I apologize for the trouble you received on *** *** ***, and have looked into the issue
The reason why TQL deducted money was because the driver was able to see how the shipper loaded the product, and yet did not call the load owning broker with any issuesThis is proven by an
email that was sent to usThe shipper allowed the driver to come to the back of the truck, view the loaded product, and then had the driver place the seal
If the driver would have notified TQL of the way the shipper loaded the product, then this case would have been different

While we understand where you are coming from, we are sticking to our original conclusion that the load should have been weighed after loading
Per Section 22, Item Number of the Broker/Carrier Agreement, "Failure to report any overage, shortage, or damage at loading or delivery may result in damages assessed against carrier", TQL nor the customer can take responsibility of what transpired

Hello All, [redacted] was contracted to do a load from Martinsville, VA loading on 3/17/2015 with a 1500 appointment and set to deliver in Jacksonville, FL with a 0730 appointment.  The load was booked with carrier with both the pick-up and delivery appointments set and sold in the...

booking call to the carrier.   The load was contracted to pick up and deliver within DOT standards and [redacted] did not do so.  The customer deducted $514 from the rate of the load, per the carrier contact agreement we have with [redacted] we can pass these along to the carrier.  This can be found in section  22 subsection h, "Any cost incurred by BROKER due to CARRIER being late for pick-up or delivery appointments may be chargers to CARRIER."  I have attached [redacted] contact for reference.  (labeled: [redacted] Carrier Packet)Per the request of the carrier, please see attachment from our customer detailing the deduction.  (labeled: [redacted] customer deduction)We have been in contact with the carrier in regards to the deductions, we last responded to them with our findings on 4/30/2015.  Please see email for reference (labeled: [redacted]- email contact)If  [redacted] would like to discuss this further please feel free to reach out to us at ###-###-#### EXT [redacted] or by email at [redacted]. Thank you,[redacted]TQL Carrier Relations

Hello [redacted],   It is always unfortunate when the transportation of freight does not occur as contemplated and without incident.  Nevertheless, despite diligent efforts to ensure timely and proper delivery of cargo, this does, in fact occur. ...

And further, when it does occur, each situation presents a unique set of facts and corresponding responsibility which is borne by the shipper, carrier, customer or a combination of these parties.  We understand that [redacted] is withholding payment due to a perceived loss suffered due to late delivery on the loads in question.  As we have explained to [redacted] numerous times over the past year and a half that we have been in discussion over this matter, there has been no documentation of the losses they claim to have suffered.  There have been no formal claims filed to date, and we do have a clause in our terms and conditions that states that claims must be filed within 9 months of delivery date.  We have also offered to come to a reasonable settlement agreement of $500 per late delivery occurrence,  in acknowledgement of the late delivery, but this has been refused.  As the loads did make delivery, we continue to pursue our invoices in full and hope we can reach a final resolution with [redacted] in the near future. Let me know if you have any questions.  Contact info:Amanda ###-###-#### EXT [redacted] Thank you Amanda R.TQLCarrier Relations
