Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

The business' response does not address the issues raised in my complaint and it specifically ignores my requested relief. All that the business does is reiterate its bait and switch tactics of requiring me to cancel my pre sale membership and sign up for a more costly membership at an alternative location in order to work out. This is unfair given that it was represented to me that this gym would open in October and it is now December.  While I understand that this delay is beyond Blink's control, I am quite dissatisfied with what is within Blink's control: its response. I've been without a gym during this time and I'm equally dissatisfied that Blink (which is a chain) is unwilling to permit me to use alternative facilities. I don't want to be and don't think I should be forced to pay for a more expensive membership after patiently waiting out this delay.

Hello,
Thank you for reaching out to us. We looked into this matter and see that this member called to request cancellation. We informed the member on multiple...

occasions via phone and email that we do not accept phone or email requests to cancel Blink membership agreements. Per the membership agreement that all members must sign and agree to prior to joining Blink, cancellations are processed by either visiting the club, filling out a cancellation form at the front desk, or by submitting a certified letter to:
Blink Member Services
[redacted]
[redacted]
We process cancellations this way as it provides a receipt of cancellation for you in the event that there’s a discrepancy. We do require a 45-day notice with a pro-rate to be collected from the date the cancellation form is signed or from the date the mail is postmarked.
We offer a certified letter option for those who have relocated or are unable to visit a Blink location for various reasons.
We see that this member has been a member of Blink Fitness on two other occasions and has abided by the cancellation policy.
The member has never mentioned a medical condition prior in any email communication with our Blink staff. If the member is unable to work out for a period of 6 months or more and can provide Blink with a medical note signed by a physician stating this, we will be more than happy to adjust the account accordingly.
With that said, our member services manager cancelled the account as a customer service gesture effective immediately and waived the 11/*/16 balance. This is despite the member refusing to follow the proper cancellation procedures for their third membership.  Since there is no record of a cancellation request in writing on file or a certified letter, the member is still accountable for the 10/*/16 balance.

We look forward to resolving this matter in a timely fashion.
Best,
Blink Fitness

I have never walked into the store a day in my life and was billed for $69 and get this I have to pay a $3.87 cancellation fee. To top it off I only joined for a $1 and the manager was not budging to assist with any reduction in payment. Thanks blink fitness for taking money that I picked off trees to give to a gym I never used a day in my life. As usual I'm 100% sure this is common and will not get resolved.

Hello,

Thank you for reaching out to us. When joining Blink Fitness, all members are required to sign up via a Kiosk or online via the website. All contracts...

are digitally signed. This member did in fact sign up for a Grey membership which is month to month membership with no set obligation period. It does require a 45 day cancellation notice. The contract for this membership is on file and is digitally signed. We're happy to provide a copy to the member directly as well. Also, we currently have no email communication from this member inquiring about cancelling his membership or regarding any balance. The cancellation policy is listed on all contracts and steps to cancel a membership are below.
Cancellations are processed by either visiting the club, and filling out a cancellation form at the front desk or by submitting a certified letter to:

We practice this methodology as it provides a receipt of cancellation for you in the event something isn't processed properly. We do require 45 day notice, with a pro-rate to be collected from the day the cancellation form is signed or the day the mail is postmarked.

I will only allow 72 more hours to resolve before I agree for my card to file a dispute.

Hello,
Thank you for reaching out. I looked into the matter and see that this member did join our Valley Stream location during pre-sale. This means the member...

would secure a discounted pre-sale rate and only pay a $1 start-up fee at the time of joining. They did not have access to any other location as they did not pay any monthly dues to utilize the facility at that time.  Since Valley Stream was delayed in opening its doors, we offered a free membership to all Valley Stream pre-sale members who joined prior to 1/*/16. This was communicated via email. The location did open its doors on 3/**/16 and a notification was sent to the members days prior.
Cancellations are processed by either visiting the club, filling out a cancellation form at the front desk, or by submitting a certified letter to:

Each member had the entire pre-sale period of time and 15 days after the opening date of Valley Stream to cancel their membership per buyer’s remorse, receiving a full refund. However, this member did not cancel their membership. A balance began accruing because the credit card on file for this member's account was declined. We've attempted to reach the member via phone and email using the contact information they provided at sign up to no avail. Blink memberships are not based on usage. A member pays a monthly fee to belong to Blink and they may utilize the gym as much or as little as possible.

