Dear ***
We have looked into this matter and find the purchase is for a Triennial useThe POA will send a statement every year for 1/of the next use years maintenance feesThe owner can pay it by the year or wait until the use year to
send the full amountOn this contract the first use year is set for
Owners can travel any time they wish, they can buy the time as they need itPer the contract and VIP charter extra weeks run from $to $from the Summerwinds travel or Interval InternationalOwner can request travel to anyplace they want to go, not all location will have a resort, sop the Summerwinds Travel may have to see about a hotel or some other type of accommodations
The resort will not allow someone on the property unless they are staying in the unitsAn owner can stop by the sales office and get a day pass *** will allow them to visit the property for the day
This is to keep the resort secure for owners and children on property
The reason we are not registered with the Revdex.com is the Southwest Missouri office will not allow any timeshare to register with them
We are always will to help owner to better understand the purchase and how to get the most out of the programThey can call customer service anytime at X-XXX-XXX-XXXX for help or questions
Thanks for your time and concern with this matterIf you have any questions, please feel free to contact me at XXX-XXX-XXXX

(The consumer indicated he/she DID NOT accept the response from the business.)
We were lied to during the entirety of the presentation and the days followingWe also called in to get more information just a few weeks ago, and received more informationWe were told we could book from anywhere between $and $499, which was made to sound like a good deal, when we are already paying thousands of dollars for a program that we cannot even use until I never even received a lto even be able to go on the website until we recently filed our complaint with the Revdex.comI will also be filing a complaint with the Illinois Attorney General Consumer Fraud BureauThe bottom line is, we just want a refund for the money paid already and a halt to future payments

Dear ***
We have looked into this and find it to be more about threats and nothing about what the real problem is with the contractMr***'s last call to customer service was in April of requesting a hardship release
The
program he purchased will allow him to travel at any time of the year as many weeks as he may neeed
If Mr*** would like to address the real problem he his having we will be happy to look into the matter

(The consumer indicated he/she DID NOT accept the response from the business.)
I agree that the original complaint was more about threats than about substanceI apologize that I allowed my anger to overshadow my better judgmentMy wife and I have just been so frustrated trying to get a vacation booked as we were told we could during the sales presentationYes, you can book trips weeks out of the year but the availability in the areas we expressed interest in is the problemWe were asked in our presentation where we liked to travel and the main places we told them was Destin, Fl and Colorado for skiingThe salesman opened the book to show us that they had properties in both locationsThat is trueHowever, what he failed to tell us was that availability for these locations was almost non-existentWe began trying to book a Destin vacation right after we bought the packageThere was no availability for the entire summerWe tried to find locations in the FL panhandle but were unable to do soTraveling to the other places in Florida with our family is cost prohibitive because of the long distanceThere were more places in Colorado than Florida but we have still been unable to book a trip due to the low availabilityIt is also very frustrating to even attempt to book a trip because their website only allows you to search for a particular resort within a particular date rangeThere is no way to search to see what is available except by dateSo you would have to be able to "guess: the exact date ranges that are available in order for it to show up on the siteIf you call to inquire, you also have to provide specific dates and the calls are frustrating because they are pushing you to give up (trade) your week at your resort instead of wanting to help you get a vacation bookedThe website is not user friendlyWe strongly feel that we were pressured to buy this property that day and were told whatever we wanted to hear in order for a sale to be closedI would love to see someone from the Revdex.com go sit through one of their high pressure sales pitches in order to understand that it is all about making the sale and not about providing the customer with a quality productWe love Branson and travel there quite oftenHowever, it is again disappointing to find a business with such lack of concern for customer satisfaction and ethical business practices to be operating there
We could be satisfied with our package if we could determine how to book vacations in the geographic areas where we expressed interest in traveling - booking years out is not an option for us(as suggested by one of the travel agents we spoke with)
We continue to believe we may qualify for a hardship case as wellIn March of this year, we found out we would be helping to raise our year old grandsonHe is staying with us most of the time which has made it harder to travel
thanks for your time
Still dissatisfied and disappointed -

Dear ***,
Again we have looked at this and find it is about availability in the pan handle of Florida,
Most resorts in that area are booked a year in advanceThe *** have the first year of use set for and they can bank the week with *** *** and put in an exchange request for the Destin area
We are more than happy to help our owners find the time they are looking for by calling the customer service department at X-XXX-XXX-XXXXAs for the web sites most travel sites search by date of travel,
again they can call customer service and they will help them find the travel and search for them if need be
If the *** are in a hardship they may list the unit for sale with a broker of their choice and have the unit soldWe will not cancel or refund the contract based on this complaint

