We have looked into this matter and see a lot of confusion, Mrs*** can exchange her week with II with no exchange fees, we will pay the exchange fees for our owners that exchange with IIThe owner may call customer service
and we will do a three way with II and pay the fees at the time of exchange or the owners can send me a copy of the exchange and the amount paid and we will send them a check
We do pay the first year of the Interval international membership and after that the owner must keep the account current if they wish to use the II services
Bonus weeks can be used at anytime, no matter if it is the use year or notthe maintenance fee reimbursement program is open to the owner that do not wish to use there week in the use year, owners can contact customer service starting in November to have the week placed into the MFRP and receive a refund of $of the fees
We will be more than happy to help Mrs*** to understand the program and how it all works, she may call customer service any time for help at X-XXX-XXX-XXXX
We will not cancel or refund this contract based on the=is complaint

When I bought this timeshare, I was told that I could go anywhere in the binder with no feesI was NEVER told that I had to buy a membership to go to these placesI was told that you owned these resorts and that I could exchange any timeWhen I tried to do this, I was told that you changed the policy and now you have to buy a membership to II to use itI don't want a membership to III tried to exchange last year and put in my request on January (as early as I could request) to be used in AugustI could not go to the places that were in the binder, some of the resorts weren't even on the listNo resorts to any of the places that I wanted to go were availableSo this is no good to meThe only place I can go is to Stormy PointI don't want to go there every yearYou changed the rules, and that's not okay with meThis isn't what I signed up forI want EXACTLY what I was told when I purchased thisI was also told, if I wasn't happy, you would buy it backI still have the binder, with the places that I should be able to exchange to for free (no membership fees anywhere!!!!) We were also told we could rent Pontoon boats for $per day, but now you no longer offer thoseNothing that I was told, or pay for every month, is what I am gettingI have reached out to you multiple times with no responseI understand how the program works, but what I was sold and told is not what I am getting!

The resort in the binder are managed by Trading Places and are subject to change as they take n new resorts and drop othersAll reservation and exchanges are subject to availability
The boat dock will be open again later this year and owner will be able to rent the boats

I tried to use Trading Places last yearThey told me they are no longer associated with you and I had to use Interval International which doesn't have the resorts that are in the binder and I tried booking in January for locations in the binder (different resorts, same area) for a trip in August and nothing was availableI was never told I had to be a member anywhere else to use the resorts in the binderI don't want to be a member of any exchange companyI was told that was optional and the only reason I would need to do it was if I wanted the options of additional resortsI was happy with just the resorts in the binder, so no need to pay for an exchange companyAlso, you stated in your response that the bonus weeks could be used any timeThis is also not true, When we tried to use them we were told that you can only use them in your usage yearI always get the run around and the result is I can't go anywhere except for Stormy PointI still feel I was misled and would have never signed up for this if you would have been honest about all of the detailsI was lied to and misled and I did not get what I was told I was paying forI had sent you multiple emails directly to customer service and no one responded to any of them

This sale was done in April of 2011, at the time of the contract the only names placed in the contract and that signed the contract was Mr& Mrs***, In May they called and stated that other where to be on the contract as
well, we had no record of thatSo in June we added them to notes as able to use the programThe unit was paid in full and deed to all four of them and they are co-owners of the unitThe problems is that we only recognize one owner for sending all the information to, like maintenance fee billings owner updates and such, it is the responsibility of the owner to get the information to the other owners, we have always do it this way do to the system will only allow one mailing address
I have look at the notes on the account and do not see any request for travel, they had a week to use in and I see no reservation for it, they did stat at *** *** in June of for nights, so something was open at that time and all reservations are subject to availability
We do offer a first right of refusal, it is not a BUY BACK Clause, it just means that at some time we may buy units back from our ownerWe will honor the 4/split for you as long as you understand that you must pay the cleaning fee for the second reservationThe HOA stopped this 4/splits do to not that many owners requesting them, but we will honor the split week for themI have placed a note in the file to this matter
We will not buy this unit back, they may list it with a broker of their choice and have it sold if they wish

