with the Revdex.com on October 23, The Customer’s complaint states that: 1) Customer contacted Viridian in October to inquire about his gas rate and at that time, Customer was told that Viridian Energy did not currently offer Fixed Rates for natural gas but that Customer’s rate would be comparable to ***’s rate and that Customer’s natural gas distribution rate increased to $which was not comparable to ***; 2) Customer had received a notification regarding an increase to his gas distribution rate around October 2013, and Customer was informed that he would be notified before an increase in his natural gas rate, but was not notified; 3) Customer believes that Viridian should be required to send correspondence every time that a Variable Rate increases; and 4) Customer would like to receive a credit for the difference between his Variable Rate and ***’s rate
First, Customer’s complaint states that Customer contacted Viridian in October to inquire about his gas rate and at that time, Customer was told that Viridian Energy did not currently offer Fixed Rates for natural gas but that Customer’s rate would be comparable to ***’s rate Every time that a customer contacts Viridian Energy’s Customer Care call center, the representative will notate the Customer’s account Viridian Energy’s records indicate that Customer contacted Viridian Energy in October regarding his electricity account, not his natural gas account
There is no indication that Viridian Energy’s representative ever indicated that Viridian Energy’s rate would be comparable to ***’s rate Viridian Energy strives to offer customers affordable green energy, but does not guarantee that its rate will be comparable to another electricity productThe prices of the utility’s standard offer service, as well as the prices of competitors are constantly fluctuating In any given month, Viridian Energy’s rates may be higher or lower than the rates offered by another company While Viridian Energy may be able to document savings or a comparable rate to the utility’s standard offer at a particular snapshot in time, it cannot offer a general guarantee of savings It is also important to note that Viridian Energy offers premium renewable energy products For example, Viridian Energy’s Simply Right natural gas product provides customers with 25% carbon offsets As a result, a direct comparison between Viridian Energy’s natural gas product and the natural gas product offered by Customer’s utility cannot be made
Next, Customer’s complaint states that Customer had received a notification regarding an increase to his gas distribution rate around October 2013, and Customer was informed that he would be notified before an increase in his natural gas rate, but was not notified First it appears that there may some confusion with Customer’s terminology Distribution refers to the charges that Customer’s utility charges for delivery, service and maintenance As a third-party supplier, Viridian Energy provides the supply portion of Customer’s bill Therefore, Viridian Energy would not send a notification regarding an increase in distribution rates If a customer is enrolled in a Fixed Rate, Viridian Energy does send a renewal notification informing the customer that his/her Fixed Rate is coming to an end However, Customer would not have received this notice for his natural gas account, because Customer was enrolled in a Variable Rate for his natural gas Viridian Energy does not send renewal notices when a customer is on a Variable Rate Viridian Energy’s Representative would not have stated the Customer would have received a renewal notice for his Variable Rate natural gas account, however, it is very probable that the Representative stated that Customer would receive a renewal notification for his Fixed Rate electricity account
Next, Customer’s complaint states that Customer believes that Viridian should be required to send correspondence every time that a Variable Rate increases Viridian Energy does not send notifications whenever a Variable Rate fluctuates because variation from month-to-month is inherent in the definition of a variable rate.
Customer chose to enroll in Viridian Energy’s Variable Rate plan Viridian offers both Variable Rate and Fixed Rate plans Variable Rates may fluctuate from month-to-month based on market conditions and company operating factors, and are best for consumers seeking the flexibility to cancel at any time and the ability to take advantage of short-term price fluctuations Fixed Rates remain set for the agreed-upon term and are best for consumers seeking price-certainty Viridian encourages customers seeking price-certainty and protection from market volatility to select a Fixed Rate product
Finally, Customer would like to receive a credit for the difference between his Variable Rate and ***’s rate Although, Customer has been appropriately charged for the Variable Rate that he selected As a resolution for customer dissatisfaction, Viridian can offer the Customer a one-time courtesy credit of $in conjunction with enrolling his electricity and natural gas accounts in a Fixed Rate This credit is offered for customer satisfaction purposes and is not meant to compensate customers for selecting a Variable Rate plan

