacted] homes over construction of defective homes in NV) to help me find others in Minnesota and across the country that have been similarly aggrieved with breaches of oral promises. I further intend to turn to social media to connect me with others similarly aggrieved so that, together, we may find suitable relief in Minnesota or warn others of our experiences. In legal discovery, I will request all other complaints made against [redacted] Homes, [redacted], and CalAtlantic so that the [redacted] Law Group and the local Minnesota Law firm(s) that help us may understand the scope of the problem, discern patterns and, work together to help persuade CalAtlantic to honor its promises.

The customer executed a financing agreement in which he chose to not lock his interest rate for his purchase from CalAtlantic Homes.  This agreement provided that “it is necessary for the [customer] to lock-in at least 20 days prior to settlement, so that CalAtlantic Mortgage Inc. and/or your...

settlement agent has time to prepare documents for settlement” and that it was his responsibility "to contact the lender to obtain current interest rate and discount point information.”  The customer was given numerous opportunities to lock his interest rate and chose to not do so.       The customer has decided to not move forward with his contractual obligation because he is not happy with current interest rates.  This is a breach of his obligations under his agreement with CalAtlantic.  CalAtlantic fulfilled all of its obligations in building a home for the customer and intends to enforce the contract and keep the customer's earnest money deposit as damages resulting from the customer's breach of contract.  CalAtlantic considers this matter closed.

It has been over 8 weeks since our back yard was flooded, 8 weeks since we submitted a bid for our damages, 7 weeks since the plants and irrigation systems were removed (something we feel only occurred because of the insistence of HOA and CalAtlantic's necessity in turning over maintenance to HOA) and all this time, we have been receiving the same response:  "We will contact you with a response." Unfortunately, this is something that we believed every time we contacted their representatives. We waited 7 weeks to file a complaint with the Revdex.com because ultimately their promises of a response were never met. Again we waited an additional week hoping for restitution so that we could once again have our back yard back to its original condition. They have my contact information, and after a week, we have yet to hear from anyone at the company.We are not going to accept another generic response from a large company who fails to take homeowner complaints seriously. These deceptive practices do not sit well with us and, if I were a current buyer, I would question the standards of a company that promotes this type of behavior.

I bought a new construction home from Cal Atlantic (Standard Pacific at that time) in Cary, NC, and it closed on 09/29/2015. As a part of the 1 Year warranty, in the last quarter of 2016, I submit several complaints to be fixed as a part of the warranty. One of them is that a window in one of my bed room vibrates when the A/C (both for cooling & heating) unit is running. So it happened the furnace sit on top of that bedroom (in the attic). The vibration is more significant and almost occurs whenever the unit is on during winter months (because the windows & house frames shrink due to cold weather, hence more prone to vibration). However even during summer it also happened now and then. The vibration cause the the muntin on the top pane to rattle against the glass and generate a rattling noise. The noise can be annoying during the night and once a while can be loud enough. On top of that, over the years, we are afraid the vibration cause a premature leak on the gas inside the e-low double pane glass. We've tried to work this out with Cal Atlantic and it drags on until summer 2017, including me taking videos of the rattling windows. They called the windows company to inspect it and stated that it must be addressed at the source of vibration. Cal Atlantic made 1 attempt to address it, by putting some foam underneath the furnaces, but it didn't help at all. At the end, on July 6, 2017, Travis Warburtan (Cal Atlantic General Manager of Customer Relations) wrote an email stating they will not do anything about it as it's not something warrantable. They should have design a house that it's structure shall able to absorb vibration to avoid this situation. Or at least install the A/C furnace unit with proper material to absorb the vibration. A frequent vibration on windows, not only it generate irritating noise, it also potentially reduce the life of my e-low glass if the gas inside it leaked prematurely due to broken seal over this frequent vibration.Cal Atlantic as the builder is liable to deliver the house that doesn't vibrate whenever the A/C is on. Since the vibration generates a irritating noise and potentially cut short the life of the e-low glass on the window, they MUST perform an adequate repair. Not sure exactly what repair it is, but I don't really care, as long as it stop the vibration. Most likely it involves putting some kind of proper padding underneath both furnace units in the attic to absorb the vibration adequately.

Customer and his co-buyer defaulted under their agreement of sale with CalAtlantic by failing to comply with the financing terms of the agreement.  According to the agreement of sale, CalAtlantic is entitled to keep the customer's earnest money deposit as a result.  Thus, the customer...

does not have any right to a refund of the deposit.    CalAtlantic considers this matter closed.

CalAtlantic Homes has been in contact with this customer and is working towards a resolution.

This matter is under consideration and we will respond accordingly to work towards resolution.

In regards to complaint ID #[redacted] Homes’ response is as follows:Ms. [redacted] raised the issue of the tile dye lot prior to her purchasing the home.  [redacted] had the tile supplier representative inspect the tile.  It was determined that the tile was the correct tile ordered by Ms....

[redacted] and that the variation in color between the tiles met industry standards.  [redacted] communicated to Ms. [redacted], prior to her purchase of the home, that the tile would not be replaced.  Ms. [redacted] elected to continue with her purchase.The home Ms. [redacted] purchased is modeled in the community where she purchased.  The placement of the electrical outlets in Ms. [redacted]'s home meet industry and building code standards.  Ms. [redacted] made several requests through the [redacted] warranty process to have the electrical outlets moved.  Since the electrical outlets meet industry and building codes, this warranty request was denied. [redacted] Homes considers this matter resolved.

CalAtlantic has been in contact with the customer on several occasions. The electrical issue has been fixed as have several other items. In addition, the window company is working with the customer to schedule an inspection of the upstairs window. After the window is fixed, we will schedule the sheetrock repair and have a painter finish the painting and caulking, both inside and out.

Regarding the wood flooring, in July 2015, CalAtlantic and two representatives of the wood floor company met with the customer at his home to discuss his wood floor complaint. The homeowner and the wood floor company agreed that the wood floor company would make specific repairs that the customer would like and that would be the final acceptable finish. The customer recently called the wood floor company to come out and refinish the floors again, but the wood floor company declined.

CalAtlantic Homes has been working diligently with the customer to address his concerns. The customer has now allowed CalAtlantic or its subcontractors to make agreed upon repairs. There are four outstanding warranty repairs that are currently in process and are scheduled to complete this month....

On the drainage issue, CalAtlantic met with the developer and engineer of record to determine the best solution to remedy the erosion problem. We then met with the homeowner and explained in detail how the backyard lower section erosion problems would be remedied and he agreed and gave consent to do the work. The work was completed as agreed. We consider this matter closed.

We have been in contact with this homeowner regarding his concern. The street is a public street turned over to the City but it is still under warranty by CalAtlantic. The curb repair is planned to be done this fall. We have no set date as the contractor will do it when his curb crew frees up in the...
