Energy responded to on December 2, On December 10, 2014, Customer filed a rebuttal to Viridian Energy’s response This letter is in response to Customer’s December 10, rebuttal Customer’s rebuttal states: 1) Customer was unaware that Viridian Energy offered a Fixed Rate; 2) Customer did not receive anything in writing; 3) Viridian Energy’s rates are significantly higher than the rate that [redacted] is charging; 4) Viridian Energy does not send Variable Rate increase notifications; 5) The Viridian Energy advertisement for a 3-year Fixed Rate states a savings claim of $per year, but Customer has paid more than [redacted] with Viridian; 6) Customer believes that Viridian Energy was supposed to be saving her money; and 7) Customer does not find Viridian Energy’s offer of a $courtesy credit to be an acceptable resolution.First, Customer’s rebuttal states that Customer was unaware that Viridian Energy offered a Fixed Rate Customer enrolled with Viridian Energy online At the time of Customer’s enrollment the enrollment website listed all of Viridian Energy’s Fixed Rate and Variable Rate products Customer would have selected whether she wished to enroll under a Fixed Rate or Variable Rate Please see Attachment 1, which contains a screen shot of Viridian Energy’s enrollment process and indicates where Customer would have personally selected a product In addition to offering both Fixed Rate and Variable Rate plans, Viridian Energy also allows the consumer to choose his/her renewable energy content Furthermore, Customer would have confirmed that she understood her Variable Rate selection on the final page of her online enrollment Please see Attachment where Customer would have been required to affirm her understanding of the following statement in order to enroll: “I acknowledge and understand that Viridian Energy’s variable rate product will fluctuate based on energy market conditions The price I pay for energy may be higher or lower than the local utility in any given month There is no saving guarantee associated with Viridian Energy’s variable rate product.”Customer’s rebuttal states that Customer did not receive anything in writing This is incorrect Customer was provided with the Terms & Conditions during her online enrollment Both Attachment and Attachment indicate where Customer was able to view, print and save a copy of her Terms & Conditions In addition, immediately after enrollment, Viridian Energy sent Customer a Welcome Packet including a printed copy of her Terms & Conditions These Terms & Conditions fully explained Customer’s Variable Rate and also indicated that Viridian offered Fixed RatesCustomer’s rebuttal states that Viridian Energy’s rates are significantly higher than the rate that [redacted] is charging First, Viridian Energy strives to offer customers affordable green energy, but does not guarantee savings as compared to another electricity productThe prices of the utility’s standard offer service, as well as the prices of competitors are constantly fluctuating In any given month, Viridian Energy’s rates may be higher or lower than the rates offered by another company While Viridian Energy may be able to document savings to the utility’s standard offer at a particular snapshot in time, it cannot offer a general guarantee of savings It is also important to note that Viridian Energy offers premium renewable energy products as compared to the utility’s standard mix product For example, Viridian Energy’s [redacted] electricity product provides customers with 50% more renewable energy than state minimum standards As a result, a direct price comparison between Viridian Energy’s rate and the rate offered by the utility cannot be made Second, Customer agreed at the time of enrollment that she understood that Viridian’s rate “may be higher or lower than the local utility in any given month.” As noted above, please see Attachment where Customer affirmed her understanding of the following statement: “I acknowledge and understand that Viridian Energy’s variable rate product will fluctuate based on energy market conditions The price I pay for energy may be higher or lower than the local utility in any given month There is no saving guarantee associated with Viridian Energy’s variable rate product.” Finally, Viridian Energy’s rate is not significantly higher than the rate offered by [redacted] *** Customer’s Variable Rate during her last month of service was cents per kWh for a premium renewable energy product, during that same period [redacted] ***’s rate was cents per kWh for a standard mix product.Next, Customer’s rebuttal states that Viridian Energy does not send Variable Rate increase notifications This is correct Viridian Energy does not send notifications indicating a increase or