22, and that Viridian received on November 24, Viridian Energy provides green energy choices for consumers at competitive rates Viridian provides each customer with a contract that clearly provides all terms and conditions, including pricing and the term of the contract In all contracts, Viridian clearly states that there are no guaranteed savings unless consumer receives that guarantee in writing If complainant can produce such guaranteed savings in writing, we would be happy to review such document Viridian had no such savings plan at such time. A customer can always terminate at no cost (if on a variable contract) or for a small fee (if on a fixed rate contract) if they are not satisfied with the pricing of the product In no way is a consumer ever in a situation that they cannot avoid rising rates. If customer is looking for price certainty and a competitive rate with the current utility rate, Viridian offers a three-year fixed rate contract We would happily apply a $credit to such product customer so desires to select such a product. First, I contacted Viridian regarding BOTH my Electricity
and Gas accountThe Viridian representative allowed me the opportunity to sign
up for a fixed electricity rate but was informed there was no fixed rate available for GasTherefore, I was required to accept or
reject the variable rate offered at that timeIn October 2013, the variable
rate was approximately $0.54/Therm., which was comparable to ***’s rate
This rate was communicated to me by a correspondence sent from Viridian during
the month of September. I informed the
Viridian representative that I am concerned about the rate increasing and
was informed that I would receive a notification when the variable rate
increasedThe same notification that alerted me to the variable rate offered during
the month of October (I was informed that I would receive a notification
of a rate increase and NOT THAT I BELIEVED I should receive a notification)
Secondly, when I initially agreed to purchase my gas supply
from Viridian in June 2013, I was informed that my savings would be realized
over a 12-month periodFrom November through April 2014, I paid
approximately $1,more than ***However, from May through November
2014, I paid approximately $less than ***With the exorbitant rates
charged by Viridian during the heating season, it is IMPOSSIBLE to realize any savings during any 12th
month period(The only scenario that would allow any customer to realize any
savings would include shutting down their gas supply during the heating
season). I agreed to enroll with
Viridian Energy because of the savings over a 12-month period and NOT because
of the 25% carbon offset advertised by your company. The Viridian representative, who initially
enrolled me in June2013, NEVER mentioned there was a chance of paying such a
high rate for my gas distribution because of this “25% Carbon offset.” Additionally, I was informed by a Viridian
Representative in October that Viridian’s gas rate is comparable to the gas
rates offered by other utility companies)
Next, my recent complaint is not based on a representation that guaranteed
me savings on my energy bill(However, it is certainly a reasonable complaint
since I was promised a savings over a 12th month period)It is
based on the misrepresentation by Viridian that I would receive a notification when
my rate increasedThis would have allowed me the opportunity to accept or
reject the variable rateViridian did not allow me the opportunity to accept
their unreasonable rates during November through April For example,
during November through April 2014, Viridian's gas rates were sometimes
double or triple ***'s rate during the same
periodThis occurred without receiving any notification from Viridian
and occurred when demand was the highest
I understand the meaning of a variable rateHowever, Viridian's representation
led me to believe that I would receive a notification informing me of an
increaseThe correspondence that I received in September and the misrepresentation
by Viridian directly caused me to remain a Viridian customer for my gas supply.(I
apologize for erroneously using the word Distribution to refer to supply).
I never would have accepted the variable gas rate if I was informed that I would not receive a
notification of a rate increase or there was a possibility that my rate would
double or triple compared to the rates of other utility companies
Finally, Viridian Energy has utilized deceptive practices to
enroll me in June AND to persuade me to remain a customerThese deceptive
practices are a direct result of my loss, i.e., overpaying for the gas supply. There is a strong argument that these deceptive
practices are criminal in natureMy current research has indicated that my
complaint is shared with numerous Viridian customers who were also defrauded We will reserve this discussion for any future
correspondences
Therefore, I reject Viridian’s offer and would remain a
customer only if I received a credit of $and a year fixed rateThis rate
must be comparable to the rates offered by other utility companies

In Feb a Viridian sales person came to our house and spoke to my bf about lowering our electric bill by signing up with their companyI was at work at the time and my bf thought they were legit so he gave them our elec co bill number and said he wanted to talk to me about it before we decidedHe was told that we would have days to decideWe looked on line and found that this company had numerous complaints and unhappy customers that were being ripped offI called the sales person that was here and stated that we did not want to change from our server that we presently had to ViridianI still didnt feel comfortable speaking with just him so I called the main number and asked to speak to someone with more clout that just a customer service person, at which time they told me all reps were in a meeting and it would be to hours before I got a call backMy bf called a man that worked for some marketing company that is associated with Viridian and also told him that we decided we were not interested in changing our serviceHe said he would take care of itWe just got our electric bill and it stated it was the last bill from them as our power provider and that we would from the next bill on be with ViridianI freaked out and we made some calls and my bf said that since the bill is in my name why dont we put it in his name and cancell the service that is in my nameI called the legit power co and asked if this could be done and they said yes so I cancelled my account and he got one for us in his nameViridian will be sending me a bill thru the other company for days and then can no longer charge us as there is no acct to chargeI have to say I also called Viridian the the other day before doing this and spoke to someone that I explained everything to and at the end said that I never spoke to nor saw anyone from Viridian and that because I never gave my permission for them to change things that I would hate to get a lawyer and take them to court but if I didnt get this taken care of and cancelled immidiately that I wouldI was promptly given a cancellation number and told it would take at least billing cycles and that they would wave the $cancellation fee which I told him I wasnt gonna pay it anywaySo now the waiting game for the final bill for days and see if they call me

I am rejecting this response because: While I did authorize the enrollment to Viridian via a Third-Party Verification, the phone-call was completed with the presence of the Viridian Sales representative, who strongly coerced my response Furthermore, you can verify the call record it should be noted that the voice of the third-party is hardly comprehensible in the call
As for the two requested refunds, I understand that the initial billing charges of $are not from Viridian Energy, but it is a direct cost to me caused by the transfer to Viridian Energy due to the misconduct of the sales-rep The same applies to the cost of $ETF Had I not signed up for Viridian Energy due to the sales-rep's misconduct, neither charges would have occurred Therefore I believe I am still entitled a refund

I called the current Electric provider (Ambit) and was told an order was put in for end of March to have my service disconnected from Ambit. I canceld that order and hope it is final from Ambit and ConEd. However, being that I have never requested this service and Ambit still had the disconnect scheduled, I'd like to have a confirmation from Veridian that they will not connect me

Finally, Customer’s complaint states that he would like a credit for the difference between what Viridian Energy charged and what Customer would have been charged with his utility Our records indicate that Customer has been appropriately charged for the product that he selectedViridian Energy understands that recent volatile energy markets have been a shock for consumers who were used to stable Variable Rates over the last few yearsAs a resolution for customer dissatisfaction, Viridian can offer the Customer a one-time courtesy credit of $in conjunction with enrolling in a Fixed Rate This credit is offered for customer satisfaction purposes and is not meant to compensate customers for selecting a Variable Rate plan
