12/07/ They have been with us since We do not offer buy backsI think some customers confuse our "right of refusal" with a promise to buy backThe right of refusal means the Resort has an option to buy the unit back in the future should for some reason it choose to do soI have been through the [redacted] 's issues with the Attorney General and believe one of those Time Share Help companies also might have contacted us (those companies do not really have any clout so I just file their correspondence away)This is the first time I have had a call from a Revdex.com mediator (also, I mailed some information just yesterday to someone else at the Revdex.com)We would not be able to give them a reference on who to use as a broker to sell this as we do not want to have any responsibility for who they useMaintenance fees are past due.Are we willing to pay anything to settle this? I agree that the original complaint was more about threats than about substance. I apologize that I allowed my anger to overshadow my better judgment. My wife and I have just been so frustrated trying to get a vacation booked as we were told we could during the sales presentation. Yes, you can book trips 52 weeks out of the year but the availability in the areas we expressed interest in is the problem. We were asked in our presentation where we liked to travel and the 2 main places we told them was Destin, Fl and Colorado for skiing. The salesman opened the book to show us that they had properties in both locations. That is true. However, what he failed to tell us was that availability for these 2 locations was almost non-existent. We began trying to book a Destin vacation right after we bought the package. There was no availability for the entire summer. We tried to find locations in the FL panhandle but were unable to do so. Traveling to the other places in Florida with our family is cost prohibitive because of the long distance. There were more places in Colorado than Florida but we have still been unable to book a trip due to the low availability. It is also very frustrating to even attempt to book a trip because their website only allows you to search for a particular resort within a particular date range. There is no way to search to see what is available except by date. So you would have to be able to "guess: the exact date ranges that are available in order for it to show up on the site. If you call to inquire, you also have to provide specific dates and the calls are frustrating because they are pushing you to give up (trade) your week at your resort instead of wanting to help you get a vacation booked. The website is not user friendly. We strongly feel that we were pressured to buy this property that day and were told whatever we wanted to hear in order for a sale to be closed. I would love to see someone from the BBB go sit through one of their high pressure sales pitches in order to understand that it is all about making the sale and not about providing the customer with a quality product. We love Branson and travel there quite often. However, it is again disappointing to find a business with such lack of concern for customer satisfaction and ethical business practices to be operating there. We could be satisfied with our package if we could determine how to book vacations in the geographic areas where we expressed interest in traveling - booking 2 years out is not an option for us(as suggested by one of the travel agents we spoke with). We continue to believe we may qualify for a hardship case as well. In March of this year, we found out we would be helping to raise our 7 year old grandson. He is staying with us most of the time which has made it harder to travel. thanks for your time. As for the web sites most travel sites search by date of travel, again they can call customer service and they will help them find the travel and search for them if need be. I am rejecting this response because: We want our money back. We were lied to and Mr*** keeps saying we signed the agreement so therefore they couldn't lie to us. Well the salesman did lie. He said they would sell our other time share the same way we bought it with a presentation not just listed on the internet. I was told just lately that they did have a broker (or real estate person) working for them and then they would have sold it that way. I heard that they got into an argument and the broker is no longer working for them. That isn't our problem we were still lied to get us to sign We want our money back. It is as simple as that. We have witness's to what he said and they would be more than happy to talk with someone as to what they understood too They could sell it if they want and give us our money back.