decrease in a customer’s monthly Variable Rate, as fluctuations are inherent in the definition of a Variable Rate product Viridian Energy has neither the legal nor contractual duty to provide Variable Rate notifications The Terms & Conditions that Customer agreed to upon enrollment did not state that Customer would receive these notifications.Customer’s rebuttal states that the Viridian Energy advertisement for a 3-year Fixed Rate states a savings claim of $per year, but Customer has paid more than [redacted] with Viridian The savings claim that Customer is referencing is based on Viridian Energy’s 3-year Fixed Rate offer as compared to [redacted] ***’s current rate of cents per kWh As explained in the last response, Viridian Energy’s current Variable Rate is higher than its current Fixed Rate Viridian Energy’s current Fixed Rate is below the rate charged by [redacted] ***, and its current Variable Rate is higher than the rate charged by [redacted] *** As noted above, does not offer a general guarantee savings as compared to another electricity product Viridian Energy can guarantee that one of its Fixed Rate offerings as of December 2014, is lower than the rate offered by [redacted] as of December Please see Attachment indicating Viridian Energy’s current Fixed Rate offerings.Customer’s rebuttal states that Customer believes that Viridian Energy was supposed to be saving her money As stated above, Viridian does not offer a general guarantee savings as compared to another electricity product At the time of Customer’s enrollment, her initial Variable Rate most likely was lower than [redacted] ***’s rate at the time, however, Viridian Energy cannot guarantee that Customer’s Variable Rate will always be lower than [redacted] ***’s rate because Viridian Energy does not have any control over [redacted] ***’s rate and it cannot predict the future Viridian Energy encourages customers seeking price certainty to select a Fixed Rate product.Finally, Customer’s rebuttal states that Customer does not find Viridian Energy’s offer of a $courtesy credit to be an acceptable resolution Customer was appropriately charged for the rate plan that she enrolled in Viridian Energy did not err with respect to Customer’s account, and therefore she is not entitled to a refund However, Viridian Energy understands that Customer was dissatisfied with her selection of a Variable Rate and is willing to offer Customer a courtesy credit in conjunction with enrolling in a Fixed Rate I would be able to increase Customer’s courtesy April 1, [redacted] ***Complaint ConsultantRevdex.com [redacted] Re: [redacted] , Case # [redacted] Dear Ms***:This letter is in response to the complaint that [redacted] (“Customer”) filed with the Revdex.com on March 13, and received on March 19, against Viridian Energy Customer’s complaint states that: 1) different electric suppliers have been soliciting in his neighborhood and requesting to view his electric bill; 2) without his knowledge he had enrolled with a different electric supplier; 3) door to door sales representatives fail to provide him with information regarding his new plans or even make him aware of what changes are being made; 4) he wants to ensure that Viridian did not charge him an early termination fee (“ETF”), and 5) Customer is requesting to be added to the do not call list.Viridian Energy markets to [redacted] consumers through a door to door marketing program All sales agents are affiliated with a third-party marketer that markets exclusively for Viridian Energy in the state of [redacted] Customer’s complaint states that different electric suppliers have been soliciting in his neighborhood and requesting to view his electric bill Viridian Energy cannot address complaints that Customer has against other suppliers marketing in his neighborhood.Customer’s complaint states that he was changed to a different electric supplier without his knowledge Viridian Energy’s records show that on January 21, Customer enrolled in a twenty-four (24) month fixed rate plan Customer did have knowledge of his enrollment as he confirmed his intent to enroll by completing a third-party verification call (“TPV”) During the TPV Customer stated clearly that he was the one authorized to make decisions on the account and provided all of the necessary enrollment information Next, Customer’s complaint states that door to door sales representatives fail to provide him with information regarding his new plans or even make him aware of what changes are being made Again, while Viridian cannot address complaints that Customer has against other suppliers, upon enrollment with Viridian Energy Customer was sent a welcome letter [ATTACHMENT A] which included a statement of the agreed rate and plan with the