We have looked into this matter and yes Mr*** did a trade in on a *** unit at the time of saleThe form at the time of sale state that the owner is responsible for any resort fees or transfer fee the resort may have
The sales department only deals with the contract and the cost to the transfer companyThe sale department has no way to know what the resorts fees will be at the time of sale
Once *** receives the contract they contact the resort and see if any fees will be due at the time of the trade in and inform the owner of the amount they will need to pay
The first item of the Purchaser Acknowledgement states this is bedroom Usage is ODD and first year of use is Mr*** received a copy of this and never questioned it
If Mr*** would like to have an annual use contract , we can have the sales department contact him with the amount to purchase the Annual contract
If they would like to cancel the trade in of the *** unit they can contact *** at XXX-XXX-XXXX and request the trade in to be canceled

My wife and I both assumed this company would sell out current timeshare***, the sales person, seemed so nice and we just completely fell for her charmWe were told that our timeshare is worth between $9,- $11,*** kept saying that it would probably all be a washSo when we were offered to do an upgrade, as she called it, we were thrilled that we would not be out much moneyI even told her that we would never have done this if we were not sure we could sell our current timeshareWhen we went to the Resale Disclosure, Mr*** said to just initial, that we were agreeing to everything that was presented to us by ***So, unfortunately, we just initialed without readingWhen we got home and really looked at the papers it states that any oral representations to the contrary are not bindingWe both thought that they would sell our timeshare, but the info is actually given to *** *** *** in ***, OhioWe realize now that we also initialed that we agreed to pay this company $to "try" to sell our timeshare(I called *** and found out that our timeshare is not worth very muchAlso, on the closing papers we were charged $for for maintenance fees to Summer Winds ResortWe were told that if we did not stay at this resort we would not have to pay a maintenance feeWe were told by *** that our current timeshare was a 3-star but if we bought into this program we would be a 5-star customer and could purchase as many vacations a year as we wanted for $It is actually $to $per week, depending on where you choose to stayWe gave them $1,($maintenance, $for enrollment, and 15% of loan amount which was $1,489) They went ahead and set up payments for $(at 15.9%)I had originally told them that when I got home I would get the $8,out of savings and go ahead and pay the loan off and when the timeshare was sold I would put the money back in savings
So, as I stated, when I got home and found all of this I called American Express to file a complaint and also told them not to pay the $which was to be automatically taken out each month
I have read other complaints against this companyI don't see how they can still be in businessI certainly don't understand how *** and *** *** and Mr*** can look you right in the face and lie to youThis is truly a scam

We have looked into this matter and find it hard to believe they thought they were just listing a unit for saleThey came in to the resort via an OPC contact that had nothing to do with Diamond Resorts and nothing in the paperwork
they were given by the OPC had anything to do with Diamond Resorts
This purchase was made in November of and they have never paid a maintenance fee to allow them to use the unitIn December of Mr*** said he sent a cancel letter to us, we did not receive any letter, I informed him it was too late to cancel the contract and that he had five days to do so
I am not sure how Mr*** was able to book a stay at a resort in Branson, our records show that he has never paid the fees and he would not be able to travel with us until the fees are paid
At this pint Mr*** can sell the unit via a broker of his choice, keep in mind the maintenance fees must be up to date before the unit can be transferred to the new owner
We will not cancel or refund this contract based on this complaint

Your sales staff deceived us on purpose! The know that had we known our contract would not be sold, we would have never agreed to attend the presentation

