researching our internal records, account manager Travis confirmed he tried to negotiate a lower rate, however you declined and requested your account be canceled. Town Apartments signed a Service Agreement with Waste Management, which took effect on April 20, 2016 for 12 (twelve) months.  Pursuant to Section 2 of the Term, the term of this Agreement is set forth on the service summary sheet. The initial term of the agreement is for 12 (twelve) months and the agreement automatically renews for an additional 12 (twelve) month renewal term if Town Apartments does not notify Waste Management on a certified letter of termination at least 90 (ninety) days, but not more than 180 (one-hundred eighty) days, per Section 2 of the termination of the then-existing term.  Please see the attached Service Agreement.
 
Town Apartments failed to give Waste Management any notice of termination within Section 2’s allotted time period.  Therefore, the Agreement automatically renewed for an additional 12 months.
 
Town Apartments may still elect to cancel the Agreement; per Section 7 of the Agreement, will contractually owe liquidation damages for early termination.

I have recently chosen another trash service that actually picks up my trash every week. Continuing service with Waste Management is not reasonable. Account Manager [redacted] confirmed she explained your invoice’s to you and that the base rate did not increase. The base rate is still $50.00 and it does not include the extra charges that are stated on the front page of the agreement, which also did not increase. The balance on your account of $454.59 is for service from October 06, 2015 to February 1, 2016.
 
She agreed to issue you a credit for one of the overages as a courtesy because you were a new customer. Please see the attached pictures showing the extreme overages of construction material that should have been placed in a Roll Off container. I have attached all of your invoices explaining the charges.

Your response, in no way, explained my ORIGINAL complaint.   We need to know why WM chose not to contact us between [redacted] and [redacted] regarding our contract.   I lowered my pickup rate because we do not do volume enough to justify the original pickup schedule.  [redacted] only offered a lower rate if I sign a new contract, which IS the problem in the first place.  Obviously we are going to agree to disagree.

Given the scope of this billing issue, I filed the complaint before speaking with Steve. Steve and I spoke yesterday and we came to an agreement. Still my complain stands that the 7 month time-frame and dozen phone calls it took to resolve the billing issue is unacceptable.
