you provided to the Revdex.com. First, let me thank you for
your prompt response
If you will scroll down, you will see the email
correspondence I have had with *** in your customer service group. As
you will see, the arrangement as per *** is that I would receive a refund
prospectively, not retrospectively. Accordingly on August 6, I forwarded
*** my *** bill for July, and requested a refund of $88.32. (I
attach another copy of that bill for your reference). Having heard
nothing from ***, on August 13, I sent *** a follemail. Having
still heard nothing from ***, on August 21, I called the customer service
number and asked to speak with ***. I was told that he was unavailable
and that he would call me back. When I did not receive a call back by
mid-day on August 22, I contacted the Revdex.com
In any event, I hope that you will be able to
assure that this issue is resolved both for July and for August (when my bill
becomes available). As indicated in my August email to ***, I have
calculated the refund for July at $

A customer can always terminate at no cost (if on a variable contract) or for a small fee (if on a fixed rate contract) if they are not satisfied with the pricing of the product In no way is a consumer ever in a situation that they cannot avoid rising rates. If customer is looking for price certainty and a competitive rate with the current utility rate, Viridian offers a three-year fixed rate contract We would happily apply a $credit to such product customer so desires to select such a product. *** ** ***Re: Sarah Lochrie, Case # ***Dear *** ***On January 16, 2015, *** *** (“Customer”) filed with the Revdex.com that Viridian Energy responded to on January 24, On February 4, Customer filed a rebuttal that Viridian responded to on February 13, On February 20, 2015, Customer filed a rebuttal that states: 1) Viridian has not shown that Customer’s Renewal Letter was mailed; 2) Although Customer’s Renewal Letter is dated February 25, 2014, there is no creative stamp, so Viridian could have fabricated this letter after the fact; 3) Viridian’s sends letters by *** *** without tracking technology and as a result, Customer cannot have proof of its transit; and 4) Customer was not aware that she was on a Variable Rate because she is on budget billing.Customer’s rebuttal states that Viridian has not shown that Customer’s Renewal Letter was mailed Viridian Energy mails Customer Renewal Letters in batches When a Renewal Letter is printed and mailed, Viridian receives a PDF copy for its records This PDF copy was provided to Customer in Attachment Viridian can confirm that Customer’s Renewal Letter was mailed, but it cannot confirm that Customer opened the Renewal Letter and read the contents However, Viridian can also show that customers that were sent Renewal Letters in the same batch as Customer’s Renewal Letter received their Renewal Letters and affirmatively responded to renew their Fixed Rates. With regard to savings, the Customer opted to enroll in Viridian Energy’s
variable rate plan as selected in their agreement. On a variable rate plan, the rates can
fluctuate from month to month based on energy market conditions and the savings
should be measured over the course of months; and not on a monthly
basis. It is important to note that we
are experiencing a historically cold winter this year and cold winters mean
your electricity usage may be higher than normal. Additional usage also puts a strain on supply
which causes prices to rise.
Viridian Energy is committed to Customer service and satisfaction and
we regret that the Customer was displeased with their service We hope this response meaningfully addresses
this matter to the customer’s satisfaction

