I said all of information kept privateThey had to give our information out because of *** called us*** card send me a letter wanting to know if I applied for a cardWe had a couple more call us they did not tell us about maintenance feeThey lady who helped us fill out papers we would not have a maintenance fee until and if we didn't use it they would waive the feeI than got a bill for $*** for maintenance fee for nowI called and spoke to *** *** and he would not hardly speak to me about anything than started laughing at me and really upset me on the phoneI don't think that was very professionalWe were also told if we ever wanted to sell they they would help us sell it they had a realtor they usedNow they say they didn't say a word about a realtor another lieThey run you threw there so fast you have no time to read all the paper workThe salesmen kept saying can you afford to pay $*** a month well that is another wrong thing to say its moreThey also said we would have unlimited use with no extra charge well that was wrong
I am so upset about all the lies the people gave us at the timeThe company trains these people to do this to peopleI will not ever use thisWe are both seniors we dont deserve to be treated with all this issueIf nothing is settled through this I will try another way to settle this situationI am very upsetI would like this paid off to stop all of this to usI think they need to pay for all the lies or the way are treating usI would like an answer in ten days so I can have an opportunity to get someone else on this

Again we do not share any information with anyone on our ownersIf I had to guess, I would say it would have been the ***, as anyone that has ever applied for a credit card knows once your approved by one all the other send out something to you soon
The fact is that the ***'s have no maintenance fees due until The HOA will bill them every year for 1/of the next use years feesIf they pay it they will not have to come up with the full amount in the use year and have more money to enjoy on their vacation that yearNo late fees apply to the billings until the use years is due, in this case If an owner is not going to use the week in they contact Customer Service at *** and have the unit placed into the reimbursement program and receive $*** of the paid fees backNo other resort in Branson makes this offer
Owners do have unlimited use, but nothing is free, they can rent nights at $*** per night or weeks at the price of a maintenance feeThis can be done as offend as they wantThe VIP Charter states all the cost involved in using extra time or the purchase of extra weeks
The contract is paid in full, so if they wish, it can be listed for sale with a broker of their choice and have the unit sold to recover the cost of the purchaseAll owners are given a five day right to review the contract and ask any question they may have or even cancel the contract with a full refund, so it is hard to say that they were rushed and didn't know what they were purchasing

Per the notes and after talking to the manager of the check inn's it seems that *** *** refused to take the tour, she stated she was not told she had to take the tour by *** ***, so *** *** just paid for the one night in the hotel and the package was not used
So at this point the package is still open and can be used by *** *** any time she wants to use it
I also checked with the manager and no one told them the tour would be hours long, we require a minimum of minutes for our tours

We had an issue with the maintenance fees being billed to us before we were ever able to use itWe should not have to pay any fees until we are able to utilize the contract, correct? We don't understand how your company can expect owners to pay any type of maintenance fee bills before they are ever able to utilize any aspect of their ownershipThis is completely unacceptable
We are also not happy with the fact that when we did try to utilize our contract, we called your company directly and the representative we spoke to reiterated to us that we could not stay at the actual resort, which is what we were promised, but they could put us up in a nearby hotel, but it would cost us more money! WHY??? Why would we have to pay any additional fees in order to utilize our contract? This makes no senseHow is this ownership beneficial for us? It seems the only ones benefiting is your company!
We have yet to be provided any services in return for the monies we have paid and we do expect for your company to cancel our contract and refund the monies we have paid thus farWe do not want to be associated with a company that tends to defraud consumers and would rather cut our losses now