This is the same response that I keep getting from summer winds! There is zero customer service what so ever and when I call in to talk about this matter I never receive a response! I have only received one call back from the plus times I have called in to speak about this matterOur sales representative verbally promised us different solutions when we signed upI do not understand how this is happening over and over! We have been lied too and not once has that been addressed! We are hard working people and expect that a company follow through on what they say! We want out of this contract now! I have been avoiding further legal action to this point hopping that they would at least return our calls and work with us! Summer winds is in the business of stealing hard earned money from hard working people! This should have been addressed to us before we signed up with Summer winds! I am hopping that the Revdex.com would recognize that this is an ongoing theme with this organization and help us take action! Flyod is a rude and arrogant person who has no regards for the people who summer winds services! Mr, Elliott addressed only one of the claims that I presentedThis one is partially true, but not close enough to the promises that were made during the sales presentationHe has acquired some skill at dodging customer complaintsWe were also told: #The top 10% Of the worldwide inventory of 5-star resorts was available to us if we bought one of their unitsFalse#All RCI properties were included in our $options with no booking feesFalse#All owners who don't visit Stormy Point during their use year will be refunded $of the maintenance feeWe have learned that this is only a limited number and the customer service reps are "not told the exact number"#Although they made sure they don't guarantee it, we were promised that they could easily sell our other timeshare properties 1n about 6-months, thereby eliminating all other maintenance fees, exchange fees, and RCI duesThe salesman even listed on paper how much we could expect to receive from these salesThis would lift a huge financial burden and still allow us to travel through their program as often as we choose to "anywhere in the world to the top 10% of the 5-star resorts in the world"AgainfalseHe didn't mention that a 3rd party handled these sales, that there was a fee required for each one, and that each unit was added to a list of thousands that I have yet to find online
From the other complaints that I have found it appears that their salespeople are trained to find out what you already own (or don't own) and how you travel now and hope to travel in the futureThey use this information to tell you whatever you want to hear and will repeat it as many times as it takes to convince you that it is trueThey have gone too far
Every claim I have made is supported by my husband and the other couple that was present at our meetingWe have owned timeshare properties for years and actively use themWe have traded for wonderful resorts from Aruba to Washington state through RCIWe have been to countless timeshare sales presentations, but never have we been subjected to this level of dishonesty and intense sales pressureWe are years old on a fixed incomeWe would never have bought through Summer Winds unless every single one of my objections were true

Stormy Point Village is an Interval International Elite resort, in the top of all II resorts
When an owner exchanges the week they will get top priority for exchanges in top rated resort all
over the world
RCI properties are available via the Summerwinds Travel, they work with II, RCI and resort owners and no fee is required to purchase the weeks that are available
Owners can place the week into the maintenance fee reimbursement program and receive a refund of $499.00, the program opens on November 1st each year for the fallowing year useWe take as many weeks and we can, this year we took over weeks into the programIt is based on a first come basis
Owner can also use the rental program to recover maintenance fees if they wish
That is correct, we do not guarantee resale, per the resale disclosureA worksheet was done on the resale listing and the fee of $was listed on the worksheet and initialed by the customerCopy enclosed
Any timeshare sales person at any resort, will ask what your travel needs are and try to work within the realm of your travel needsIt has been done that way for years
The first year of use form Mrs*** is set for 2017, and she will see at that point what can be done with her exchange and how nice of a resort she can get being a Stormy Point owner

I have to thank MrElliott for being so specific in his defenseHe has supported and confirmed each of my complaints
The rebuttal stated "Stormy Point Village is an Interval International Elite Resort in the top of all II resorts." That statement has little relationship to the promise of 10% of the worldwide inventory of 5-star resorts being HELD for Summerwinds ownersII was never mentioned at our meeting or the annual dues to use itThat one of the items that surprised us when it was revealed later
By his own admission ALL of the RCI properties promised to us are NOT available in your systemThis was a major selling point for us because we use RCI
We were told we WOULD receive the $reimbursement if we chose not to use our weekThe sales rep pushed this pointHe even encouraged us to use this option and book Stormy Point through the $programMr Elliott is now telling us "We take as many weeks as we can
It is based on first come basis." No date or limitations were mentioned by the sales repSo now we have to pay maintenance fees full months BEFORE they are due to scramble for a place in line for a POSSIBLE reimbursementFurthermore, the number of refunds is at their discretionUnbelievableThis,too, was one of our top reasons to buy
Just because they disclosed the $fee (per property) does not make it an ethical practiceeven other resale agents have told us thisMay I remind MrElliott that he was not there as the salesman listed our properties with the amount we could expect to receive for each one in a 6-month time frameWe can't find any evidence that VSI (the agency we were referred to) is making any attempt to sell our property
He wrote "The first year of use for Mrs*** is set for 2017"another surprise revelationWe were encouraged to start right away, having no idea Stormy Point was not available to us for 1/years
In his attempt to refute the lies and misconceptions under contention, MrElliott has strengthened our caseMy complaint centers on what we were actually promised at our sales meetingThis is what we believed to be true when we purchased the unitHe has told us in his rebuttal that those things are not trueThe fact that he is working so hard to defend their deception tells us that he continues to encourage itMrElliott's ".we are always happy to help our owners" and "thank you for your time and concern" sound so phonyHe tried to sound reasonable and concerned about the ownersIf he actually was sincere he would admit they scammed us and offer the repayment I have requestedOur sales rep knew he was losing usIn his fervor to make a sale he promised more and more that
Summerwinds can't deliverHe went too far this timeThey have to admit we were deceived
To summarize: We bought because we were told Summerwinds would sell our other timeshare properties in 6-months thereby eliminating all other maintenance fees (including the $refund we were counting on), exchange fees, and RCI dues, and we'd still have access to ALL RCI resorts and UNLIMITED $5-star units (which turned out to be their leftovers)We believed the rep and acted on what he promisedWe would not have made this purchase if ALL of that were not true, and it just isn't true
MrElliott's chose not to comment on the hundreds of other complaints against Summerwinds
I have reiterated the same arguments over and overThey haven't changed, I still have other witnesses, and I will continue this fight until Summerwinds voids our contract and issues a refundAn apology for the deception and putting us through this anxiety would be nice, but I doubt that will ever come