and that Viridian Energy received on February 10, Customer’s complaint states that: 1) Customer was told by Viridian that he would be renewing his Fixed Rate in February 2015; 2) Customer never received a Renewal Letter but recently learned that his contract had previously been auto-renewed; 3) Customer did not authorize the auto-renewal and believes that it is illegal to be auto-renewed without his express permission; and 4) Customer would like to cancel without paying the $early termination fee. compliant, MrDeo states that upon his fixed rate period expiring, his utility
bills have been higher than usual Customer
also claims that the same error has occurred with his Gas account. The customer claims that he has tried to
contact Viridian for days and was placed on hold for over an hour He also states that his emails have gone
unanswered Finally, He is upset and
claims that a promise for a $credit was not honored wants to cancel his
service with Viridian Energy, return to standard service with the Utility and
be reimbursed $
To start, Mr
Deo’s account residential electricity was enrolled in Viridian Energy’s month fixed rate plan on or around July 31, with an expiration date of
March 14, 2013. The account was
enrolled using the online method, which was authorized with an e-signature of “Mike
Deo.” His account was referred to
Viridian Energy by an Independent Contractor named *** ***d (Associate
ID ***. On June 19, 2013, Mr
Deo enrolled in another month fixed rate plan with a contract expiration date
of January 18, at which time he was advised of the rate term, expiration
date and cancellation fee. This account
is no longer being serviced by Viridian and has returned to standard service
effective March 13, 2014.
Mr
Deo’s account residential gas was enrolled in Viridian Energy’s variable rate plan on or around August 7, 2012. This account was billed month to month
without a term end date and could have been cancelled at any time without
penalty. In November of 2013, it was enrolled in a month fixed rate plan @
per therm and expires on January 4, 2015.
The account
was also enrolled using the online method, which was authorized with an
e-signature of “Michael Deo.” His
account was referred to Viridian Energy by an Independent Contractor named Alan
Kurtz (Associate ID 14754). Viridian
Energy utilizes a network marketing approach to energy sales which means that
each one of our Independent Associates is required to have a relationship with
each of their referrals
Pursuant to Viridian Energy’s Terms and Conditions, (EXHIBIT A) at least thirty
(30) days prior to the end of the fixed price Initial Term or any Renewal Term
with respect to Gas Service or Electric Service, you will receive written
notification from Viridian informing you of the date upon which your Agreement
with Viridian with respect to such Service will end and explaining your
options. Unlike the fixed contract
terms, a variable rate plan does not promise such notification when the rate
changes, as that is the very nature of a variable rate. While Viridian
Energy aims to provide rates that are competitive with the local utility and
other electricity suppliers, prices may be higher or lower than the EDC's rate
in any given month Our records show
that MrDeo failed to respond to either renewal notice on his electric
service
In regards
to contact with Viridian, while we have been experiencing unusually high call
volumes and wait times, customers do have the option of leaving a voicemail
message on our customer care line. A
customer care agent will return phone calls within hours. Nonetheless, we would like to apologize for
the Customer’s difficulty in reaching us On February 19, 2014, customer emailed [email protected] but did not receive a response until March 1, 2014. The representative apologized for the delay
and his inability to reach a representative by phone. He was advised that his electricity service
had been cancelled and his gas service had a contract expiration date of
January 4, 2015. In regards to
a promised reimbursement for $in point 4, a review the customer’s call log
do not indicate anything similar to such an offer. If we failed to honor a promise, we do
apologize, however, the customer re-enrolled without mentioning an oversight
Viridian is
committed to customer service and satisfaction and regrets that the customer
was dissatisfied with their experience Both
his Gas and Electric services were billed as contracted, per the terms and
conditions. The Customer dropped his
electric account and his gas account in locked into a fixed rate until January
of 2015. The customer was inconvenienced
by being in the call center queue for an unreasonable length of time and a response
to his email query was untimely. For these
issues, we do apologize. We hope this
response resolves the matter to the customer’s satisfaction

Customer’s complaint states that she does not want to receive service from Viridian Energy and she does not want to receive an early termination fee On August 19, Viridian submitted a cancelation for both Customer’s natural gas and electricity accounts Customer has not started service with Viridian Energy, and as a result, Customer should not received service from Viridian Energy Customer will not be assessed an early termination fee
Viridian Energy treats unauthorized enrollment as a zero-tolerance offense, and if shown, the Associate responsible will be terminated Viridian Energy will further investigate Customer’s claims regarding unauthorized enrollment by contacting the referring Viridian Associate

