I met with the D.RHorton rep this morningWe went through all the issues line item by line itemEmails were sent out for work orders and purchase orders during our meetingHe assured me everything would be repaired or replaced in a timely fashion. I was also contacted by the D.RHorton warranty division who explained how the process works and asked to be kept in the loop as the repairs are completed.Feels like I'm in good hands now and I am cautiously optimistic.*** ***

This response is completely shady and misleading as are all communications with this companyWe have not received any phone calls from this person or anyone else so it is incorrect to say that we have not responded backI have continued to email the sales manager to ask him why no one has contacted us and when we can get our money backWe have not heard a peep from anyone from this company in over two weeksI also have over a dozen emails between me, the sales manager, and the sales agent making it crystal clear that we have terminated the contract and want our deposit backSo please don't say that you all were unaware that we wanted to get out of the contractThat is just an outright lieAlso, the sales agent never told us about the appraisal like you said and the mortgage company only disclosed it to us after I badgered them about for daysI'm still waiting for your sales agent to talk to me about the appraisalYour sales agent never communicated about anything unless we physically tracked him downAlso, stop telling me about your two homesites left to sellI can provide you an email from your sales agent in April saying that they were going to start converting the garage and would be ready to start settlingThen the appraisal came back low and all of a sudden you all are not going to be able to close until late September which just so happens to be when the original appraisal expiresHow convienientAt this point, all of this is irrelevantWe would rather live in a cardboard box then do business with you peopleI'm going to say this one last time just so you can't say you didn't know, I'll make it clearWe have terminated the contract pursuant to the VA appraisal clause in the contract and federal codeWe wouldn't buy that house if it was the last house on this planetDon't bother sending us a settlement letter to tell us "the good news." Just send us our money backYou guys think you can push us little guys around but we've had enoughYou should all be ashamed of yourselves

Please enter your reason(s) for rejecting the business response below.First of all, only once did I ask the builders repair crew to leave my home because they removed the carpet and padding in the family room which was flooded, replaced the padding and proceeded to install the old carpetI told them if they weren't go to replace the carpet they can leave The contractor already knew my position on using my living room carpet to replace the carpet in my bedroom closet before they made the appointment to make the repairs to my home caused by their negligenceIf they would've installed the correct membrane in the shower when it was installed it probably would have never leakedYour rep told me that the permanent membrane was never installedNowhere in my warranty does it state that that I have to supply your company with the material to get your job doneThe carpet in this house belongs to me and it's not yours to use at your discretionThat does not excuse you from your responsibility to make the repairs to my homeD R Horton already knew my position about using my carpet in my living room before they scheduled the appointment on May 24th so that's no excuse for not showing up Furthermore the issue with the carpet is minor compared to the rest of the damage done to my home due to your negligenceDrywall in the kitchen has to be replaced along with cabinet facing, most of the molding and some repairs to my hardwood floorsThis incident happened almost months ago, I could have had another home built by now, so there's no excuse for my home to still be in this condition The contractor is absolutely right, I'm not going to allow them to remove my living room carpet because they said the new carpet may not match the old carpet which means that if you replace the carpet in my formal living room its not going to match the carpet in the rest of the homeI've already had enough problems getting D R Horton to repair issues with this home since I closed in Oct I refuse to allow them to bother somethingI that I don't currently have a problem with knowing that there's a great possibility that's it's only going to cause more problems. For the entire month of September, *** *** did not return my calls or emailsIt is only after this complaint was made that he attempted to contact meOther that dropping off a hinge pin.ITEM -We realized that day, we were never supplied with hurricane shutters by DRHorton for the front door and are still waiting on DR Horton to supply the proper shutters*** *** did allow us to retrieve some temporary shutters from another home across the street.ITEM 2- There are three hurricane bolts that need to be replaced as they came our of the masonry when we secured the shuttersITEM 3- Also, when the contractor drilled the holes for the front door hurricane shutters, the masonry dust permanently stained numerous pavers on the front porch, These pavers need to be replacedThere are also a couple of pavers in the front right corner of the driveway that need replaced.ITEM -We are also need DRHorton to correct a drainage problem in our yard, which may be caused by a leaking pipe in our neighbor's side yard *** *** ***ITEM - We are waiting on the paint contractor that DR Horton uses to caulk a tub end cap and paint trim under the kitchen island. ITEM - Additionally, we are waiting for the stone company to fix the stone on both columns of the garageThe top of one column is not level and both have cosmetic issuesWe have since been contacted by the stone company and I believe a work order has been submitted.DR Horton has also scraped the back porch since this complaint was originally madeWe are willing to work with DR Horton and look forward to the contractor finishing the workThank you,Regards,*** *** *** ** ***

This is the current schedule for *** *** *hower repair Tile- Install on Friday this week and grout on Sat Placed a call to the Shower Shop to schedule the re-install on the doors (hopefully Monday or Tuesday) Trim and paint after all items are installed

We maintain that the original hot water heater and air handler system servicing your unit were codecomplaint and properly installedIt should also be noted that your unit obtained a Certificate ofOccupancy from the Borough of Conshohocken prior to your purchaseHowever, there is clearly adisconnect regarding how the system is designed and operatesWe will call you to obtain the contactinformation for the plumber that serviced your unit and claims that the hot water heater/air handersystem is defectiveIt is our hope that a review of the system by your plumber and our servicedepartment can resolve this matter