Summer Winds did not address our complaint of fraud and lies! We were repeatedly told we would get weeks to use a year! Extra money was not mentioned unless we wanted to add more weeksThis business is sure putting a black spot on Branson! Why do they not address our complaints, instead they sidestep the issueWe can not even use an "owners week" for years! I am including the letter which I sent to them by certified mail! We accept the week that was deposited into *** to replace the points that we lost due to not being informed on the requirement to bank them before the closing company sells the property
I was informed after the matter that the points had to be banked before the transaction was completeAlso *** Doesn't allow you to bank pointsSo this would be valuable information that would help customers in the future when you inform them about trading in their timeshare and informing them that they wouldn't lose their points in their account

We have looked at the records on this tour and found that the income marked on the check in sheet did not meet the requirements for the programThis had nothing to do with the age of the customers as
we take customers form
the age of and up every day
We do not allow customer to go back and change information on the check in worksheets
We did allow them to have the hotel room for the one night for the cost they paid for the package
If they had purchased the hotel it would have been *** so they did save money
We will not refund the *** paid for the package as we did allow the hotel room with no problems

We have looked into this matter and find Mr*** is wanting to purchase weeks at the price of $for Next year, most of the week for the $price are within days, in the next few weeks units will be listed for
As per the contract and the VIP charter the extra week are priced from $to $so the price he was given was within the range of the contract
The contract purchased is for Odd year use, the owner can still use Stormy Point every year by purchasing extra weeks or night back to Stormy PointOur customer service department is open Monday - Saturday 8:am until 5pmWe will be expanding the hours soon for owner to make reservations and ask questions
All the concerns in this letter are covered in the contract and they had five days to look over the contract and ask any questions or even cancel the contract with a full refund
None of the pricing that Mr*** has mentioned in this complaint are outside of the range agreed to in the contract

The reason I do not except Stormy Point Village response is simply because I was lied to
One of the first thing we asked was is this a Vacation Travel Club and we were told that it was not a travel Club but a Timeshare with our home resort being in Branson MissouriWe also were not told this was an every other year contract but now we learned we can go every year by purchasing extra weeks or nights back to Stormy Point
They are correct when they say the extra weeks per the contract and the VIP Charter are priced from $to $but they failed to tell us that the $price for most weeks are within a day travel windowThe salesman told us we could get a bedroom unit anytime and anywhere for $We even went back the next day and talked with the salesman again because we wanted to make sure we understood him correctly about the $price for a bedroom unit anytime and anywhere was correct and he assured us that was trueHe never told us that we would have to travel within a day window and would have to choose from a list that comes every MondayWe had a particular place we wanted to go and he told us (salesman) just give them a call, when we called we were told that it was not available and the price would not be $but $to $because of the season and the resort and we were trying to book outside of day window to travelWe never were told the season or resort would matter, he always said anytime and anywhere for a bedroom unit would be $
We are familiar with II and RCI and this program appears to be nothing more than get away weeks that II and RCI have availableSummerwind Resort operates like a Vacation Travel Club and not a Timeshare programOur salesman guaranteed us that we were not purchasing a Vacation Travel Club
Our salesman also told us that he was assigned to us because we were timeshare owners and he would be able to answer our questions faster and better than some of the other sales people
This is a shame that they charge you this outrageous price for something you will hardly ever use at the price they told youThey put it on paper but never tell you the complete details in person (to our face), you must read the contract completely and the layman does not have a lawyer's background to understand all the terminology
We have been misled and lied toWe never would of purchased a program like this had we been told the truth at the start

Again we have looked into this matter, This is a timeshare with a deed to a unit at Stormy Point Village not a travel clubYes the contract is for every Odd yearAs for weeks priced at $not all of them are locked into the days window
The only way I know to resolve this matter at this time is to see what Mr*** is looking for and when he wants to travel, He can contact me at XXX-XXX-XXXX and I will see what kind of pricing I can find for his trip
It is hard to just say yes the week is $without having a timeframe and location to be able to checkAgain the pricing on the contract is $to $
With the Odd year week, it can be exchanged for locations as far out as one year and we pay the exchange fees with II so the cost is only the amount of the maintenance fees
