I apologize for the way you were treated at our facility, I do show that Alex send this complaint to the appropriate departments to address our staff. We can pull the membership for Swift, however I do show you did use the facility for April, May, June, July, and September

I am rejecting this response because:That is not correct I did go in on Monday 8/7/and I talked in person to the same salesperson I asked to please cancel and he told me I was too late even though he told me I could come in on that day 8/7/17 to cancel If I wanted he also told me I can come in and cancel if I didn't want to continue with the membership and he will refund me, but he just lied to me, no refund and now I am stuck with a membership that I cant get rid of, I was never shown any contracts and I never signed or put my initials on anything

The contract was purchased on 4/23/and the complaint states intent to purchase. The contractual agreement is attached to show initials and signatures of the sale to Emily M***. An email address was supplied and the consumer would receive a copy of the contract via email and hard
copyThe regulations are clear on cancellation policy.The member may transfer to another consumer, but all payments must be current to do so.There is a transfer fee but this will be waived if member finds a someone to transfer.There is a note in your complaint about HIPAA release offered and accepted 6/21/We have no such request or anything filedWe do not have a medical clause.Refer to the regulation portion of the contract.There is no violation and the contract will stay in place

When we looked into this, the trainer sent us images of text messages showing him trying to get ahold of you with no luckI do show you contacted our member service team in March to cancel but this concern was not brought upThe same process I have done and responded back with is the same process we would have done if this was brought to our attention in MarchIf you are not wanting to utilize the services you do have the option to transfer the agreement to someone elseWe will waive the $transfer fee

I am rejecting this response because:Right - because I selected the option which is 2x as much per month ($19.99) to get the $fee waivedThe $plan I wanted (and verified via phone when Shaq lied to me) has a $fee associated with it per your Assistant Manager at the West Jordan location. I get the feeling you are not trying to solve my issue, rather you are replying with vague info and questions to dodge the advertising and lies I was toldAm I incorrect?When I called and asked about fees, I was specifically told there were NONE outside of the $per monthThen you sprung the cancellation, sign up, and facility feesLiesLiesLies.

We are okay with you payment the past due of $for the monthly dues, for the child care and the $cancellation feeOnce this is don't the membership will cancel. Thanks

***, The membership you had with VASA was a month to month membership and the terms for cancellation on this account is a days notice in writing and a $cancellation fee if canceled with in the first monthsOur records do not reflect we had received a cancellation request
for your accountOur records show that our billing company attempted to contact you in May of to go over the past due, they asked for you to send your cancellation request to our support email for reviewWe never received that documentation showing the account should have been previously canceled, because of this the account remained active until September of this when it was sent to the collection AgencyDuring this time Paramount Acceptance the billing company still attempted to reach you to resolve the past due balanceAt this point if you can provide the documentation for cancellation we would be happy to review itWithout any proof of cancellation you will need to resolve the balance with the collection agency Aldous & AssociatesPlease let me know if you have any questions
