I am rejecting this response because: It is completely evident that Ava's has a pattern of deceitful business practices given they have an [F] rating with the Revdex.com, they have entire Facebook page devoted to exposing what a scam they are, and the negative online reviews are countless This only affirms the fact that when you are online you had better do your research to avoid being scammed I only wish I had researched Ava's before calling them Ava's will defer to their Terms of Service, and they can write whatever they like in their terms This, however, does not give Ava's license to act fraudulently First, I thought I was dealing with a local shop because of the way the misrepresent themselves in their advertising Then, I was lied to on multiple occasions about the delivery date of the flowers, once over the phone when I originally ordered the flowers, and once via email later in the process When I found out the flowers had still not been delivered when I was told they would be, I began to investigate and called Ava's After being on hold forever and being disconnected multiple times I was finally prompted to leave a call back number and was not called back until the next day I was then informed they would be arriving late and was given zero chance to cancel and/or get a refund Finally, when the flowers arrived (days after I ordered them) they were not in satisfactory condition and were refused at the door When you look into Ava's (and you do not have to look very far) you will find that this scenario repeats itself over and over This is definitively fraud and it's criminal The only resolution to this situation is a full refund in the amount of $

To Whom It May Concern,As advertised on our website, We at Avas flowers do not promote that we are nor have even been a local florist, as shown on our website under out terms of service it states that we operate nationwide with local florists:Legally Binding ContractThe first thing you should know is that this Agreement constitutes a legally binding contract between you and Avas Flowers Our official company name is Flower Tech Center, Inc., but we operate under the name Avas Flowers Hereinafter, whenever we use the terms “Avas Flowers,” “We,” “Us,” or “Our,” please note that we are referring to Flower Tech Center, Incd/b/a Avas Flowers We are located in Mahwah, New Jersey, but we operate nationwide by working with local florists We also often use FedEx and UPS for delivery, which we will cover in more detail below.The information that was given to Mrs***, from the local affiliate was information, due to the fact that all orders are sent over with a specific recipe for the product purchased by the consumerAt this time to resolve the complaint, we have went ahead and refunded Mrs***, the amount of $back to the card that she has used a the time of purchase: The order has been refunded - Amount: $vs Transaction [redacted]

My apologizes for the issues mentioned Avas Holiday Delivery policy:Holiday Floral Delivery:We cannot guarantee delivery on a specific date for busy floral holidays like Mother's Day, Thanksgiving, Christmas, and Valentine's DayTo maximize the likelihood of delivery on one of these busy floral holidays, please place your order at least four days in advanceOrders placed within days of Valentines Day and Mother's Day DO NOT HAVE GUARANTEED DELIVERY DATESNeither cancellations nor refunds will be issued on orders placed during the Valentines Day or Mothers Day holidays if the order was placed within days of the holiday, and subsequently delivered within days after the respective holiday ON LINE ORDER PROCESSING:In order for a website order to be processed, the customer "MUST" check our TERMS of SERVICE prior to placing the orderAt that time, the customer has the choice of viewing those terms and policiesWhether they read read them or not, they are bound by those termsThe customer MUST approve the acceptance of those terms of service before finalizing the on line order or the order will not be placedPrior to the acceptance of "the terms of service", all of the charges for that order are shown and MUST be reviewed before acceptance of the order
