We have looked into this matter and find the resale listing was done in March of and was good for one year and would be expired at this pointAs per the contract and the resale disclosure, resale is not guaranteedI Will
attach a copy of the disclosure for reviewThe resale agent has nothing to do with Summer Winds resorts and most all Timeshare resale agent do charge a small fee upfront
As for the maintenance fees, the purchase was made for an Odd year use, so every year the HOA will bill for 1/of the next use year fees every yearowners may pay by the year of wait until the use year and pay the full amountAt this time the use year is set for so the full amount is due at this time
We will be happy to move the use year to and wave the current amount that is due without any late fees being appliedIf the ***'s would like me to move the use year to they may contact customer service at 1-800-699-and ask for the paperwork to be sent to themThis will allow them years before the maintenance fees will be due again

We feel that the tactics used to sell us on the Summer Winds timeshare were dishonestWe purchased a membership in Stormy Point Village in Branson, Missouri
We would never even have considered buying a timeshare, if the salesperson hadn't told us that we would be able to reserve unlimited weeks for $*** per week--upon availability--for us or our children, in the *** *** inventory of timesharesThis was the thing that convinced us to sign up for the timeshareAs we stated in our earlier complaint, we didn't just hear her wrong or misunderstand...we asked over and over again if the $*** per week price was accurate and true, and she continued to tell us it wasHad she explained honestly that there were only weeks available for that price, out of the thousands and thousands of weeks in *** ***'s rental pool, we never would have bought the timeshareWhen we saw the "$*** - $***" price on the charter membership form that we signed, we again questioned her, and she reassured us that that higher price was only charged on very rare occasions, for instance, in a city that was hosting the Super Bowl or some other major event that weekWe believed her explanation--which ended up not being true at all
We feel that a business should not be able to explicitly lie to its customers in order to sell a time share ownership, and then hide behind a document that wasn't honestly explained
We feel that Summer Winds knowingly mislead us, and we deserve to have a refund of our $*** payment, which we paid in cash

Mr*** is missing the point of our complaint
We were NOT told that we would have weeks to choose from at $*** per weekWe were told that ALL weeks in the *** *** inventory would be available to us, for $*** with our VIP membership, with only a RARE exceptionWe repeatedly asked our salesperson if ALL weeks were $*** per week and she said yes, except for very unusual circumstances! That is not the fact and she knew it was not the factShe purposely misled us into believing her sales pitch
If she had not lied to us, we would never have even had an interest in buying the timeshare
Why is a company allowed to use deceptive tactics to ensnare their potential buyers and not have to own up to their deception? This company cost us almost $*** because of a total and deliberate misrepresentationThey should not be allowed to train their salespeople to make untrue statements, and then use a document we signed under explanations to blame us for the situation
Had the salesperson been honest with us, we would have walked away, and not have found ourselves in such a frustrating positionHow can they justify keeping our money when we bought the timeshare ONLY because of their dishonest sales practices?
We respectfully ask that they refund our payment!

Once again the contract that Mr*** agreed to was that extra weeks are priced from $*** to $*** and are all subject to availabilitywe have more than weeks for the $*** price and not only are the weeks offered by the Summer Winds travel, they can also be purchased from *** *** within the same price range
the weeks is just a guideline of the listings, some weeks they have over weeks listed for the $*** price and again that change every Monday evening, so new inventory and locations are placed on the list every week and again owner are not restricted to just these weeks
I have attached documents from the contract that was signed and initialed by both Mr& Mrs*** that states the weeks run from $*** to $***I only see one request for travel and it was available
for less than $*** for the week
Again we will not cancel this contract based on this complaint, as they can have unlimited weeks for $***

for booking or banking, the note below is from the TPI agent that talked to her on January that if the week was used she would be able to exchange it, if not she would lost the week

1) When we were recruited at the meeting, we were told first that not only would we have a week every yearsWe also would have what they called BONUS WEEKS which we could use any time and any place
2) As we spoke of getting the time share ***, and *** said that because the time share was at such a prestigious resort there would no problem to trade our week for any other place in the US or any other country(They all neglected to share that the time share that was being sold to us was for the first weeks of the yearAnd why would anyone want to go to Branson in Jan or FebAre the waterslides working then?) I tried numerous times to find a place in Wisconsin to trade our week for(Because our "salesman" said there were several resorts that would be available for us to book in Wisconsin.) From the time we got our time share and the ability to log in was at least several months and then every attempt to log in failed (password *** to us was incorrect?) at that time I attempted to contact Summer Winds via their website and received no response EVER
3) I have not seen anywhere in our papers where it shows that our Tri-C "yellow" season 2Bd cottage is listed as only the first weeks of the yearIf we were actually told that we would NEVER had even considered the purchase of this time shareWhy on earth would someone from Wisconsin even consider purchasing a time share that would be used or required to trade for someone else to use in January or February in Branson? That is insane!!!
4) When I did talk to someone to talk about a trade they said that someone would have to want our week before we could trade for the place and week that we wantedWhy would anyone want our week? It is certainly not in the middle of the summer when the weather is niceSo the possibility of trading our week for any other week is
5) We were also told that we would NEVER have to pay the maintenance fee because we could always bank it and someone else WOULD always take our week if we didn't use itThey neglected to tell us that you need to pay the maintenance fees first and then maybe they can rent out our week, that there is no guarantee of getting any maintenance fees returned to usI was told that when they sent out the billings for the maintenance fees
6) The salesmen that we dealt with namely ***, *** and *** gave a phone number to call to get assistance with our time share which I never was able to get an answer