We have recently disposed of the original property and have no need to relist it with Summerwinds
We continue to believe that the "promise" of sale used as incentive for purchasing from Summerwinds was deceptive if not fraudulentThe fact that a high price for the property was stated gave strong pressure to accept their offerThe price mentioned was inflated and a guarantee of sale within the contracted period was assured by the sales staff
We have not yet heard from the Missouri Attorney General's office with regard to this complaint

Dear Rose,
Below is the reply I sent to Mr*** on May 1st, it explains the resale listing and that it was not a trade in at allThe value is the listing for $16,Once sold he will receive the listing amount unless he makes a
deal with the agent for a lesser amount
Resale is not guaranteed, so no one can give him a guaranteed priceAt this point in time
Mr*** has not made any payments and is in default of the contract
In my latter of May1st I enclosed a copy of the resale disclosure and a copy of the resale worksheet showing the list price for the unit set at the $16,price
Thanks for your time and concern with this matter
Dear Mrand Mrs***,
I have received your letter and reviewed your concerns, the Parkway resort was not a trade in, it is a resale listing with VIS a resale agentthe listing price was set for $16,( copy enclosed )
The resale of this unit is like selling your home, you set a price and if an offer is made you can take the offer or counter the offerSo no one will be able to confirm a price until it is soldThe asking price was set for the $16,you are askingAs per the contract you agreed to the Resale Disclosure ( copy enclosed) that states we did help list a unit for resale and we do not guarantee that sale
So at this point you are in default of the contract due to stopping the payments to the lender
If the account is not brought up to date and is allowed to go days without payment the account will closed as a default and you may lose everything you have paid to date
If you have any questions, please feel free to contact me or customer service at X-XXX-XXX-XXXX

Once again *** Elliott is not addressing the guaranteed trade in value of $16,stated to us by *** Austin in our time share meeting on March 7,
We are not disputing what Mr*** Elliott stated when he said the $16,in paragraph above is a listing price for our Parkway ResortHowever, Summer Winds Resorts omitted the guaranteed $16,trade in value of our Parkway Resort in writing in contract number XXXXX if our Parkway Resort was not sold within yearThis is what was stated to the four of us by *** Austin on March 7, and this was the only reason we even considered buying into the Summer Winds Resorts
Once again it seems apparent to us that Summer Winds Resorts has no intention of honoring the words of *** Austin or *** *** (see letter dated May 11, 2016)
If this is not perfectly clear what we need in writing or what was omitted from contract number XXXXX, call me at XXX-XXX-XXXX.*** ***

Dear ***
I have talked to sales and found out what Mr*** is referring toThe sales rep told him if the unit is not sold within one year he can trade the unit in with us and it will have a value of $16,
They cannot put this in the contract because it is contingent, on the price being the same one year laterBut the sales staff feel it will be no problem

Final Consumer Response /* (4200, 12, 2016/05/28) */
(The consumer indicated he/she DID NOT accept the response from the business.)
*** *** response is not acceptable to us because Summer Winds will not put the $16,guaranteed trade in value of our Parkway Resort in writingOf course, the sales staff feels like this will not be a problem one year laterI believe what *** *** and the sales staff are really saying is: we will put in writing the trade in value of $16,for your resort but if your unit is not sold within one year, then the trade in value of $16,becomes contingent upon the value after one yearSuppose one year later at their discretion $8,becomes the new value, then will that be the new trade in value of our unit? The statement by *** *** does not guarantee the $16,trade in value of our Parkway Resort and has absolutely no meaning to usOnce again, the only reason we even considered buying into the Summer Winds Resorts was the $16,guaranteed trade in value of our resortThe true value of a time share unit is not the listing price of the property but the actual amount the unit sells forYour response is not a guaranteed trade in value but instead a play on words
I checked with Vacation Services International, the agent listing our Parkway Resort about a month ago and they had many Parkway Resort properties for sale from $2,- $30,000+ and some of these properties have been on the market for over two yearsOn May 27, I again checked the VSI website at http://vacationservicesinternational.com/ and they have a total of time share resorts available from $2,- $43,I'm sure that many of these are Parkway Resorts that are not sellingDo you think that maybe Summer Winds Resorts is overstating the value of our property so we would buy their property? On August 31, - September 7, we visited the *** *** Resort in Genoa, NevadaWe also went to a time share meeting at their resort and we did not buy their property because they overstated the value of their resort and they would only give us a trade in value of $8,for our resort
We believe for this deal to go through there is one and only one scenario that can now be accepted by usAt the March 7, sales meeting, Summer Winds Resorts and *** *** placed a $16,value on their Summer Winds Resort and a $16,value on our Parkway ResortSince the $16,value of both resorts was the same amount, then Summer Winds Resorts should be willing to trade their resort for our Parkway ResortAll future money we spend at a Summer Winds Resort will be money in their pocketsWe will sign this contract and Summer Winds can take their time selling our Parkway ResortIf they sell it for $16,000+ they can keep the differenceThis is more than a fair deal for both parties and no money has to be exchanged
No other scenario other than the one we presented in paragraph will be acceptable to usWe are tired of repeating ourselves over and over againIf Summer Winds will not accept this agreement, then send us the cancellation papers immediately*** & *** ***