Terms and Conditions It is important to note that after Customer received the welcome package, he had a second opportunity to rescind his agreement with Viridian Energy.Customer’s complaint states that he does not want to be subject to an ETF of $ Viridian Energy’s ETF for a 24-month contract is $not $ The TPV that Customer completed clearly explains Viridian Energy’s ETF and rescission policy Customer had the right to rescind his enrollment without any penalties or fees within (3) three calendar days after the enrollment On January 30, a drop request was submitted and the utility provided a service end date of February 27, Customer request cancellation after the rescission period, therefore he did not fulfill his contract and he will be subject to $early termination fee Finally, Customer requested to be added to the do not call list We have honored Customer’s request and added phone numbers linked to Customer’s account to its internal do not call listViridian Energy is committed to compliance and customer satisfactionIf you have any questions, please do not hesitate to contact me by email at [redacted] Regards, Alexandra JosephCompliance Specialist

Complaint: [redacted] I am rejecting this response because:Viridian's response indicates that I have been on a variable rate plan But they do not address the fact that the rate of HAS NOT VARIED during months out of a month period (and of those months were consecutive - May through September in 2014; and November through January 2015.)Certainly 'market conditions' and 'company operating factors' HAVE changed; and seasons have ALSO had an influence And yet, the month-to-month rate has NOT CHANGED during the above mentioned periods I disagree with Veridian's comment that I am upset at the fact that their rate has not been modified to match what is currently being offered by my utility company I never expected them to match There is nothing available to the customer to back up Viridian's variable rate It seems they charge whatever they want It appears that Viridian strives to get the most they can out of their variable rate customers, hoping that they do not look at the details/comparisons of their monthly billing In regards to my conversations with Viridian, the only thing they would offer was a $one-time discount if I signed up with them for two years at a fixed rate I explained therefore that I am not interested in doing further business with Viridian since I lost any trust in them I want a valid accounting of the basis of each of the last year's monthly charge and adjustments accordingly Sincerely, [redacted] ***

On March 12, 2015 Customer filed a rebuttal that states: 1) There were five consecutive months where Customer’s Variable Rate did not change; 2) Customer does not feel that she has transparency into how Viridian sets its Variable Rate; and 3) Customer requests an adjustments to last year’s monthly charges. First, Customer’s rebuttal states that there were five consecutive months where Customer’s Variable Rate did not change. Please understand that enrollment in a Variable Rate does not guarantee that the rate will change, it only indicates that the rate is subject to change based on a variety of factors. Although, a Variable Rates may fluctuate from month-to month, it is also possible that the Variable Rates may remain steady for a period of time. For example, the 2013-2014 [redacted] caused an extreme increase in the market price of electricity, and rather than passing this cost through to Variable Rate customers during the span of one month, it spread out the cost over the span of several months.Next, Customer’s rebuttal states that Customer does not feel that she has transparency into how Viridian sets its Variable Rty service to the customer. There are several factors that determine Viridian’s Variable Rate, including market conditions and company operations. For customers that are looking to independently calculate the applicable monthly variable rate, Viridian offers its Term Free Index Rate product. The publically available index allows consumers to independently calculate their variable rate. Finally, in Customer’s rebuttal she requests an adjustment to last year’s monthly charges. Customer enrolled in a Variable Rate and was properly charged for a Variable Rate. As a result, a refund is not due.I sincerely hope this meaningfully responds to the above complaint. Renewal notices on fixed rate plans are sent out 30-days prior to the expiration of the contract term. The term end date of the plan was October 3, 2013. Customer are required to respond to the noticeViridian Energy’s records indicate that a notice was sent out on September 3, 2014, but a response was not received causing the account to default to a variable rate.