2.Yes you can exchange your week and travel to other locations, it is not a problem for a yellow week owner to exchangewe do have owners travel to Branson in the early part of the year, and yes Branson has a water slide that is open year round
I have enclosed documents that show this to be a Triennial C yellow unit
Someone wanting the week is not the owners problem, once it is banked the owner can exchange the week and no matter what the exchange co is able to use the unit or not the owner still is able to travel
It is called a reimbursement program, so yes they have to be paid before we can reimburse them
Again this is all part of learning how to use the purchase, our customer service department is always willing to help owner understand how to get the most out of the ownershipjust call us at X-XXX-XXX-XXXX and we will be happy to help

At the time of sale Mr*** still owed money on the Holiday Inn membership, so it was listed for resale, any property that is done as a trade in must be paid in fullI have enclosed a copy of the resale

We did receive a cancel letter on this contract postmarked December 2, that was well after the five day right to cancel
We cannot understand how Mr*** didn't know he had a mortgage, he signed all the loan documents and provided a method of payment for the lenderAt this time Mr*** has stopped payments to the lender and has not made one payment to date
At this point we will allow a release from the contract with no refund of the down payment, as the cancel letter was not done within the five days allow by law
If Mr*** would like to be released with no refund of the down payment he may contact me at XXX-XXX-XXXX and I will have the account closed

All though they are not being completely truthful, because all the things they say they are giving me were already in the package that I purchased....I was not given everything I was promised because they were suppose to pay for half of our 3rd night hotel stay that they promised me when they called me begging me to come in March or April....So now I am paying in full for our third night.....I had to make many phone calls and was lied to by everyone who answered the phone....They refused to connect me to a manager, So I had to get online and find a different number to call where I finally got ahold of someone who was willing to help....She tried to push me into canceling my vacation and finally agreed to let me use my vacation that I had already paid for and made me pay 100% Of my 3rd night hotel stay....After all this trouble she finally told me that I wouldn’t have to attend their minute presentation.....Mostly because they knew that they had given me such a huge run around that I wouldn’t even give them a chance to sell me anything and I would have told others how I was treated......So given back to me what was rightfully mine that I paid for with a signed contract Isn’t being all that generous....I have learned my lesson this time to check out a company before I jump into anything again....Reviews they have on line speak for themselves