12/18/2017 I wanted to get out of the *** resort as the maintenance fees are high, $per year. I was told at the meeting by the salesperson *** ***, and a sales manager, *** ***, and a former *** salesperson that if I bought at *** *** I would not have to pay the *** maintenance fees and Mr*** also told me that if I placed my *** ownership with a broker he worked with, if it did not sale within a year, Summerwinds would purchase the *** ownership for $22,(it was indicated my *** could bring as much as $35,but I could take less of course). Now, they are not doing any of thisI had to pay the *** maintenance fees to avoid legal action, I don't think anyone has tried to sale my ***, and they now claim there was no promise Summerwinds would purchase my *** for $22,if it did not sale within a year of Jan 19, 2017. Yes, I did sign that document Mr*** mentionedThere was a lot going on and being presentedI believe some of this meeting was tape recorded or videotapedI'll send you more documents that were signed or presentedI understand what I am claiming about them buying my *** after one year from Jan 19, if not sold, conflicts with what is in that Acknowledgement I signed (mainly paragraphs and 4) and it could be hard to get them to offer any settlementThanksI'll email you those other documents.12/19/2017 Mr***:Re the copy of the "Purchaser Acknowledgment " with a typewritten date at the bottom of January 19, - I reviewed it and it what I initialed and signed. I am disappointed with Summer Winds on this decisionI feel they are VERY unethical about their sales processWe asked them very specific questions about our purchase & they flat out lied & told us what they thought we "Wanted to hear" in order to get the sale
I hope that the Revdex.com sends out a Secret Shopper to one of their presentations so they can see what they are doing & how they manipulate and lie to people
I do hope this gets publicly posted on the Revdex.com web siteIf someone out there is reading this I highly suggest that RUN not walk away from any presentation by Summer WindsThey will look you in the eye & lie straight to you and tell you what you want to hear even though it is NOT the truth in order to get you to buyBy the time you get you ID number to try to use their web site & book a trip you are past your "day cancellation period"When you catch them in their lies they will tell you there is nothing they can do for you
Make sure to do your homework on them before you buyCheck out the internet & you will see there are MANY others besides me that have been taken advantage of & lied to

We have all talked to Mr*** on this matter and he flat out refuses to listen to anything we have to sayThe sales person told him the purchase was an every three year ownership and that he can purchase extra weeks every year and have as many as they wish
Yes the maintenance fees can be refunded in the amount of $as he was told for his use year
Mr*** also states he wanted to travel for Christmas, but he didn't call our office until December 28,to check on any travel
The Interval International membership was active on December 31,as it takes a little time to get the information to them and have the owners placed into that system, but this would not have stopped them from traveling for Christmas
Everything Mr*** has stated as a concern he can doWe feel that Mr*** also had a responsibility to look over his contract and call with any questions or concerns he may have had within the five day right to cancel the contractHe has made no effort to use the program so he is not able to determine if the ownership works
In effort to resolve this matter we will offer a refund of $the remaining amount will cover the administrative cost of the saleWe feel this is a fare offer due to the fact that Mr*** was so unwilling to listen to anything we had to say and that he a responsibility to review his contract and cancel within the five days allowed by law

As for the resale of the Welk Resort, it was listed and the listing is good for one year, so we still have time to see if it sellsAlso per the contract and the resale disclosure, resale is not guaranteed
I will be happy to call VSI and see if I can help it move a bit faster, but again there is not guarantee