While we strive to provide rates that are competitive, they can be higher or lower than the Utility or other licensed suppliersCustomer contacted us in May of 2014, more than months after his fixed rate expiredHe was offered a new fixed rate plan and small courtesy credit, but declined
Viridian Energy is committed to customer service and satisfaction and regret that the customer was dissatisfied. The account was billed and serviced according to terms and is not entitled to reimbursement. The account was cancelled and service has returned to standard service effective 5.28.2014. Customer enrolled with Viridian Energy on August 4, and selected a 6-month Fixed Rate at cents per kWh Prior to the end of the fixed term, Fixed Rate customers are sent a renewal notice with details regarding a renewal term In order to receive a Fixed Rate for an additional term, customers must affirmatively agree by signing the renewal notice and returning it to Viridian Viridian also allows customers the convenience of renewing a fixed term online or by phone If a customer on a Fixed Rate does not affirmatively renew his/her fixed rate contract, he/she is placed onto a month-to-month Variable Rate, which may be cancelled at any time without penalty Viridian did not receive a response from Customer, hence, she transitioned to a Variable Rate plan at the conclusion of her term Variable Rates may fluctuate from month-to-month based on wholesale market conditions and company operating factors Viridian encourages customers seeking price-certainty and protection from market volatility to select a Fixed Rate product

I am rejecting this response because: In no way did our sales person ever indicate any of this There was never a mention of market volatility, or variable rate plans We were sold a product based on a trusting relationship of a neighbor, and I am quite confident that he was not aware of the volatility of your prices either I do not blame him personally Following that, we were sent a package, which quite truthfully, I did not feel necessary to review since our sales rep had "explained" the process to usOkMy mistake However, I can assure you that Viridian banks on this face-to-face misrepresentation, and then banks on the fact that most consumers who have entered into this business relationship in trust perhaps did not read the follow up literature Which was like reading the phone bookIt was never represented to me that I should be monitoring my energy prices and that the minute we signed, prices would climb, soaring past our carrier's prices This is what you count on! We should have especially been warned to monitor prices as we are on a budget plan and pay the same amount every month, and therefore did not see it until year end when we owed over $additional (I ALWAYS receive a credit back year end with my original energy carriers I NEVER owe money.)
Perhaps you could blame me for not reading the dot and letter of the contract But this is an intentionally deceitful practice In fact, in addition to the sales rep who sold us the plan, I have had several other acquaintances try to sell me the product previously None of them ever stated variable rates They all boasted HUGE savings when you sign with Viridian Hugely deceptive and dishonest practice I wonder how many other people are getting ripped off each month by your inflated prices Why are your energy prices so much higher than *** and *** *** anyway? It's truly obscene
Please advise as to any additional course we can take with this unseemly business practice Thank you*** ***

December 3, and that Viridian received on December 4, Customer’s complaint states: 1) Customer’s rate recently increased from $to $without notification; 2) A similar rate increase occurred last year and Customer also did not receive notification; and 3) Customer would like to receive a refund and reasonable Fixed Rate contract.First, Customer’s complaint states that Customer’s rate recently increased from $to $without notification This is incorrect Customer was enrolled on a 6-month Fixed Rate plan that began on February 5, Prior to the end of Fixed Rate terms, Viridian Energy sends customers a Renewal Letter informing the customer that his/her Fixed Rate is ending, and that if he/she does not renew into another Fixed Rate product, he/she will default to Viridian Energy’s current Variable Rate Customer was sent the Renewal Letter in Attachment on July 7, This renewal letter notified Customer that her Fixed Rate term was ending, and offered Customer a number of options to renew her Fixed Rate plan Viridian Energy did not receive a response from Customer, and as a result, Customer transitioned to Viridian’s current Variable Rate product. Customer’s complaint states that Customer had a similar rate increase occurred last year and Customer also did not receive notification This is also incorrect Viridian Energy also sent Customer the Renewal Letter shown in Attachment on October 31, informing Customer that her Fixed Rate was coming to an end, and that she would need to affirmatively renew into another Fixed Rate Viridian Energy did not receive a response from Customer As a result, Customer transitioned to Viridian’s current Variable Rate at the end of her term. LLC is committed to customer service and satisfaction and regrets that he was
dissatisfied with his experience with Viridian, LLC. In the complaint MrGolick states he was
satisfied with his service from Viridian until his bill increased to a high
rate. Customer would like his bill to be

The
customer’s residential electric account was enrolled in Viridian Energy’s
variable rate plan The account was
enrolled using the online enrollment method on or around March 2, 2012, service
commenced on April 9, The
customer’s account was referred to Viridian Energy by an Independent Contractor
named Living Green Now, Associate ID# and was authorized with an
e-signature of “Jacob Golick.” Viridian Energy utilizes a network marketing
approach to energy sales which means that each one of our Independent
Associates is required to have a relationship with each of their
referrals.
