[Your Answer Here]If commerce payment systems wasn't operating a fraudulent company I may be satisfied with the terms however,  what I was sold by there sales rep [redacted] was far different then what I received.  First of all cable, electric etc. Doesn't call there potential customers and offer them a package that is totally different than the package that they actually intend on maliciously selling you.  Furthermore I think that commerce payment systems is the only company around that won't accept a written cancellation, a phone calk to [redacted] notifying him that I cancelled, and also another email to the underwriting team to cancel me.  I went through the underwriting process in The summer yet I've been charged since Even furthermore I have [redacted] recorded telling me far different terms that were untruthful and AGAINST THE LAW.  this company has a record of pissing off its customers and lying and cheating if they don't simply want to return my money then I'm prepared to play ball bring it on commerce payment systems.

After carefully reviewing your merchant account, all rates

have been charged as per contract.
 
Nonetheless as a courtesy, a refund has been issued on
Merchant id ending in [redacted] total of $198.00 and under Mid [redacted] total refund
of $139.00. These were the charges that were charged from commerce payment
systems. Due to the fact that the fees were charged as per contract, unfortunately
overdraft fees were not approved for reimbursement. Please expect the refund to
post within 48-72 hours back to the bank account we have on file.

[Your Answer Here]I spoke to [redacted] in reference to my complaint and he seemed confused as to why I filed one to begin with. Yes, I am frustrated with his company and the way they run their business. Because of the verification failure, to which I still do not understand why the doctor's personal home mortgage came into play, my business has lost some of its funds because we did not get all the information back that the company promised. So I had to send a letter to all my patients that used their card with [redacted]'s Terminal and ask them to come by and use the new terminal we had to contract. Some patients have come by, but we do not expect to get the full funds we originally charged. The terminal that we contracted with cannot just take the account number, it either needs the card to be present or additional information needed that we may not be able to get. This frustrates me even more because not only has this whole situation inconvenienced my business and my patients, but now I have lost some of the funds that were originally owed to me. I feel like nothing was resolved and I tried to explain this to [redacted] I felt like he was ignoring the issue and I was done arguing with him and I told him as far as I was concerned it was "water under the bridge" because talking to him is impossible. I read many reviews from others who had the same issue I had and some even said the company was a scam. My point is, nothing has been resolved because now I have new issues recollecting from patients.

a result, the merchant account had been declined. The merchant was asked security questions based on
their credit report but the merchant was not able to answer any of the questions. 
Merchant understood and will be processing the sales with a new credit card processing company.

The funds were just deposited in the amount of $198.75.  We closed the accounts in October 2013. In October we were charged $19.95 and $20.00 for the minimum monthly charge. In November, again $19.95 and $20.00. In December $118.95, $118.95 and $119.00. In January 2014, $19.95, $19.95 and $20.00. In February, $19.95, $19.95 and $20.00. March, $19.95, $19.95 and $20.00. April, $118.95, $118.95 and $119.00. May, $19.95, $19.95 and $20.00. In June $19.95, $19.95 and $20.00. We attempted to close that bank account and move our business to another bank and discovered we were overdrawn because they attempted to make yet ANOTHER withdrawal.
I was assured the accounts were closed in October and again in June, perhaps I should have paid more attention. Either way, I reached out by phone, by email and by fax. The management is ALWAYS in a meeting, They DO NOT return calls. Only when I made this report to Revdex.com have I received a halfway resolution. Commerce didn't even have the decency to correspond with me directly.
All told, we are owed $1,093.20 plus the overdraft fees from Community first in the amount of $65.95, minus the $198.75. Final amount as of today - $960.40. The longer Commerce delays, the more fees are attached. Should I also include the numerous man hours wasted attempting to contact them? I cannot close the bank account because Commerce will not issue a check, they will only refund to the bank where the funds were removed. Community First, our bank, wants their monthly fees for an open account, and rightfully so. Please tell me what I am supposed to do? How can I continue to run a business when I spend my time chasing money that was wrongfully removed from our account?
I want this resolved NOW, I have been patient, I have been resilient, I have been persistent.