The response is not correctSomething is freeWe agreed at the presentation (and we have the documents from the presentation), that we were purchasing a time share with an annual (every year) free week of stayThere was no misunderstanding on our partWe would never give them *** (I'll be in a couple of months) for the chance to use our time share for the first time in 2019! That's ridiculousAnd then it was only good for every third year after thatThe paper we have shows a free week every year - "Forever"Draw up for us by "Mr*** at the presentation and in the presence of "Mr*** The only discussion about anythin in the third year was the maintenance fee of *** - also on the presentation papers clearly marked as due in We get that and agreed to itThere was never any mention (or even hinted at) that we were purchasing a Triennial-C (whatever that means) optionAnd if that was the deal we were working on, we would have expected any honest salesman to explain what that meant! We absolutely understood that we could purchase other weeks at our expense if we wanted toAnd we also agreed to and understood thatAnd we specifically told the salesmen that we would not be using the time share to come back to BransonWe would be swapping our free week to go other places (cruise to Alaska was specifically mentioned at the presentation)We wondered why the salesman was present when we went to the closing (they don't do that when you buy a car)And we don't know what would have happened if we found that the contract had included the TRI-C and first use year in small print at the topHere's how they distract you from seeing thatThey tell you to check everything below for typos and let them know if you spot anyThere were some (deliberate; who knows)So they go back and get it corrected and reprinted and bring it back to the closingYou of course immediately look to see if the typos have been corrected - they were and then you move on to signing and initialing the rest of the closing documentYou eyes and attention are drawn to where they have made the corrections and away from the top of the document where the Triennial-C and first year use have been printedYes, we missed those two itemsIt's just like the TV commercial says - "Who reads every word? Only lawyers"And the statement where "Mr *** the Compliance Officer says they contacted us and there was no mention that we wanted to cancel is just not trueFirst of all, we contacted them (not the other way around as he states) on June 24th; to find out how to book our first vacation - using the customer service number listed above in his responseSecondly, nobody ever followed up and contacted us to discuss our concerns (Compliance Officer's words, not mine)When we talked to the customer service repon June 24th, that's when we were told about the Triennial-C and first year useShe told us that there was no hurry to book our vacation because we weren't eligible to use our week until WHAT??? She then pulled up a copy of the contract and directed our attention to the top where TRI-C and first use year were printedWe immediately told her we wanted to cancel the contract because that was not what we were told or agreed to at the presentationShe couldn't help us with that and told us to call the compliance department and we didWe also on the same day called the state of Missouri phone number to cancel and they told us that it was past the five days allowed and we would have to settle this with the sellerWell we didn't know within five days that we had been taken for a ride and scammed! There was an expectation on our part that the terms and conditions that we agreed to at the presentation would not actually be altered on the closing documentsWhy would we even think to look for that? Salesman trying to make a sale at any cost and hoping we would miss the details? ProbablyWe were deceived, taken advantage of (senior citizens) and lied to (by omission and directly)Again, we would never pay that much money to buy something that we couldn't use until three years from now!
We continue to dispute the charges with *** and will continue to do so every billing cycleThe papers that VPG Partners (Summer Winds) sends back to *** to have the chargeback reversed are not accurateThey never made a welcome call to us and they did receive multiple requests to cancel! We were well aware of the five day cancellation policy, but we didn't know for five weeks that what we thought we had purchased and what we got were not the sameSo why would we even be thinking about cancelling?
So after three months of going back and forth with these people we have decided it would be in our best interest to seek legal counselWe had our personnel attorney review the contract and he referred us to another attorney here in Dallas who has a license to practice in both Texas and MissouriThe next communication to Summmer Winds will be through himHow he will proceed we don't know as of this writing
In conclusion, if you happen to read this and are thinking about purchasing a unit through Summer Winds - buyer beware!! The salesmen wear you down by tag-teaming, keep you confined in their presentation room, deceive you in what they present and if you don't reject their offer immediately, you might too be a victim of the same misdirection, fraud, and con job that we got sucked intoBE CAREFUL!!! Just get up and walk away - they don't want to waste time on someone they know will not be purchasing anything
Maybe this will be resolved to our satisfaction and that would be goodWe just want to get out of the contractWe have no desire to ever return to Branson, MO, for any reason

We could not get anyone from Mr*** office to help us we tried from early June until SeptThen we sent a letter cancelling the time share by a Missouri lawyer *** *** dated Sept he stated MO.Rev.State.407.610(2)There is nothing in the letter saying to contact Mr*** with info, however he has heard nothing from MR*** So Mr*** is deceiving you, like he has usWe expected to get a letter or response back with the cancellation informationWhen we had not heard anything we contacted Mr*** after many attempts,finally his response is that he will get back to the lawyer which he has not done from Sept when he signed for the letter, until now we have heard nothingI have written to Federal Trade commission and Fraud abuse reporting directory and *** I am very surprised Missouri does not protect seniors from this kind of fraudulent practicesI hope no one else has to go through anything like this