This is the response to the complaint made by *** *** *** Home scheduled the 1st walk through with Mr*** a week or so prior to closingDuring this walk a list was made on items Mr*** thought needed repaired or replacedWe (Emerald) immediately started making the
necessary adjustmentsTo my knowledge all items were addressed before closingMr*** sign off on paperwork stating ALL items were complete It was several weeks later we received a day list of items that Mr*** wanted us to take a look atOur project manager meet Mr*** at his home and began working on the listit was a few weeks later I received an email from Mr*** asking me to get involvedI emailed him back and we agreed on the date to meet Dec 2nd. I (*** ***) *** *** and Mr*** meet at Highland at 9:on December the 2nd to review the day listWe walked around the entire home inside and out addressing each item on the listOne of the items on the list was about the gutters and flowerbedsMr*** wanted *** to install some underground drains attached to his gutter downspouts, because when it rains his flower beds fill up with waterI then explained to Mr*** that was not covered on WarrantyIn his subdivision we had inches of rain in the last days……I showed him where the mulch was blocking the water from draining out of the beds and he would need to keep this free and clear of debrisHe said he should not have to do thatWe agreed to disagree I came by to check on things a few days later and noticed some items on the front porch, so I went to inspectIt was notices from several of our trades that had been scheduled to do some of the repairs we talked about…I guess Mr*** didn’t show up to let them in to do the work(photo’s attached)We will continue to take care of Mr*** list and agreed upon items needing attentionOnce we have a completed signed off list from Mr*** we will notify the Revdex.com We have done everything we can to make Mr***’ experience a positive one *** * *** Construction Manager Inter-City Operations Manager

Please accept this correspondence as D R Horton, Inc.’s final response to the Revdex.com with regard to the above-referenced complaint On Sept 28, we pressure washed the driveway at the direction of the Area Mgr to see how the concrete would hold upOur pressure washer pro and our Area Mgr both reported there was no dislocation of surface material and it appeared to be in good condition with no loss of integrity Therefore, we stand behind our decision that the concrete is in sound condition and the request for repair has been deniedIt is our company policy that concrete surfaces are excluded from warranty coverage after closing on the home as acknowledged by the initials and/or signature of the buyer on the closing paperwork Sincerely, *** ***

Please see our response to above referenced claim: The homeowner has brought to our attention an area of his driveway that holds water and also a slope in his driveway. The solution to alleviate the standing water in the driveway is to grade his yard in such a manner that the
water has a place to drain from his driveway towards the ditch located outside the front of the referenced property We proposed the grading solution to the homeowner, but he has rejected the offer and demanded that the culvert, which is actually located outside the property boundaries, be replaced and a portion of the driveway be replaced as well The driveway was poured as necessary to cross over the culvert and to the home, while also sloping for proper drainage to the ditchThe slope in this driveway is gradual in nature and well within acceptable standards. For these reasons, we have denied the culvert and driveway replacement portion of the claim However, we are more than willing to complete the proposed grading modifications to alleviate the standing water in the drivewayWe look forward to completing this work promptly if granted permission by the homeowner

We received the customer’s request to cancel their sales contract, and we sent the cancellation notice to *** ***Per the terms of the sales contract, the deposit is non-refundable

In order to hold a contractor accountable for an alleged defect, the contractor must be afforded a reasonable opportunity to inspect the alleged defect and if applicable provide a repairThe homeowner contacted the builder and the original plumbing contractor after the repairs had been completed by a third party paid plumber

We have investigated the home at *** *** *** *** *** *** with the Residential Warranty Co(RWC) The repairs made (January 2016) to the home by DR Horton contractors and supervised by DR Horton staff were at the direction of the RWC’s structural engineerThe home had a
concrete shrinkage crack through the finished flooring, which was epoxy injected and finished flooring material (tile) repairedThe concrete crack was measured 1/8” of 1” inch at its widest point (NOT 3” inches in width as described in this complaint) The crack was measured with a crack gauge by the structural engineer during his inspection and the repair plan/protocol provided by the same inspecting engineerAfter receipt of this original complaintI contacted the RWC ,where I requested the RWC to please contact the homeowner and arrange for a re-inspection of the home and to provide the homeowner with their findingsThe RWC has made contact the homeowner and scheduled the re-inspection for June 29, at 1:00PM If you have any questions, please feel free to contact me Respectfully, *** *** WARRANTY MANAGER

Thank you for purchasing a D.R
Horton home. However, it has come to our
attention that you believe there was improper conduct on behalf of your real
estate agent and D.RHorton regarding the pricing of your home because the
pricing on the home configuration sheet you were handed during
your initial
visit was different from that in the
multiple listing service (MLS). Please
note that your allegations were taken very seriouslyWe immediately contacted
our sales people for further information.
Based on information presented, we adamantly deny that there was
anything improper about your transaction. As was explained to you prior to you signing your contract, the price listed in the MLS reflected the
incentives being credited towards the purchase price of the property. The home configuration sheet you were handed
showed the unadjusted price. It should
also be noted that the agreed upon purchase price for your home was thousands less than the price listed in the MLS.
Our sales representative also explained to you that if you had
constructed a home with the same options on a different lot within the
community that you would have paid $20,more than the purchase price of the
home you selected. Frankly, we thought this matter
was resolved to your satisfaction. After
all, you signed a contract based on our explanation. Additionally, the attorney you retained never
raised the pricing of your home as a concern during his review of your
contact. Furthermore, neither you, your
real estate agent, nor your attorney objected to closing at the agreed upon
purchase price. Perhaps this is just a
misunderstanding. Should you wish to discuss this
matter further, please do not hesitate to contact me