and that Viridian Energy received on February 7, Customer’s complaint states that: 1) Customer enrolled with Viridian Energy to save money on his electricity and natural gas supply; 2) When Customer’s Fixed Rate ended, his rate was higher than the utility’s rate; and 3) Customer would like to receive a refund.Customer’s complaint states that Customer enrolled with Viridian Energy to save money on his electricity and natural gas supply and that when Customer’s Fixed Rate ended, his rate was higher than the utility’s rate • First, although Viridian strives to offer customers affordable green energy, it does not guarantee savings as compared to another electricity or natural gas product The prices of the utility’s standard offer service, as well as the prices of competitors are constantly fluctuating In any given month, Viridian’s rates may be higher or lower than the rates offered by another company While Viridian may be able to document savings to the utility’s standard offer at a particular snapshot in time, it cannot offer a general guarantee of savings It is also important to note that Viridian offers premium renewable energy products For example, Viridian’s Everyday Green electricity product provides customers with 50% more renewable energy than state minimum standards, and Viridian Energy’s Simply Right natural gas product includes 25% carbon offsets As a result, a direct comparison to the utility’s price cannot be made. • Second, Customer chose to enroll in a Variable Rate, not a Fixed Rate as his complaint states Variable Rates may fluctuate from month- to-month based on market conditions and company operating factors, and are best for consumers seeking the flexibility to cancel at any time and the ability to take advantage of short-term price fluctuationsFixed Rates remain set for the agreed-upon term and are best for consumers seeking price-certaintyViridian encourages customers seeking price-certainty and protection from market volatility to select a Fixed Rate product.Next, Customer’s complaint states that he would like to receive a refund Customer has been appropriately charged for the Variable Rate plan that he selected, and therefore is not due a refundHowever, as a resolution for customer dissatisfaction, Viridian Energy can offer the Customer a one-time courtesy credit of $in conjunction with enrolling both his accounts in Fixed Rates with Viridian Energy.I sincerely hope this meaningfully responses to the above complaints If you have any questions, please do not hesitate to contact me at *** *** or by email at ***Warmest regards,*** ***Counsel

filed with the Revdex.com on March 14, regarding Viridian Energy In the complaint, Customer states that a Viridian Energy dodoor representative misrepresented herself as an *** representative and he enrolled with Viridian Energy under pretenses Customer also states that he was assured a lower rate of $0.129/kWh and was assured that he would remain with *** as his electric delivery company Lastly, Customer would like to be refunded $in billing charges as well as a waiver of a $early-termination fee (“ETF”) for cancelling his account Upon receipt of this complaint, the sales agent linked to the enrollment was identified and her account has been de-activated pending a full investigation into the concerns expressed by Customer in the complaint If substantiated, the sales agent will not be reactivated and will cease to be associated with Viridian Energy Viridian Energy takes this matter seriously and continually strives to improve the training and selection of our external marketing vendors to ensure compliance with all rules and regulations Viridian Energy’s records indicate that Customer enrolled with Viridian Energy on March 7, Customer authorized the enrollment by completing a Third-Party Verification (“TPV”) One of the prompts on the TPV states: “That the purpose of the call is to verify that you would like to enroll with Viridian Energy as electric supplier,” and Customer confirms with a clear “Yes” Customer is correct in stating that he was assured a rate of $0.129/kWh because, Customer enr olled in Viridian Energy’s month fixed rate plan at the rate of $0.129/kWh Customer is also correct in stating that *** would remain his electric delivery companyThe TPV states that Customer will receive one bill from the utility (***), of which Viridian Energy will be the supply charge and the utility will be the delivery charge Finally, Customer complaint states that he requests a refund of $of billing charges and waiver of the $ETF Customer has not been billed by Viridian Energy, and therefore $ is not a Viridian Energy charge If Customer terminates prior to the end of a fixed term, they are subject to an ETF On April 13, 2015, Viridian Energy received a cancellation request from Customer and the utility confirmed a service end date of May 5, Customer did not fulfill his contract therefore he is subject to $early termination fee.Viridian Energy is committed to compliance and customer satisfaction If you have any questions, please do not hesitate to contact me by email at *** Kind regards, *** ***Compliance Specialists