Mr*** response dealt only with the one part of the agreement that actually may come to passthe *** condo trade-insSummerwinds failed to explain what happened to the 1/closing money we paid Nov23, 2015, which meant we paid one and a half times the closing feesNeither was their any address on the matter of our having to pay both maintenance fees ($2,000) to Star Island and other aforementioned expensesAgain, *** *** told us that we would pay our 1/that day, we would pay no maintenance fees for 2016, and he would take care of everything else for usWe have a large compilation of correspondence, non-responses, and phone records to evidence that no one at Summerwinds regards their culpability in any facet of this unscrupulous deal
We do not accept the lie that we could get 7% interest on the loan, paying 15.9% instead
Furthermore, we want reimbursed for the payments we have made on the upgraded condo and our contract voided so that we have no further affiliation with Summerwinds Resorts
Let me stress that this company lied on various matters and have left us with a sizeable balanceWe do not accept that the company will fall back on the fact that we had an opportunity to back out within five daysThey take honest, hard-working vacationers, set up an update for the next day after arrival, hold the vacationers as a captive audience for, in our case six hours, do not go over the paperwork to verify that the promises are in the stackThen, they know that a vacationer will not look over the papers they presumed to back up the verbal deal while they are still on vacationIt is a perfect scam, and we plan to file a legal suit unless we are recompensed the monies paid to Summerwinds Resort, Resort Funding, and Resort Closing, (one-in-the-same company), and our contract is not voided at no cost to us
Let me repeat what reimbursement we expect, which is not even a nominal amount to a large corporation:

We have tried to work out the problems with this deal and the trade-in's, we have change the use year for them and worked with the trade in agent to make sure the units were transferred and such
As per the contract the maintenance fees had to be paid to turn the unitsNo closing cost for the trade in was taken the day of sale, we do not collect any cost for third party agents at the point of sale
We will allow a cancel and refund of this contractWe will have the account closed and a refund to Mrs*** within days
If Mrs*** wants to cancel the trade in she can contact TSTI and inquire about the cancelation process

When I called Star Island April and spoke to *** in collections, he told me that the units were no longer in our namesTimeshare Trade-ins is the legal ownerAfter a duration twice as long as it takes to buy a home, we have closure on one part of the deal with SummerWinds Resorts
We were pleased to read that Compliance Officer *** *** stated in his latest response that SummerWinds will allow us to cancel our contract with a full refund within daysOur paperwork verifies that the cost for the 4-bedroom upgrade is $61,Our initial loan amount contracted November 23, totaled $33,The difference is $28,($20,for the Star Island trade-ins + $8,equity in our 3-bedroom at Stormy Point, which we applied to the upgrade.) Additionally, we have made payments to Resort Funding, for a total of $2,and do not expect another auto-payment in May of
We will stand by our part of the agreement to pay 1/closing costs for the Star Island tradesSales Rep*** *** did not go over the Timeshare Trade-ins contract with us because it would have contradicted his verbal promisesWe cannot locate any paperwork from November with our signatures that we agreed to anything except the 1/closing costsThe remainder of expenses, which Garth Gunderson assured us that he would "take care of", we still do not believe we owe(That amount includes $paid to Stormy Point on Nov23, $+ $charged by Resort Closings on Dec28, and $1,+$1,charged by them on Jan11, 2016, we never agreed to pay the day we made the deal.) The total refund, including trade-ins and charges to Resort Closings and Resort Funding, totals $37,This is the fair settlement we expect to close this matter without further action necessary
We will wait for a response from SummerWinds until April before forwarding a copy of this correspondence to the Missouri Attorney General's office as they are also working to mediate this issue for us to avoid legal actionHopefully, we can reach a resolution by that time

We have looked into this matter and find the sale took place in 2013, the resale listing was good for one year and has since expiredAs part of the contract the resale disclosure clearly states that if the unit is not sold the
owner is not entitled to any refund or cancellation of the Summer Winds contract

Now to address Mr*** responseAlthough, your offer does not satisfy me 100%, due to the fact that no refund will be given, I will accept itHowever, we feel like we deserve one since Mr*** *** our sales rep, knew we had not interest in another time-share since we had one already and were not satisfied with that one eitherHe ensured us that my timeshare with the other company would be listed and soldHe took 10-mins with an estimated sales priceI sent the required docs of the timeshare to be soldAfter not hearing back in a month, I called to confirm the info had been received and inquired why no one had contacted meI was told there was no offer yet and since February 2013, I have not heard back from them and still feel he misled and scammed me
I entered into agreement under the expectation that you'd sell my other timeshare but as of this day it hasn'tI will not accept your offer to relist the unit at no cost until it is soldReason being that there's no guarantee that it will be sold this timeI did not get the services expected then, and Mr*** did not inform me of the resale disclosureSo I do not feel comfortable with Summerwinds doing so
