Holding payments in the event of a claim is part of the signed Broker/Carrier Agreement. Section CARGO LIABILITY AND CLAIMS, letter (e) the last sentence is "BROKER reserves the right to offset any claim(s) with CARRIER's pending invoices."

When I spoke to the carrier, I let them know that TQL’s stance was that we were unaware that the shipper was using their chassis. I also told them that we could pay for the repairs in order to get the chassis back in their possession. Then, they could pursue the shipper for damages. If the carrier is looking to file a suit against TQL, their counsel should get in contact with our Legal Department

I spoke to the TQL broker just now. He reported that he had a carrier booked to pick the chassis up on 12/23, but that the carrier cancelled the load. He is now trying to find a new carrier to pick the chassis up

Our driver was not allowed in loading zone.So he didn't see how they load the entire product.When they load all pallets ,they called my driver to place seal.My driver was only able to see the back of the trailer.How can he judge from just looking only the tail part of the trailer.His duty is to see if anything damaged in the product .Nothing is damaged .The load was shifted because it was not loaded on trailer properly and our driver was not allowed to see the whole process of loading.TQL have to charge dollars from shipper,not from us.In their response they admit that load is not loaded properly and they blame my driver that he didn't inform this before.But my response is that when the driver entry is restricted in loading zone and he didn't see all loading process,then how can he judge just looking at the back of trailer.He is not any loading expert and loading is not part of our job.So we are not responsible for their shipper fault.It cost us also one business day

Hello,
Per the email that was sent to us by your company, "their loading guy locked two straps in front of my driver and then my driver put on the seal in front of them." From this email, we concluded that the driver did indeed see the loaded product before he put the seal onIf there were issues with how the shipper loaded it, the driver should have notified us at that time

*** *** Thursday I called again finally after speaking with different reps I got to matthew *** the rep who was handling this claim I was informed bye him the insurance denied this claim cause they found no coverage for the load Matt told me only option is to pursue the trucking company cause tql is not liable for the damages well if the trucking company didn't have insurance to cover the load tql should not have let them take the load apparently tql brokers don't know what to look for in the insurance policy or don't care I will be calling a manager and ask them whats going on or else our attorney will be contacting them DO NOT USE TQL