I don't know how else to explain this program, it is simple to understand the purchase was agreed to for a triennia use week, that can be used every year by paying a maintenance feethis is one of our most popular ownerships, due to the fact that if you want an extra week you just purchase it and goIf you are not wanting an extra week then you're not out any money until the use yearIn this case the use year is set for and the reservation can be set now for next yearShe is right as the difference between the annual and a triennial are just the maintenance fees would be do every year on an annual contract.We have offered to help her to better understand how to use the purchase that they agreed to.They had five days to look over the contract ask any questions or even cancel the purchaseNo calls were made to us until August 16th days after the purchaseOnce again we will not cancel or refund this contract based on this complaint due to the fact it can be used every year as she was toldWeeks can be purchased for as little as $per weeks less than a price of the maintenance feesTo set a reservation for or book extra weeks, just give us a call at *** anytime *** ***Compliance OfficerSummer Winds Resorts e

Ms*** also had a five day right to look over the contract and cancel with a full refund
I received an email from Ms*** and sent her a reply on April 5,to her concerns and told her this same information

Ms*** called me on 8/5/at 5:pmI explained to her what was wrong she kept denying this wasn't said,(she did not attend the meeting with us so how can she know what was and not said)she called me back after getting Mr*** on the phone, he asked what was wrong I asked being he asked what was wrong was he just now learning of this problem being I have tried to reach him on several occasions, he said yes and started making excuse that he don't get involved when there is a problemhe denied what I said he told usMs*** started talking they were on conference call she asked me what kind of power do I think they have to buy our time share I told her the power to buy our time share since this was what we were told, I stated again Mr*** made us believe summer winds were buying our time share and we had no more claims to itwe're still standing on what we were told, she offers to put us in a cheaper unit with less cost, as I told her I'm standing on what we were told, she made a statement that we are just trying to get out of paying for this, no problem in paying for it if it was as we were toldshe kept trying to get me to see it her way and again in our going back a forward I told her we are standing our grounds being the four of us were told the same things, I asked for our money back and contract to be cancelled she assured me it wouldn't be and it would be turned over to collectionsI told her I'm not giving up on this we were lied to in getting us to purchase this time shareshe got upset in turn so did I and I told her this stress I'm not going to continue and I hung upI don't believe I would have ever received a call back from Ms*** or Mr*** had I not have filed a complaint being Mr*** knew nothing of this until 8/5/My Mother *** *** would like her money back and we all want this cancelledWe have had this short dealing with this company and things are as they are it would be a train wreck to continue doing business with them

I do not want to do any further business with this company or give them any more money for maintenance fees or exchanges as I believe we were not given the correct information about the selling of our other timeshareWe were not informed that the listing would only be for a yearI called the properties in Door County that they said would be available and there is no availability as we were told there would beWe would have to deposit our "exchange" on Jan1st and hope that something would be available at the property we wanted for spring or summer when our children could take advantage of itOur Mexico property does not carry a deed with it and they did not point that out when they were making their sales pitch to usThey assured us their property was such a good place and we could easily exchange itWe do not want to do any further business with this company as we believe we were given information verballyWhen signing a mortgage, they carefully go over each step of the contract and this was not the case with Summer WindsWe were dealing with some medical issues last year and did not respond earlier and when we did contact *** *** they did not have anything available! We do not wish to use Summer Winds or Exchange it for anythingI really feel that there are many young families and elderly people who are being taken advantage of in order to sustain this companyThey are offered free tickets to get them to come and just "hear" about the property and see it and then they are pressured into buying

In reading the reply I can see Mr*** is having a hard time understanding how the program worksOwners do not call the resort for reservations, they call the Summer Winds Travel to book the weeks for the $At this time the Summerwinds Travel has units listed in Wisconsin for only $per week in a bedroom unit, again that is only $per night
Yes they can place the week into *** *** for exchange in and they will not pay an exchange fee, as we pay all owners exchange fees
If the ***'s wish to they can list the unit for sale with a broker of their choice and have the unit sold
Again we will be more than happy to help them to better understand how the program works and how to get the reservation they wantWe will not cancel or refund this contract

The call that was made to him last week was to see

*** was sent a welcome letter on March 14,with the information on the purchase
The package has expired at this time and we will not refund a purchase from almost years ago