Dear Rose,
Mr*** is concerned about the sales price of the unit he listed for resale, after looking at the comparisons the price seems to be right in line with the top listing set for $26,down to $11,The resale process is
just like selling a home, it is listed for a price and if an offer is made you can accept or counter offerThe purchase was made in January so it has only been listed for a short time
Nothing about the sale was as Mr*** puts it deceptive, the listing is active and per the resale disclosure, resale is not guaranteedMrMcGee with VSI will be more than happy to talk with Mr*** anytime about his listing and how to maybe move it faster

We feel that the HERD SALES mentality used by Summer Winds was a large factor in our buying the first contract.pressure from the salesman and his supervisor made it seem that we would be missing out if we did not buyLittle or no explanation was made to tell how to actually use this timeshareWe were told that we could bypass the maintenance fees by simply not using the weekA month later we were sent a bill for mantenance with little time to payWe were also told that we could start to use immediately, then later when we tried to book a stay in Hot Springs ARwe found we had to wait a full year to begin useMeanwhile we made payments each monthIn January we were called to Branson for a "Q&A" to explain our benefitsIt seems we were not alone in not having been informed in many points of ownershipAt that point we found we had to upgrade in order to sell our timeshareThe company had no problem with charging a much higher price for this upgrade, at the same time charging an out-outrageous interest rateWe have also been sent a bill for next year's maintenance fees, which we were assured we would not be charge withWe have been waiting Since January for a "refund" of part of the previous feesWe feel that this company is just a leech in the business communityLittle or no communication with clients except to ensure that "all is well"And NO, we will not go away so easilyEither they sell this property immediately or refund all of our investmentOtherwise the next step will be with our solicitors

We are NOT accepting the response from the business as we want out of the contracts we signed and a refund issuedWhy should we walk away owing more than $5,on contracts that were signed under pretenses? We were told information one way from the salesman and then of course the contracts read another wayThey NEVER asked if we wanted to read any of the contracts before signing themThey did, however, tell us the contracts reiterated what we were told by the salesman and we signed themWell, we found out what the salesman told us was not trueThis is not a good value for us and again we are now stuck paying for two timeshares which is unfairIf we would have been told the truth during the initial presentation with the salesman, we never would have signed the contractsWe do not feel this is a good deal and we strongly believe that the contracts should be canceled and all monies paid to date should be refunded to usWe wrote a letter to the company back in December 2016, sent it certified with return receipt requestedWe were hoping to deal with them directly to try and resolve the matter amicably between the parties but we did not get that chance because we NEVER heard from themSigning contracts under pretenses should be a good enough reason to make the contracts invalid and therefore the contracts should be canceled and all monies paid to date by us should be refundedThis company should not benefit from people signing contracts that DO NOT represent what they were told during a sales pitch and led to believe what they were signing was true and correct

Just for the record again: The ring binder that we got at the time of our purchase under Maintenance Fee Reimbursement, does says, "We will reimburse that years's maintenance fees if you deposit your week." If that is not the case, Summer Winds should state that only *** will be reimbursedI realize that the difference is only *** but the misleading information that is given to potential or new Summer Winds clients is where all their problems come fromSales can still be made if the Summer Winds sales teams stated the true facts to new clients and not lie to themFrom what I read or heard about the complaints against Summer Winds, they were mostly about the sales tactics not the program itself
We have not used this program yet so we will try to book a vacation and see how it worksCome October if we want to put in the exchange, we will get in touch with Mr***
According to my *** *** *** agreement, it does state that they will advertise our property until it is sold which is what their sales told me alsoSo there is no more fees involved with the sale of that property but it may never be sold either, like *** *** said it would be

Sir:
My name is *** and I filed a complaint #XXXXX in late August of against
Summerwinds for their business practices and truthfulness concerning myself, a senior citizen
Mr*** *** of Summerwinds called me apologizing and offering to help settle this with a check to
help me in my financial distress to the amount of $5,stating that it would take 30-days for
receiptI accepted the offer and have not received anything
This may have slipped by, but I settled the case based on Mr***'s commitmentI do not know if this
letter will help, but I thought that an informed reminder would be advisableIf there is anything that the
Revdex.com can do, I would appreciate it
Very truly yours,
***