Pursuant to Viridian Energy’s Terms and Conditions, variable rates fluctuate
generally based upon such factors as load ratio, energy market pricing,
transmission costs, company operating factors, and other market price related
factors. While Viridian Energy aims to
provide rates that are competitive with the local utility and other electricity
suppliers, prices may be higher or lower than the EDC's rate in any given month. The benefit to this plan is that it allows
the customer to the flexibility to cancel anytime without incurring any early
termination fees
This
winter’s unprecedented cold temperatures coupled with record high wholesale
energy prices resulted in both increased usage and increased rates for variable
rate customers. Just as an example, the
average cost of wholesale electricity increased by 126% during December over
its December level. We recommend
that variable rate customers switch to a fixed rate plan that offers protection
from price swings through 2014. Public
Power’s current fixed rates are lower than the utilities’ standard offer
While we have been experiencing unusually high call volumes and wait times,
customers do have the option of leaving a voicemail message on our customer
care line. A customer care agent will
return phone calls within hours.
Nonetheless, we would like to apologize for the Customer’s difficulty in
reaching us
In closing, The
Customer made a conscious decision to enroll in Viridian Energy and understood
the implications of switching his energy supplierDue to the cold this winter,
rates and usage has increased resulting in higher bills for variable rate
customers. Viridian received an inbound
drop request from *** on February 4, 2014, and MrGolick’s account returned
to standard service on March 11, 2014. Viridian
takes this matter very seriously and holds itself to the highest standard to
make certain that matters as such are properly managed. We apologize for any inconvenience the

Viridian claims that they did not provide fixed rates, yet the terms and conditions attached to the email do. in response to the complaint that *** *** (“Customer”) filed with the Revdex.com on August 25, The Customer’s complaint states that: 1) Viridian Energy agreed to refund Customer for the delay caused in switching Customer to a Fixed Rate; 2) Customer’s refund was approved on June 20, with a processing time of 4-weeks; 3) Customer has not received his refund; and 4) Customer was told that his check was delayed due to the fact that an employee failed to include it on the spreadsheet sent to Accounts Payable for processing, and the head of the Accounts Payable Department was on vacation
I apologize for the delay in processing Customer’s refund check When processing a refund check, customers are told to expect that their check will be delivered in 4-weeks Unfortunately, Customer’s check has taken longer than expected The primary reason that Customer’s check has been delayed is that an employee erred in failing to include Customer’s refund check on the spreadsheet sent to the Accounts Payable Department for fulfillment It is also true that the head of the Accounts Payable Department was away from the office for a period of time this August Nevertheless, Viridian Energy understands that Customer has been waiting for this refund and the Customer’s immediacy in having it delivered Customer was told when he spoke to Viridian Energy’s Customer Care Department today August 25, at a.m., that Customer’s refund request had been processed and was with the Accounts Payable Department for payment Viridian Energy sent out Customer’s refund for $last Friday August 22nd by U.SMail In response to Customer’s complaint, Viridian Energy can request that the Accounts Payable Department fulfill and send out Customer’s remaining refund check for $within the next week