I'm not sure what Mr Elliott means by a resale listing was done@time of sale&also unit was listed a few wks later.We were told by Jackie Bailey that Ed Magee of Vacation Sevices International(this is also stated on the property advertisement form given to us by Jackie)that we would be contacted on May 20th,2016.That didn't happen,but I did get in touch w/him on the 23rd.He said then that he did not get in touch w/us because he did not get a confirmation of sale from Stormy Point.He was then emailing us a contract on the 24th,then the25th,then the 26th.Finally on June 1st(this is now attempt #5)he had me call someone named Kaitlyn&eventually got our email address correct.It seems he may always be in his car when speaking w/you&this is possibly why he can't get your email address correct.Kaitlyn then told our property had been listed on May 21st.So when was it listed? Your guess is as good as mine.When I spoke w/Kaitlyn on June16th, she told me what SummerWinds told us about our property selling in days is not true,that I should call back in months&we would talk about lowering our price.I called Ed Magee on June23rd to inquire how things our going with our "sale"& relayed Kait's advice to me,he ws going to "look into it&get right back to me personally.Didn't hear from him & so called him again July 11th.He told me then he has people working on this sale,& someone would call back that morning(then he asked how to spell my last name& what my first name was..&yet he knows what property he's talking about? Anyway of course he didn't callI called again July 20th,Kaitlyn called the following day for him&said there were no offers,and that if I hear nothung from them,that means of course there are no offers.So I now have the official "DON'T CALL US,WE'LL CALL YOU" notice.(I saved this message,it's priceless.I did speak w/someone else in customer service today,July 27th who said "it is a down market,election yrs are below average sales,yes they have properties that never sell,I should maybe call back every months&they could give me some recommendations.Really....So anyway,who is this Ed Magee?I certainly don't know,my husband nor I called him,the man that Jackie Bailey brought over to our table@the sale presentation called him.He spoke with Mr Magee first,then handed me HIS phone&I was given a price we would sell our currently owned property for&this price,$was 20% below market valueAt this point we had not been told that Summerwinds Resorts would later wash their hands of this guy and nothing that they say for 2-hrs will be true.Jackie told us they would "try"to make the sale of our property as "close to,if not a total wash" of the price of Summerwinds.This is repeated constantly.Mr Magee is then called,you're told a price,which miracle of all miracles made this a total wash!!!Of course prior to this,Jackie told us many wonderful things about owernship at Summerwinds,one of them being...the maintenance feeIf we are not going to use our week at their resort, we will be reimbursed$of our$maintenance fee.I discovered on June 23rd there is actually a MAINTENANCE FEE REIUMBUURSEMENT PROGRAM and I was advised by a custumer service rep(I didn't note who I spoke with this time,although several times it has been Margaret)to call Nov 1st to start enrollment process.She also said I can pay the fee when I make that call&they also offer the option of paying half of fee annually to make it more manageable for owners(we are Bi-Annual owners)Ironically when the mail arrived later that day stating that one half of the fee is due right now.Obviously the earlier conversation I'd was not correct.My favorite part of this?When I called for "futher details" of the MFRP,which remains "open until full"(this is the same call in which I was told they advise you to call NOV 1st to start enrollment)I asked the number that are able to enroll till full...the answer?"It varies from year to year"So,is it 10?25?50?100?200?500?How many owners are there,and what's the probability of successful enrollment,I have no way of knowing.By the way,when I mentioned Mr Magee's name to Margaret questioning his legitamcy,she know him by first&last name also.Apparently he's a very popular guy around Summerwinds! So back to Jackie,our esteemed sales executive\agent\sales rep.This fraulent business and deceptive practices are beyond our comprehension.The only way this makes sense to me is for understand that's done there is,Jackie sits with you,and tells you how she going to make "a wash"and then she should say,and I am totally lying to you right now,then bring the next guy over to with, you call Mr Magee,and then say,this also will all be lies.When it seemed the check wouldn't be sent to Summerwinds,but to us,I said I was not comfortable doing this based on a check coming in the mail,Jackie told us,this is what we do everyday,this is the price you will get,we would possibly make loan payment.I questioned this again while signing papers,again we were assured by Jackie,now joined by Imelda Nilsson,there is absolutely no cause for any concern,this will happen, you will sell this propery for$18000.They forgot to say"we are flat out lying to you right now" Jackie did tell us that when we got our check, we could use it for a car,or anyway we'd like to use it,but did suggest that we pay off our high interest loan with it instead.Ms Nilsson pretty much said the same thing later.I would assure each of these honest, upstanding ladies that since we cannot pay this loan that were such a check to ever arrive,that is most certainly what would be done.And so the following day at breakfast when I told Jackie again about my concern,she again assured me that this would happen,that we would be paying nothing,she had "made it a wash".She said with a smile,we did the right thing,we'll be *** we did this.she should have finished with"And I am lying to you right now" Summerwinds sales pitch guaranted us every step of the way,in any way possible, that there are people looking to buy th ese properties.Until I guess you go in the seal the deal office.This is sadly where we were totally scammed.In Jackie's case I guess "if you tell lies often enough they become your truth".And I guess my husband and I had suckers! stamped on our foreheads.We truly believed what we were told,htye sold us hook,line, and sinker.But we did not come up withb the idea of selling our propery,JACKIE BAILEY DID,we did nmot call EDWARD MAGEE at VACATION SERVICES INTERNATIONAL,JACKIE BAILEY and her TEAM MEMBER DID.WE DIDN'T USE OUR PHONE TO MAKE THIS CALL,OR COME UP WITH SOME RANDOME AMOUNT OF MONEY,SUMMERWINDS RESORTS EMPLOYEES DIDAND NOW THIS COMPANY SAYS SORRY,NOTHING WE SAID FOR HOURS IS TRUE.we cannot pay this loan.we need to cancel this contract

We have looked into this matter and the only complaint I see is they do not understand how the referral program works, once they send us names we call them and sell them a packageIf they tour owner get a check if they purchase
owner get a bigger checkin looking at the records we do not see that any names have been sent to us
The other matter of the contract being a Triennial, it was covered in the contract closing
As Mr*** stated in his complaint, he has stopped payment to the lender and is in default of the contractWe will allow this contract to be closed and he will forfeit all payments made to date
It will take about to days to close the contract out, he will receive a letter from the contracts department once it is doneNothing will be needed from Mr*** to close the account

and the ***'s have never contacted us with any concerns in the last years
I see a lot of questions and confusion in the complaint
that we can help the ***'s with and that are available to themIf an owner exchanges the week for some other location we pay the exchange fees , so they have no $fee for an exchange
The maintenance fees can be reimbursed to the owner if they choose not to use the unit in any given use year
All the ***'s have to do is call customer service and have the next use year placed into the program and they can be refunded $on the maintenance fees paid
I am not sure about the free extra week as we do not give a free extra week, this may have been something that was offered by Interval International and we have nothing to do with it
Yes the ***'s list a unit for sale, the listing was good for one year and has long since expired
Again we feel the ***'s need some help to better understand the purchase and we are more then happy to help them by calling customer service at 1-800-699-

We have looked into this matter and find nothing wrong with he sale and that Mr*** used the resort for his week in with no problems The Triennial purchase is called a starter package do to the fact it is our least expensive packageWe have a lot of owners that never upgrade from