I sent in ALL the items requested by Commerce Payment Systems - BOTH SETS OF REQUESTS - the second ASTONISHINGLY coming TWO WEEKS AFTER they had told me my account was opened and had ALREADY SENT me my ACTIVATED PROCESSING TERMINAL. In the INITIAL set of documents, on June [redacted] I sent a copy of my CA driver’s license, a copy of a voided business check from my company, [redacted] and a copy of my business license from the city of Orange. I subsequently, later in the same day, received an APPROVAL of my application from [redacted]. And subsequently we made arrangements for him to send my credit processing terminal to my booth at the venue I was working, the San Diego County Fair. In the HIGHLY UNUSUAL SECOND REQUEST FOR ADDITIONAL DOCS AFTER ANNOUNCING THE APPROVAL OF MY ACCOUNT, I sent a copy of my passport, a copy of purchase orders for merchandise from TWO separate vendors we use, and a picture of our booth at the San Diego Fair in lieu of marketing materials, which we don’t spend money on. Our product on display IS our marketing material. Our booth has a banner that advertises our trademarked product, ‘Diamond Illusions’ jewelry, while in the background, hanging on the booth grids, is a LARGE sign with our company name, [redacted] in LARGE LETTERING.  For security and privacy reasons I blacked out my passport NUMBER when submitting the copy of that, but all other info was visible - ie. photo, date of issue and expiration, AND MOST IMPORTANTLY birthdate -- b/c that was the reason they gave for needing the passport or birth certificate in the first place, to VERIFY MY BIRTHDATE. This HIGHLY sensitive document is NOT something I think ANY private company is entitled to - and I have NEVER had ANY merchant processing company, or ANY company for that matter, EVER request. This company requested a copy of my passport FOR THE STATED PURPOSE ONLY of VERIFYING MY BIRTHDATE. The passport copy I sent DID THAT -- BUT this company's underwriting dept declared that I had submitted an 'altered' document because I kept my passport number private. It is WHOLLY RIDICULOUS to label that as an 'ALTERED DOCUMENT'. Commerce Payment Systems underwriting dept ALSO referred to our booth picture as ‘mismatched documentation’ on our company name, because of the banner with the trade name of our merchandise, and our company name on a separate large sign in the background – another WHOLLY RIDICULOUS assertion. ADDITIONALLY, this fraudulent company NEVER, even during that two-week interval BEFORE the second request for additional verification info, deposited ANY of the credit and debit card proceeds into my account - DESPITE ADVERTISING the quickest turnaround in the industry! This company, AT A MINIMUM, owes me FULL INTEREST EARNINGS on the proceeds withheld for over 7 months (even longer, by the way, than the six months their underwriting dept  advised me when they sent an email regarding closing my account; apparently and obviously, this company SEEKS to freeze customer accounts and then will just sit on them, earning interest, unless and until the customer calls outside attention to it.) They made NO EFFORT AT ALL to get my funds to me even AFTER the six month period of holding onto my proceeds specified by their underwriting dept. – which was done in the first place supposedly to "protect me". What **! It is obviously no accident that this company has an 'F' rating with you!! Their M.O. is to scam businesses, sit on their funds for as long as possible while collecting interest on them, AND, IF they hit the jackpot, retain all the funds from any business that just walks away from their con tactics. I would have responded with my Revdex.com and NY Attorney General complaint MUCH SOONER if I hadn't still been busy with the ongoing Fair season, AND if my wife hadn't filed a divorce petition and summons in the interim, keeping me busy.However, I think this company owes me EVEN MORE under the law for Breach of Contract - ie. damages. So I think I will let my complaint already sent to the NY Attorney General's Office of Consumer Affairs play out for a LONG-OVERDUE FULL CRIMINAL INVESTIGATION OF THIS COMPANY, rather than letting this despicable company off the hook by just FINALLY giving me WHAT THEY OWED ME to start with OVER SEVEN MONTHS AGO!! Hopefully, they will face punitive actions by the AG's Office, as well they should. With an 'F' rating, they shouldn't still be in business to prey on MORE unsuspecting merchants. Hello [redacted],Thank you for submitting this information, with this merchant information we were able to further investigate the cause of the debit. In conclusion when you had initially set up your merchant account, your account was set up as a Sole prop. After speaking with the underwriting department, it was concluded that your business is an active LLC. Due to this your are account was then set up as an LLC due to tax id number update in which will effect the year 1099k form. This explain why the sole prop account remained opened. When the cancellation request came it was for the LLC merchant account. We deeply apologize for the inconvenience and for the miss communication this has caused. I have confirmed that all refunds have been issued and also your merchant account are officially closed. We tried reaching out to you several times to provide you a courtesy call to address the issue at hand.David D[redacted]

I believe to only reason that a refund was issued is because of the negative publicity of a negative Revdex.com report.  You say that the fees charged was in my contract?  So then you admit that what your sales people state differs to what is actually charged.  No one will agree to pay 31+ dollars a month, in addition to undisclosed charges from [redacted].  Also, you say that I never officially cancelled?  Not only did I officially cancel, but the proof of the cancellation is attached.  I was willing to let everything go, then you had the audacity to make these false statement to make yourself look good.  It is obvious that I am not the only victim of you company.  You have a pattern of deception.  I want all of my data, contact information, bank information permanently removed from your system  immediately!!
