I attempted to purchase tickets from Ticket GalaxyThey were good seats, and I paid accordinglyThey called me a couple hours later and said they didn't actually even have the tickets they had sold me, but instead would give me much worse seats for a minor discountI said, "no, I'm not interested in that." As of July 20th, the tickets have been delivered and accepted by the customer, through delivery of *** ***. Because the customer accepted the alternates at a discount, we are unable to further discount the tickets at this point.There is no refund due

in particular Mr*** requested tickets seating him in the Balcony of the venue The tickets we will provide Mr*** will seat him in the Balcony as his order indicates.Mr*** agreed to the terms and conditions governing his order before completing that order, including the clause that indicates that "All sales are final."It is unfortunate that the tickets Mr*** will receive are not in his preferred balcony section, but the tickets do conform to Mr***'s order.Furthermore, we guarantee that the tickets Mr*** receives will be valid for entry, and not, as he puts it "bad tick".We sincerely hope that Mr*** enjoys the *** *** concert.Thanks,DanTicket Galaxy

contacted our sales department via email on May 20, (yesterday)The email
was sent with a time stamp of 3:06pm EST, and a customer service representative
responded to him at 3:46pm EST on the same dayWe're unsure why *** ***
would claim that the email was undeliverable as it was received on our end and
it was also responded to in a timely fashionAdditionally, a customer service
representative also called *** *** later that night and spoke to him about
his concerns
*** *** also purchased tickets to a concert that were
advertised as:
Section: Lawn, Row: GA
GA commonly stands for General Admission and this is also
clearly labeled on the accompanying venue map on the website that *** ***
placed his order onIn his email dated May 20, *** *** stated that he is
disabled and cannot stand for the entire concert and is looking for assistance
The customer service representative did call *** *** and offered to help
him find other tickets, however there would be an increase of price for actual
seats versus general admission ticketsAlso during this conversation, *** *** agreed to rescind his chargeback that he filed and was willing to work
with our customer service department for a solution
We are also attaching a copy of *** *** order receipt
which indicates that he did willingly purchase General Admission ticketsAlso
included is a screenshot of our customer service records and a screenshot of the
venue map from the website
Additionally, *** *** was required to read and agree to
the website's terms and policies before completing his purchaseThe website’s

All prices are in United States Dollars (USD) unless otherwise

an item's correct price is higher than the stated price, the FULFILLER will

I am rejecting this response because: This is scalping behind a veil of advertisement. I understood they were a resale. They charged an additional fee of $service fee. I feel this represented the increase cost in the tickets NOT an increase ticket price PLUS an additional service fee of $I read the website and believed the increase in the tickets was the SERVICE FEE not an additional service + increase in the ticket price by 62% I called and emailed after receiving my tickets and the price printed on the ticket was $NOT the $price per ticket represented on their invoice AND website. When I asked what the service fee of $was for and I was told it was a website fee to protect my credit card. I purchase items on the internet ALL THE TIME and have NEVER been charged a service fee for use of a website????? I feel they misrepresented their product, and after researching ALL THE COMPLAINTS I have found from other consumers I am not the only one, because they advertise $tickets (which on the ticket sent to me states $79) and I did NOT receive $tickets. Yes, their website states they sell at a higher cost but I believed that is what I was paying the $service fee for. It is advertisement to have that high of a service fee PLUS increasing the ticket price by 62%. They said the tickets to *** are highly sought after, I can go on line and purchase ANY level I want at the face value. I was under the impression I was purchasing them at face value WITH an additional service fee for the pre-sale This is scalping at its WORSE. If I wait outside an event the a scalper sells me a ticket, I can see what the face value is on the ticket and I can CHOOSE to pay the increase price. I am an intelligent adult and am capable of making that callHowever, I CHOSE to purchase the PRE-SALE tickets AND pay the service fee of $77.48, with the understanding the tickets value was $127. I received tickets with a value of $79. I WANT either tickets with a value of $per ticket or I want my money refunded in fullI will not be satisfied until I have one of the two options

I am not denying the purchase of ticketsI am not in disagreement with the terms of the contract at time of purchaseWhat is in contention in this case is that FULLFILLER, by way of Ticket Galaxy and its associates purposefully utilized deceptive marketing that misrepresented the goods in question and lured me into the transactionTherefore, making such a transaction a fraudulent one under the Federal Trade Commission and nullifying the original contract which was agreed upon under an illicit misrepresentationOnly in retrospect, days later, was further information obtained that corroborated of an ill-willed scheme to pray on customer’s naiveness on this specific circumstanceI am not conveying “buyer’s remorse” but in fact I am a victim of online-fraudulent activityThat is why I do not agree with the business transactionI attempted to mitigate this dispute independently and directly with Ticket Galaxy customer service without successFurthermore, their representative was uninterested in providing further guidance on how to dispute claim through an alternative methodI believe I did my due diligence prior to the purchase and I was not deterred at any point from that perception, to the aforementioned parties’ financial gain, that I was obtaining them directly from the event box-office retailerFurthermore, the company sold tickets that they did not have in possession at the moment of actual purchaseSpecific seating associated with tickets was deliberate obfuscatedThus, making the sale “deceptive” under the Federal Trade Commission i.eTicket Galaxy facilitated the actual proprietor’s (FULLFILLER) misrepresentation of the goodsWhen the merchandise (i.e concert tickets) were later available to public (and FULLFILLER) and subsequently to the brokerage companies (Ticket Galaxy, ticketnetwork.com) THEN they were delivered electronically at a significant mark up to actual retail priceAlso, accordingly, charging an exorbitant fee for such services Their own documentation proves this if you take a look at the time my purchase (4/11/2015) time and notification of actual electronic delivery (4/16/2015)Their website is misleading to the general publicWhen I originally navigated their website it is purposefully constructed to persuade the general public that vendor is the actual box office retailer for the eventIt only is apparent in retrospect--Illicit scheme i.ebusiness model:

Ms*** received her ticket shipment on August 21st, On September 6th, 2014, Ms*** contacted our Customer Service Department where she left a voicemail at 10:30AM EST requesting a call backOur records indicate that one of our representatives returned her call at 10:31AM ESTThe representative left a voicemail advising Ms*** to contact the Customer Service department between 9AM-6PM ESTMs*** has not since returned the call.
Ms*** was educated to the fact that tickets are in many cases sold above face value and that *** is neither a primary sale box office nor the venueMs***’s freely-chosen acceptance of the price and the terms and conditions indicates that she did make a conscious and educated decision to purchase tickets at the price she agreed to

did we attempt to pressure our customers into paying more for the ticketsWe
absolutely understand the difference between $and $for tickets is quite a
jumpAs such, anyone who didn’t want to pay the extra amount was refunded in
full, and the order cancelled
Additionally, when *** *** placed her order, she had to
select that she has read and agreed to the terms and policies on our website
The specific language in our terms and policies is as follows:
Pricing All prices are in United States Dollars (USD) unless otherwise
specifically statedSITE cannot confirm the price of an item until after an
order is completed by USERDespite SITE'S best efforts, a small number of the
items listed on the SITE may be priced incorrectlyIf SITE discovers an item's
correct price is higher than the stated price, SITE will either complete the