Hello,

Thank you for reaching out to us! We looked into this matter and see no communications to our member services email address at [redacted] from the member's email address on file in our system. We also see no record of a cancellation on file for this...

account. Cancellations are processed in person at the front desk by signing a cancellation form or by sending a certified letter to our corporate location. When cancelling, a prorated fee is collected for the required 45 day notice. I see no prorate was collected for this member's account. Here at Blink Fitness we attempt to be as transparent as possible. We list the cancellation notice in the terms and conditions section of the contract which all members must agree to prior to joining. We also list the cancellation policy in the FAQ section of the website. The 45 day notice is listed on each page upon joining online ajd on the kiosk after selecting the preferred membership class.
If this member is able to provide proof of cancellation, we would be more than willing to adjust the account accordingly.
Best,
Blink Fitness

As I previously mentioned if the associate had told me I could not cancel over the phone then I would of came in however at the fault of your employee I was not properly informed and yet you keep giving me the same response. As a company you should take fault for your employees training, telling me the same thing that I'm complaining about is not a resolution to the issue. I unsubscribe to your e-mails since I was getting an abundance and I was never informed by telephone especially since YOUR OWN MANAGER SAID 'we do not call clients because we have too many' so once again that information is false. Like I previously said the only time I was notified was when a letter was sent by your lawyers so there is no way I could of responded in time being that I was never informed. Your policy and actions are completely contradicting. I am still not getting the proper customer service I deserve for your employees mistake.

I phone [redacted] on 3/**/2015 to discuss his feedback. I left a message and will be sending him an email explaining the membership agreement. [redacted] agreed to the $20 monthly rate which allowed him...

access to multiple facilities. There was a change in our offering where certain clubs were charging $25. Blink honored the $20 for the 12 month agreement and sent [redacted] a email which notified him of the change for his consideration which he referenced in his letter. It is also stated on the agreement which [redacted] acknowledged when joining. The agreement states "The monthly dues will continue to be deducted each month at the monthly rate then in effect. Blink will provide thirty days' notice to Member of any change in the monthly or annual rate."

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

The phone number on the response from the business was the [redacted].  So I went there to collect my refund of $37.11 which is what Blink offered.  That was during the week of April **, 2015.  I met Crystal at the front desk and she said she wasn't authorized to give it to me.  That would be up to Tracy, the manager.  Crystal left Tracy my message along with the note from the business regarding my overpayment of $37.11.  Tracy was supposed to call me back.  Today is 4/**/16 and I haven't heard from her.  Will Blink permit anyone from that gym to refund my money in cash since that's how I paid it?  I do not want to use my credit card.  Please let me know when I can collect it.  Thanks.  [redacted]

Hello,

Thank you for your inquiry. I looked into this matter closer and see this member reached out to us in email on 10/**/15 stating the following:
255);">Dear Blink Staff,I would like to possibly freeze my account until the new gym opens closer to my home. This would also help me to get over the financial disposition that I am experiencing at this time. I have not been there in a while and I am still being billed but I do not want
to cancel my membership. Is there anyway around this?Best,

We quickly responded within 24 hours the following:
Unfortunately we do not have a freeze or membership on hold option.  If you wish to stop future billing you will have to submit a cancellation from in person at the club location or via certified mail.

The member quickly followed up asking if we could waive the fees accrued to date. We replied by stating our memberships are not based on usage. Members pay a monthly fee to belong to Blink. They may utilize the facility as often or as little as they choose. We do not refund membership dues because of non-usage. The member reached out several more times repeating her request. We continuously and consistently explained how Blink memberships work to no avail.
Kindly,
Blink member services

Thank you,

Hello,

Thank you for reaching out to us. We've looked into this matter and see that the original credit card is still listed as the primary payment source. I have removed that credit card and replaced it with the member's preferred credit card.
We sincerely...

apologize for the inconvenience and for the length of time this has taken to be resolved. As a customer service gesture, we have refunded the most recent payment on 1/**/16 back to the credit card used. The next billing date will be 2/**/16 which will be charged to the new credit card on file. Please feel free to reach out to [redacted] if you have any other questions or concerns.
